Chairman and Members of the Planning Commission, Residents’ for Quality Neighborhoods (RQN) recommends approval of this request; however, we also recommend that you include four additional conditions. The addition of these conditions will put this Use Permit more in line with the Conditional Use Permits issued to other fraternities. a. No events or gatherings shall begin before 9am or continue after 10pm in line with permits issued previously to other fraternities. (see attached condensed list of conditions) b. No amplified sound equipment, to include bands and DJ's, shall be allowed at any event or gathering without an approved permit from the Community Development Department. (Although this information can be found in several places on the city’s website it its important to include it in the Conditions so that there is no misunderstanding on the part of residents of the site.) c. All dwellings regardless of the street address shall be considered as Lamda Chi Alpha. Any violation of the Municipal Code, regardless of the dwelling unit where it occurred, shall be considered a violation committed by Lamda Chi Alpha and assigned to the Lamda Chi Alpha address, ie, 1264 East Foothill Blvd. (We make this recommendation because both the application for a Conditional Use Permit and staff’s recommendation is for 1264 East Foothilll Blvd - which includes 1264 and 1264 ½ E. Foothill and 1241, 1243, 1249, and 1251 Monte Vista Pl. as one parcel/one entity.) d. Also, recommend a procedure for handling a reasonable complaint be added to Condition #3 of the Resolution for the benefit of the applicant and subsequent Planning Commissioners. (see attachment) Although the site is located in proximity to other dense housing units, it is also located in proximity to single-family homes. Some of the individuals in those homes work in our community and elsewhere. And since the Conditional Use Permit goes with the land, we also have to look to the future as well as the present. The additional conditions listed above will, we believe, help protect the safety and well-being of all residents of the area. 1 The attached is a condensed list of conditions from the Conditional Use Permits issued to fraternities located in the city. Each Conditional Use Permit, from which this information was taken, was provided by John Mezzapesa, Code Enforcement Supervisor. Thank you for your time and consideration. Sandra Rowley Chairperson, RQN Attachment: Fraternity conditions 2 1 Fraternity Use Permit Terms, Condensed Sigma Nu 1304 Foothill Blvd Use Permit 1484, PC Res. No. 5055-91 (Revised Res. No. 5055-91) • (#1) Occupancy of the site is limited to nineteen (19) residents. • (#3) Fraternity use is confined to the house only, for residential use only. Fraternity activities conducted from the fraternity house shall be limited to meetings of the executive council and other meetings and gatherings involving 19 or fewer fraternity members and guests. • (#4) [Procedure for handling a reasonable complaint.] • (#5) No meetings or other gatherings involving persons other than fraternity members living on the site are allowed between the hours of 10 p.m. and 9 a.m. • (#7) [Neighborhood relations program.] (See notes) • (#8) Failure to comply with and conditions etc. may constitute grounds for revocation of permit. • (#10) No events involving the use of amplified sound equipment shall be allowed. • (#11) No hosted Greek events on the site shall be allowed (ie. TG’s, rush events, little sisters, etc.) One parents’ barbeque and one alumni barbecue may be held at the site each year. Not more than thirty-eight (38) persons may be present at either event, including fraternity members. Alpha Epsilon Pi 280 California Blvd Use Permit U 1099, Res. No. 5189 (1983 Series) • (#1) No more than nineteen (19) persons including the resident manager shall reside at the house at any time. • (#5 & #13) [Procedure for handling a reasonable complaint.] • (#12) No meetings, parties or other types of activities involving persons other than residents living on the site shall be allowed between the hours of 10:00 p.m. and 9 a.m. 06/09/1992 RE: Status of fraternity, Addendum: Letter from the City of San Luis Obispo, Glen Matteson, Assoc. Planner • Use permit transferrable to any fraternity at the location. Phi Kappa Psi 1335 Foothill Blvd Use Permit U 47-10, Res. No. PC-5582-13 • (#1) No more than eight (8) persons shall reside at the site at any time. • (#7) The maximum number of persons allowed on-site for routine meetings and gatherings shall not exceed seventeen (17) from 7 a.m. to 10 p.m. except as specifically approved by the Community Development Director for special events. For proposed special events, a parking and transportation plan shall be submitted. • (#8) No meetings, parties, or other types of fraternal activities that would exceed the residential maximum occupancy of persons (11) may take place between the hours of 10 p.m. and 7 a.m., unless otherwise approved by Community Development Director through a special event per Condition #7. • (#12) [Procedure for handling reasonable complaint.] Delta Upsilon 720 Foothill Blvd Use Permit 36-09, Res. No. 5527-09 • (#1) No more than fourteen (14) persons shall reside at the house at any time. • (#8) The maximum number of persons allowed on the site for routine meetings and gatherings is twenty -one (21), except as specifically approved by the Community Development Director for special events. For such special events, the applicant shall also submit a parking and transportation plan. • (#9) No meetings, parties, or other types of similar activities that would violate City Noise Ordinances or other City regulations are allowed or that would exceed the maximum of 21 persons noted in the above condition may take place between the hours of 10 p.m. and 9 a.m., except as approved by the CDD Director. • (#12) Events limited to those submitted to the Community Development Director in the fall. No. 8778 (1998 Series) • (#1) No more than 10 persons shall reside at the house at any time. • (#6) The maximum number of persons allowed on the site for routine meetings and gatherings is twenty (20), except as specifically approved by the Community Development Director for special events. For such special events, the applicant shall also submit a parking and transportation plan. • (#7) No meetings, parties, or other types of similar activities involving persons other than residents are allowed between the hours of 10 p.m. and 9 a.m., except as approved by the Community Development Director. • (#8) [Neighborhood relations plan.] (See notes) • (#9) Events limited to those submitted to the Community Development Director in the fall. For such special events, the applicant shall submit a parking and transportation plan. • (#7) No meetings, parties, or other types of similar activities that would violate City Noise Ordinances or other City regulations, or that would exceed the maximum of 44 persons provisions noted in the above condition may take place between the hours of 10 p.m. and 9 a.m., except as approved by the Community Development Director. Delta Chi 1236 Monte Vista Place Use Permit U 106-98, Res. No. 5230-98 • (#1) No more than thirty-five (35) persons shall reside at the site at any time. • (#4) The maximum number of persons allowed on the site for routine meetings and gatherings is fifty -three (53) except as specifically approved by the Community Development Director for special events. For such special events, the applicant shall also submit a parking and transportation plan. • (#5) No meetings, parties, or other types of similar activities involving persons other than residents are allowed between the hours of 10 p.m. and 9 a.m., except as approved by the Community Development Director. • (#6) [Neighborhood relations program. [(See notes) • (#7) Events limited to those submitted to the Community Development Director in the fall. (See notes) Alpha Gamma Rho 132 California Blvd Use Permit U 144-97, Res. No. 5208-97 • (#1) No more than eighty-eight (88) persons shall reside at the house at any time. • (#5) The maximum number of persons allowed on the site at any one time is 132, except as specifically approved by the Community Development Director for special events. For such special events, the applicant shall also submit a parking and transportation plan. • (#6) No meetings, parties, or other types of similar activities involving persons other than residents are allowed between the hours of 10 p.m. and 9 a.m., except as approved by the Community Development Director. • (#7) [Neighborhood relations program.] (See notes below) 3 • (#8) Events, including meetings and parties on site limited to those submitted to the Community Development Director in the fall. (See notes below) • (#12) Use permit shall be reviewed if any complaint is received by the city. (See notes below) • (#13) Failure to comply with conditions, etc. may constitute grounds for revocation of this permit. (See notes) --------------------------------------------------------------------------------------------------------------------- NOTES: Most use permits have the following language in common: • Neighborhood relations plan/program: o Annual training of all members in community relations; o A program to inform neighbors of upcoming events at the house; o submission of names and telephone numbers of responsible persons including alumni president and chief financial officer, to Community Development Director and to the neighbors within two blocks of the house. o Responsible persons shall be available during all events and at reasonable hours otherwise, to receive and handle complaints. o Evidence of said plan shall be submitted to the Director for review each year. Failure to exercise reasonable efforts to implement said plan may be grounds for revocation of this permit. • Events, including meetings or parties on site, shall be limited to those listed on a meeting and activities schedule, submitted to and approved by the Community Development Director in the fall of each year. Exceptions to this schedule must be approved by the Director. If Director determines the change is significant and may have an adverse impact on the neighborhood, then it will be referred to the Planning Commission for consideration. • The Use Permit shall be reviewed by the Planning Commission at any time, if any reasonable, written citizen or Police Department complaint is received by the city. The Planning Commission may add, delete or modify the conditions of approval or may revoke the use permit. • Failure to comply with any of the above conditions or code requirements, or the conduct of the use so as to constitute a violation of Federal, State, or local law, or so as to constitute a public nuisance or so as to cause adverse impacts on the health, safety, or welfare of persons in the vicinity of this use is prohibited and may constitute grounds for revocations of this permit.
