DEED OF EASEMENT
WALTER GILMORE, as Grantor, hereby grants to the CITY OF
SAN LUIS OBISPO, a municipal corporation, San Luis Obispo County,
California, as Grantee, the following easement in the County of
San Luis Obispo, State of California, to wit:
Parcel No. 3. An easement for sanitary sewer
and access roadway purposes over and across that
portion of Lot 4 containing 35.42 acres, as laid down
and designated upon the map attached to the Decree in
partition rendered out of the Superior Court of San
Luis Obispo-County, on July 25, 1893, in the action
wherein Rebecca Johnson is Plaintiff and William
Johnson, et al. Defendants, a certified copy of said
decree being recorded August 15, 1892, in Book 20 of
Deeds at page 480, et sea., records of said County,
described as follows:
Commencing at the Southeast corner of Lot 4, (J 18)
and running Westerly along the Northerly line of
Foothill Boulevard 180 feet more or less to the
South Easterly corner of a parcel of land conveyed
to Vernon Hector Bowen by deed recorded in Vol 528
at Page 17 San Luis Obispo County Records; and true
point of beginning; thence Northerly along the
Easterly boundary of the parcel of land so conveyed
363 feet more or less to the Southwest corner of a
parcel of land conveyed to Jack T. and Mildred C.
Hougham by deed recorded in Vol 455 at Page 436 San
Luis Obispo County Records; thence Easterly along
the Southerly line of the parcel of land so conveyed
180 feet; more or less to a point on the Easterly
line of Lot 4; thence Southerly along the Easterly
line.of Lot 4, 40 feet; thence Westerly and parallel
with the Southerly line of the parcel of land mentioned
immediately above, 140 feet; thence Southerly and
parallel to the Easterly line of a parcel of land con-
veyed to Vernon Hector Bowen by deed recorded in Vol
528 at Page 17 San Luis Obispo County Records; 323 feet
more or less to the North line of Foothill Boulevard,
formerly Bishop Peak Road thence Westerly along the
North line of said Boulevard twenty (20) feet to the
true point of beginning.
TO HAVE AND TO HOLD said easement for the purpose of acquir-
ing, constructing, completing, reconstructing, repairing, main- -
taining, and operating sanitary sewers and appurtenances, and an
access roadway, for said City, together with the right of ingress
and egress therefor. E.;
The Grantee shall, at its cost and-expense, and without de-
lay, restore any improvements damaged or destroyed at any time
by reason of the laying of said sanitary sewers and an access road-

way, or by Grantee in maintaining, repairing or operating any san-
itary sewer or sewers and an access roadway, in said easement, and
shall restore the surface of the ground to as near its original con
dition as possible, including an equal distribution of surface
earth, and shall save the Grantor, or any tenant of his, from any
suits or damages arising from and during the construction, or by
reason of maintaining, repairing or operating said sanitary sewer
or sewers and an access roadway.therein.
IN WITNESS WHEREOF, the Grantor has hereunto set his hand

RESOLVU, by the City Council of the City of San Luis Obispo,
California, that It does hereby accept that certair. deed of ease-
ment for sanitary sever and access roadway purposes, dated August
31, 1 51, and executed by WALTER GIIXORE# and that the same be
recorded in the office of the recorder of the County of San Luis
Obispo, California.
I hereby certify the foregoing to be a true copy of the
resolution adopted by the City Council of the City of San Luis
Obispo, California, at a regular meeting thereof held on the.1s_
