Advisory Body Appointments for Unscheduled Vacancies (HRC and PRC) Item 6d Department: Administration Cost Center: 1021 For Agenda of: 6/18/2024 Placement: Consent Estimated Time: N/A FROM: Greg Hermann, Deputy City Manager Prepared By: Kevin Christian, Deputy City Clerk SUBJECT: ADVISORY BODY APPOINTMENTS FOR UNSCHEDULED VACANCIES: PARKS AND RECREATION COMMISSION AND HUMAN RELATIONS COMMISSION RECOMMENDATION Confirm the appointment of Yukie Murphy to the Parks and Recreation Commission (PRC) and Mason Ambrosio to the Human Relations Commission (HRC), both to fill unscheduled vacancies with a term ending date of March 31, 2026. POLICY CONTEXT The Advisory Body Handbook, last adopted by City Council in September 2021, with amendments being made in December 2023, outlines the recruitment procedures, membership requirements, and term limits for all City advisory bodies. Additionally, the City Council Policies and Procedures Manual, last updated May 2023, describes the “Appointment Procedure” and “Process” for Advisory Body appointments. Recruitment and appointment recommendations were performed in conformance with all recruitment procedures, processes, and bylaws found in these resources. California Government Code Section 54972, Local Appointments List (Maddy Act), requires that on or before December 31st of each year, each legislative body shall prepare an appointments list for their boards, commissions, and committees whose members serve at the pleasure of the legislative body. This obligation was met and is ongoing. Additionally, the Maddy Act limits the posting for upcoming vacancies to be no more than twenty days in advance of vacancies and that posting must be publicly available for at least ten days. Posting for these vacancies were made in compliance with the Maddy Act. DISCUSSION Per the City Council Policies and Procedures, each City Advisory Body has a respective City Council sub-committee (“sub-committee”), generally consisting of two Council members, with several having only one Council member assigned. Membership on the sub-committees is assigned annually. One of the duties of the sub-committee is to interview advisory body candidates and make recommendations to the full City Council for appointment of citizens to the respective Advisory Body. Page 29 of 747 Item 6d Parks and Recreation Commission: The City Clerk’s office was made aware of an impending resignation on the PRC in April 2024, when a member notified the office that they plan to move out of the area, noting that their last meeting would be June 5, 2024. The Annual Advisory Body Recruitment ran from November 2023, through January 2024, with appointments being made in March of 2024. Per the Advisory Body Handbook, Section C, Membership Qualifications and Appointment Process, the candidate being recommended for appointment interviewed previously during the 202 3-24 Annual Recruitment process. Human Relations Commission: The City Clerk’s office received a resignation from a member of the HRC immediately following their May 1, 2024, meeting. Per the Advisory Body Handbook, Section C, Membership Qualifications and Appointment Pro cess, qualified but not selected candidates, vetted during the past two annual Advisory Body Recruitments, were invited to interview for this unscheduled vacancy. Three of four candidates expressed continued interest in the position, one withdrew due to ti me- commitment restraints, with the final two being re-interviewed in late May. Public Engagement Notices that the City was accepting applications for City Advisory Bodies Annual Recruitment were placed on the City’s website and “e-notification” service, listed in the annual Local Appointments List (Maddy Act Notice – GC 54972) on the City Website and City Information kiosk, and distributed via City social media outlets, in late November 2023. A notice that the City was specifically recruiting for the current unscheduled HRC vacancy was posted on May 1, 2024 and for the current unscheduled PRC vacancy on May 20, 2024, in the City Information kiosk outside City Hall and on the Advisory Body Vacancies page of the City website, following Maddy Act guidelines. CONCURRENCE The Council liaisons for the HRC and PRC concur with the respective recommendations. ENVIRONMENTAL REVIEW The California Environmental Quality Act does not apply to the recommended action in this report, because the action does not constitute a “Project” under CEQA Guidelines Sec. 15378. The costs related to recruitment are accounted for in the annual budget appropriation in the City Clerk program. ALTERNATIVES Council could recommend changes to the two subcommittee’s recommended appointments or direct staff to re-open recruitment for additional candidates. This action is not recommended as the Advisory Body annual recruitment yielded multiple qualified candidates and the Council sub -committee members have been thorough in their assessment of these candidates.
