Have not yet confirmed that the retaining wall was done without permit or in violation of building code. CorrespondenceNick Buckley 4/10/23 - Initial Complaint 04/19/2023 4/19/23 NB - Received a call from an anonymous reporting party regarding drainage that was installed which is causing erosion issues on neighbors below the property. The rp stated that his property was not really affected specifically but that people around him were much more affected. The RP also stated that he was going to call Jim Gorter to discuss. CorrespondenceNick Buckley Anon RP 05/03/2023 NB - Spoke with the property owner who was confident they did not need a permit because the fence was under 9 feet. He also denied my request for an onsite inspection. CorrespondenceNick Buckley 5-2-23 - PO 05/12/2023 NB - Building code states that any fence over 7 feet requires a permit and the municipal code amended that to 6 feet. Also, any retaining wall over 48 inches including the footing requires a permit. The retaining wall on site is at minimum 56 inches at highest point from natural grade determined by counting blocks. Permit is required for the retaining wall/fence. ResearchNick Buckley 5/3/23 NB - NOV sent certified and regular mail. Compliance due date is 6/12/23. Notice of ViolationNick Buckley 5/12/23 06/25/2024 NB - Multiple emails exchanged between the property owner, building staff, engineering staff and myself. I also had a phone conversation with the property owner today where we discussed the height of the wall, and the footings. The property owner states that there is a difference in opinion regarding what constitutes a footing. My response is that a retaining wall will be measured from the bottom of the concrete or block (including what is below grade) to the bottom of the concrete or block. I also sent the PO an email with the original NOV attached. A permit tech also sent him the comments from engineering yesterday and again today.
