SUBJECT: FNCE-0504-2021 (2082 Fixlini Street)
Review of a fence height exception along Johnson Avenue with an average height of
eight feet where a six-foot fence is normally allowed and a fence height exception
along Fixlini Street with an average height of six feet where a four and a half-foot
fence is normally allowed. This project is categorically exempt from environmental
review (CEQA).
Dear Paul Abbott:
On October 10, 2023, I reviewed your request for a fence height exception along Johnson Avenue
with an average height of eight feet where a six-foot fence is normally allowed and a fence height
exception along Fixlini Street with an average height of six feet where a four and a half-foot fence is
normally allowed. The proposed fencing also includes a vision clearance triangle at the intersection
of Fixlini Street and Johnson Avenue per Municipal Code Section 17.70.210. After careful
consideration, I have approved your request, based on the finding and subject to the following
conditions:
Findings:
1. As conditioned, the proposed exception is consistent with the intent of Section 17.70.070
(Fences, Walls, and Hedges) of the Zoning Regulations because the project achieves an
appropriate balance between maintaining the streetscape appearance, overall character of the
neighborhood, and provides additional security and safety with consideration to visual impacts
and scale.
2. As proposed, the project will not adversely affect the health, safety, or welfare of persons living
or working in the vicinity because the location of the fencing does not infringe upon required
line of sight for pedestrian and vehicle safety.
3. No public purpose would be served by strict adherence with the Zoning Regulations because
provisions for fence height exceptions are intended to provide flexibility on lots with special
circumstances and the location, height, and extent of the proposed fencing will not adversely
affect the health, safety, or welfare of persons living or working in the vicinity.
4. The project is categorically exempt under Class 3 (New Construction or Conversion of Small
Structures) of Section 15303 in the State CEQA Guidelines because fences are small structures
and granting of the fence height exception does not constitute a change or intensification of
the existing residential use and will have no significant impact on the environment.

Conditions:

1. The fence height exception granted is limited to the exceptions described in the approval letter
and depicted on the plans submitted. Any future modification to the height, placement, extent,
or design of the fencing shall be subject to the review and approval of the Community
Development Director.
2. The project site shall be maintained in good condition including proper maintenance of
surrounding vegetation.
3. The applicant shall defend, indemnify, and hold harmless the City and/or its agents, officers and
employees from any claim, action or proceeding against the City and/or its agents, officers, or
employees to attack, set aside, void or annul, the approval by the City of this project, and all
actions relating thereto, including but not limited to environmental review (“Indemnified
Claims”). The City shall promptly notify the applicant of any Indemnified Claim upon being
presented with the Indemnified Claim and the City shall fully cooperate in the defense against
an Indemnified Claim.
My action is final unless appealed within 10 calendar days of the date of the decision. Anyone may
appeal the action by submitting a letter to the Community Development Department within the time
specified. The appropriate appeal fee must accompany the appeal documentation. Appeals will be
scheduled for the first available Architectural Review Commission meeting date. If an appeal is filed,
you will be notified by mail of the date and time of the hearing.
The Community Development Director’s approval expires after one year if construction has not
started. On request prior to the expiration of the original approval, the Community Development
Director may grant a single, one-year extension.
