Agreement to Terminate Off-Site Parking Agreement
This agreement made and entered into ni" P-day of January, 2012,by
and between Coastal California Properties, LLC, a California Limited Liability Co.,
(hereinafter called "Ownef') and the CITY OF SAN LUIS OBISPO, A MUNICIPAL
CORPORATION (hereinafter called "City").
WITNESSETH
WHEREAS, Owner is the owner of real property located at 1327
Archer Street, San Luis Obispo, California (Legal Description - attached hereto as
Exhibit'A": APN 002-505-003, referred to herein as "Property"); and
WHEREAS, the property known as 1327 Archer Street was formerly
two separate parcels addressed as294 & 298 Pismo Street; and
WHEREAS, in accordance with Use Permit A 56-82A, an off-site
parking agreement was recorded with the County Recorder on October 12,1983 to
meet a condition of approval to allow off-site parking at294 Pismo Street to satisfy
parking requirements for a business at 298 Pismo Street that sold beer, wine and
soda pop (retail and delivery); and
WHEREAS, the Agreement to Provide Off-Site Parking recorded as
Document No.48980 is null and void since the two properties that are referenced
in the agreement have been merged into one and the site has been redeveloped;
and
WHEREAS, the use that created the need for the off-site parking is
no longer located at the site; and
WHEREAS, the Owner desires to terminate the outdated off-site
parking agreement recorded on October 12, 1983 to eliminate any cloud on the
property title.
NOW, THEREFORE, in consideration of the mutual benefits,
promises and agreements set out herein, the City anci Owner agree to have the
former off-site parking agreement terminated.

Dear Mr. Chapman:
In October L975 pursuant to a reguest by you for a use permj-t, at 294 Pismo Street,
staff circulated requests for comments from all di.visions of the Department of Com-
munlty Development. The responses to those requests revealed three (3) rnajor prob-
lems with your request:
1. The nonconforrnity of the property known as L327 Archer Street, ttcal
West Bul-lding", wlth regard to providing adequate off street parklng.
Several modifications to the exlsting building at L327 Archer St,reet
whlch were done without appropriate permits have resulted in conditions
which do not conform to minimr:m standards of the uniforu building code.
3, No use permlts have been obtaj-ned for existing uses j-n the buildlng
whlch require use permit approval, therefore they are in vlolation
of Municipal- Code Section 9200, the Zoning Ordinance and are not legally
non-conforming because they have been established since L966,
In several discussions between staff, Mr. Crespin and./or you, the staff indlcated we
would recommend denial of requests for additional use__;lermits to occuPy the structure
until the non-conforming situations r{ere rectifled. (Snclosed is a c?py of a memoran-
durn indicating the exteit of the parklng and building nonconformitle!
Subsequent to your request we received a request for a use permit to operate a
beauty salon aE 298 Pismo SEreet. At the time that request was received staff agaln
advlsed you, verbally, that we would recommend against approval of the use permit
untll the parking, use perrnit and bulldi.ng code deficiencies were corrected.
In staff opinion the simplest procedure to foLlow in, order to bring the existlng use
i-nto conformity wlth city ordlnances would be:

Apply for use permiEs for existing uses which require them, concurrently
submiLting;
A plan for providing off street parking for the existing uses ln the "Cal
West Building" and antj-clpaLed uae on the adjacent parcell
Establish a program, in conJunctionwlth the building department,, for cor-
rectlon of buildlng code deficlencl-es ln the Cal West BulLding.

4. Apply for necessary land use or building permits for the "CaI West
Building" and future uses on the adjacent property.
We will continue to reconrmend agalnst any increase in the intenslLy of use on the
Cal I"IesL Building property until the non conforming situations have been corrected.
In any event, we intend to. pursue enforcehent, action to obtaln compllance wl-th zoni'ng
and buildlng codes; the present sltuation cannot be ignored. If you have any
