RESOLUTION NO. 10201 (2010 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ORDERING THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY A
CERTAIN MEASURE RELATING TO THE AMENDMENT OF THE MARGARITA AREA
SPECIFIC PLAN AT THE GENERAL ELECTION TO BE HELD ON TUESDAY,
NOVEMBER 2, 20109 AS CALLED BY RESOLUTION NO. 10177 (2010 SERIES)
WHEREAS, a General election on Tuesday, November 2, 2010, has been called by Resolution
No. 10177 (2010 Series), adopted on June 1, 2010; and
WHEREAS, the City of San Luis Obispo, with the participation of property owners, citizens,
public agencies and other interested parties prepared a specific plan for the Margarita Area pursuant to
the General Plan and the State Government Code; and
WHEREAS, the Council of the City of San Luis Obispo on October 12, 2004, adopted
Resolution No. 9615 (2004 Series) the Resolution certifying a final program EIR for the Margarita and
Airport Area Specific Plans and related facilities Master Plans, approving the Margarita Area Specific
Plan, and approving General Plan amendments (ER, SP, GP/R 73 -00); and
WHEREAS, pursuant to authority provided by Division 9, Chapter 3, Article 1 (commencing
at section 9200) of the Election Code of the State of California, petitions have been filed with the
legislative body of the City of San Luis Obispo signed by more than 10 percent of the registered voters
of the City to repeal portions of Resolution No. 9615 (2004 Series) pertaining to the Prado Road
Extension, or submit these to a vote of the voters; and
WHEREAS, the City Clerk examined the records of registration and ascertained that the
petitions were signed by the requisite number of voters, and has so certified; and
WHEREAS, the City of San Luis Obispo, California desires to submit to the voters at the
General Municipal Election a measure relating to Resolution No. 9615 (2004 Series); and
WHEREAS, the City Council has not voted to adopt the initiative measure; and
WHEREAS, the City Council is authorized and directed by statute to submit the ordinance to
the voters.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. That the City Council, pursuant to its right and authority, does order submitted to
the voters at the General Municipal Election the following question:

Shall the Council of the City of San Luis Obispo
adopt an ordinance amending the Margarita Area I YES
Specific Plan, Airport Area Specific Plan, Related
Facilities Master Plans, and General Plan Land -Use
and Circulation Elements for the purpose of
eliminating a portion of the Prado Road alignment
adopted by the San Luis Obispo City Council by NO
Resolution 9615 (2004 Series)?
SECTION 2. That the full text of the ordinance submitted to the voters is on file in the City
Clerk's Office and available for viewing on the City's website, www.slocity.org., and is attached as
Exhibit A.
SECTION 3. That in all particulars not recited in this resolution, the election shall be held and
conducted as provided by law for holding municipal elections.
SECTION 4. That notice of the time and place of holding the election is given and the City
Clerk is authorized, instructed and directed to give further or additional notice of the general election,
in time, form and manner as required by law.
SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution
and enter it into the book of original resolutions.
Upon motion of Council Member Ashbaugh, seconded by Council Member Settle and on the
following vote:
AYES: Council Members Ashbaugh, Marx, and Settle, and Vice Mayor Carter and
Mayor Romero
NOES: None
ABSENT: None
The foregoing resolution was adopted this 20"' day of July 2010.
