Mayor Erica A. Stewart called the Closed Session Meeting of the San Luis
Obispo City Council to order at 4:00 p.m. in the Council Hearing Room at
City Hall, 990 Palm Street, San Luis Obispo with all members present.

2. CALL TO ORDER
A Regular Meeting of the San Luis Obispo City Council was called to order on
May 21, 2024 at 5:42 p.m. in the Council Chambers, 990 Palm Street, San Luis
Obispo, by Mayor Stewart.

Vice Mayor Pease led the Council in the Pledge of Allegiance.
4. PRESENTATIONS
4.a BIKE MONTH PROCLAMATION
Council Member Shoresman presented a proclamation declaring the month
of May as "Bike Month" to Gary Havas President of Bike SLO County.
4.b PUBLIC WORKS & UTILITIES WEEK PROCLAMATION
Mayor Stewart presented a proclamation declaring the week of May 19 -
25, 2024 as "Public Works & Utilities Week" to Public Works Director Matt
Horn and Utilities Director Aaron Floyd.
4.c CALIFORNIA TRAVEL & TOURISM MONTH PROCLAMATION
Mayor Stewart presented a proclamation declaring the month of May as
"California Travel and Tourism Month" to Lydia Bates, TBID Chair, on
behalf of the Tourism Business Improvement District Board.
4.d CITY MANAGER REPORT
Interim City Manager Whitney McDonald provided a report on upcoming
projects.

6. CONSENT AGENDA
Mayor Stewart requested that Item 6e be pulled from the Consent Agenda.

6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES
Waive reading of all resolutions and ordinances as appropriate.
6.b MINUTES REVIEW - MAY 7, 2024 COUNCIL MINUTES
Approve the minutes of the City Council meeting held on May 7, 2024.
6.c 2024-25 CENTRAL SERVICES COST ALLOCATION PLAN
Adopt the 2024-25 Central Services Cost Allocation Plan including the
Cost of Services Allocation and Labor Rates.
6.d APPROVAL OF THE FIRE DEPARTMENT’S 2023 ANNUAL REPORT
That the City Council receive and approve the San Luis Obispo Fire
Department’s 2023 Annual Report.
6.f DECLARATION OF INTENT TO HOLD A PUBLIC HEARING ON JULY 2,
2024, REGARDING 205 CASA STREET AND 1067 MURRAY AVENUE
Adopt Resolution No. 11494 (2024 Series) entitled, “A Resolution of the
City Council of the City of San Luis Obispo, California, finding that the
property at 205 Casa Street and 1067 Murray Avenue may constitute a
public nuisance, and ordering a public hearing concerning same and
abatement thereof,” setting a public hearing for July 2, 2024, to consider
whether a public nuisance exits at 205 Casa Street and 1067 Murray
Avenue.
6.g AMENDMENT NO. 1 TO THE REIMBURSEMENT AGREEMENT FOR
THE 600 TANK FARM PROJECT
1. Adopt Resolution No. 11465 (2024 Series) entitled, “A Resolution of
the City Council of the City of San Luis Obispo, California,
approving Amendment No. 1 to the 600 Tank Farm Reimbursement
Agreement”; and

2. Authorize the transfer of $267,138.10 from the Airport Area Specific
Plan Transportation Impact Fee undesignated fund balance (Fund
503) to the Development Agreements project account (2000056-01).
6.h AUTHORIZE THE FIRE DEPARTMENT TO APPLY FOR FEDERAL
EMERGENCY MANAGEMENT AGENCY FISCAL YEAR 2023 FIRE
PREVENTION AND SAFETY GRANT
1. Authorize the Fire Department to apply for funding under the
Federal Emergency Management Agency (FEMA) Fire Prevention
and Safety (FP&S) Program in the amount of $16,280.00 to
purchase six Powered Air-Purifying Respirators; and
2. Authorize the City Manager, or their designee, to execute the grant
documents and approve the budget changes necessary to
appropriate the grant amount upon notification that the grant has
been awarded; a resolution is not required.
6.i AUTHORIZATION TO ADVERTISE ROADWAY SEALING 2024
PROJECT, SPECIFICATION NO. 2000615
1. Approve the project plans and special provisions for the Roadway
Sealing 2024, Specification Number 2000615; and
2. Authorize staff to advertise for bids; and
3. Authorize the City Manager to award the construction contract
pursuant to Section 3.24.190 of the Municipal Code for the bid total,
if the lowest responsible bid is within the publicly disclosed funding
amount of $5,400,000; and
4. Approve the transfer of $5,131,008 from the Streets Reconstruction
and Resurfacing account (2001001) to the project account
(2000615); and
5. Approve the transfer of $130,000 from the Parking Lots
Maintenance account (2000031-08.01) to the project account
(2000615); and
6. Approve the transfer of $40,000 from the Parking Lots Maintenance
account (2000031-08.04) to the project account (2000615); and
7. Approve the transfer of $50,000 from the Parking Lots Maintenance
account (2000031-08.05) to the project account (2000615); and
8. Approve the transfer of $130,775 from the Pedestrian and Bicycle
Pathway account (2000032-00) to the project account (2000615); and
9. Approve the transfer of $200,000 from the Active Transportation
Plan Implementation account (200608) to the project account
(2000615); and

10. Appropriate $1,060,000 in LRM funds pending approval of the
2024-2025 Supplemental Budget CIP True-up to the project
account (2000615); and
11. Authorize the City Engineer to approve Contract Change Orders up
to available project budget and up to any amended budget
subsequently approved by the City Manager up to $200,000.
6.j AMENDMENT NO. 1 TO EXCLUSIVE NEGOTIATING AGREEMENT
WITH THE SAN LUIS OBISPO REPERTORY THEATRE
Approve Amendment No. 1 to the Exclusive Negotiating Agreement between
the City of San Luis Obispo and the San Luis Obispo Repertory Theatre.

reconsideration of the funding recommendation based on the direction to
prioritize those projects that fit within the City Council's primary funding
priority of "Homelessness prevention, including affordable and alternate
housing, support services and transitional housing."

Resources Analyst Lucia Pohlman and Sustainability Manager Chris Read
provided an in-depth staff report and responded to Council questions.

ACTION: By consensus, the City Council directed staff to receive and file
the Lead by Example 2024 Progress Report.
7.b INTRODUCE AN ORDINANCE ADOPTING LOCAL AMENDMENTS TO
PART 6 OF THE BUILDING AND FIRE PREVENTION CODE AND
APPROVE ENERGY EFFICIENT RENOVATIONS POLICY FOR MAJOR
RESIDENTIAL ADDITIONS AND ALTERATIONS (Estimated Time: 120
minutes)
Vice Mayor Pease declared a conflict on this item and recused due to her
business being involved in the design and construction industry.
Deputy City Manager Greg Hermann, Deputy Director/Chief Building
Official Mike Loew, and Sustainability Manager Chris Read provided an in-
depth staff report and responded to Council questions.

Introduce Ordinance No. 1736 (2024 Series) entitled, “An Ordinance of the
City Council of the City of San Luis Obispo, California, adopting Local
Amendments to Part 6 of the Building Construction and Fire Prevention
Code, 2023” approving the Energy Efficient Renovations Policy for major
residential additions and alterations.
Ayes (3): Council Member Francis, Council Member Marx, and Council
Member Shoresman
Noes (1): Mayor Stewart

8. LIAISON REPORTS AND COMMUNICATIONS
Mayor Stewart attended the SLO County Mayor's meeting and a REACH tour of
ESAero and Honda Research Institute at Santa Margarita Ranch.
Council Member Marx attended the IWMA meeting, the IWMA Solid Waste
Summit, the Air Pollution Control District meeting, and the City's Investment
Oversight Committee meeting.
Council Member Shoresman attended the HSOC meeting.
9. ADJOURNMENT
The meeting was adjourned at 10:40 p.m. The next Regular City Council Meeting
is scheduled for June 4, 2024 at 5:30 p.m. in the Council Chambers at City Hall,
990 Palm Street, San Luis Obispo.
