SUBJECT: ITEM 6E – AUTHORIZATION TO ADVERTISE A REQUEST FOR
QUALIFICATIONS FOR ON-CALL CONSTRUCTION MANAGEMENT
SERVICES, WATER AND WASTEWATER
Staff received the following question regarding evaluation criteria and point ranking for
the proposed Request for Qualifications (RFQ) for On-Call Construction Management
Services, Water and Wastewater. The question is shown below in bold with staff’s
response shown in italics.
1) Are we able to provide local preference points or otherwise favor local
vendors in the selection of contractors to serve on our list of on-call
construction management firms for water and wastewater projects? Are
there local firms, that we know of, capable in providing these types of
services?
It is not recommended to include local preference points or otherwise favor a
professional based solely on the business address of the firm. The proposed RFQ
is for construction management (professional) services, and pursuant to California
statute (Government Code §4525 - 4529.5) the City must adhere to a
qualifications-based competitive procurement process. The code states:
“Notwithstanding any other provision of law, selection by a state and local agency
head for professional services … shall be on the basis of demonstrated
competence and on the professional qualifications necessary for the satisfactory
performance of the services required.” The requirements of qualifications-based
procurement do not identify location as a suitable qualification criterion.
Specifically, evaluation of the On-Call Construction Management (Water and
Wastewater) proposals will be based on the following qualifications as listed in the
draft RFQ (Section C: Proposal Content and Selection Process):
1. Understanding of the work involved in Construction Management work.
2. Demonstrated competence, professional qualifications of proposed staff.
3. Recent experience in successfully performing similar services.
4. Ability to respond quickly to work requests.

For example, demonstrated competence and qualifications (per evaluation criteria
#2) may include a firm’s experience working in the City of San Luis Obispo and
knowledge of local conditions, codes, and standards. In addition, a firm may also
be able to demonstrate that they quickly respond to work requests, such as an
urgent engineering field meeting (per evaluation criteria #4), based on the amount
of time it may take to travel from their office to the project site.
The Department of Public Works’ on-call construction management professional
services list does include local firms experienced in providing construction
management services for general improvement projects, and staff anticipates
some of these local firms, in addition to firms that do not have a local business
address, will submit qualifications for this RFQ specific for water and wastewater
projects. All firms that submit responses to the RFQ will be evaluated based on the
qualifications-based criteria identified above.
In addition, staff wishes to clarify that the proposed RFQ is for professional
services related to construction management and does not include construction
contracts, which would be publicly bid independently.
