The project would also need to comply with all relevant objective standards such as Chapter 17.36 (Service Commercial Zone), Chapter 17.70 (Site Development and General Development Standards) and Chapter 17.72 (Parking and Loading). So even though the project will be reviewed ministerially, it will still need to comply with Objective Standards under the City’s Municipal Code (unless of course the County uses their superior agency authority). Let me know when you would like to meet and discuss any of these standards in more detail. Our primary objective with this first meeting is to review the following:  Have the city staff reviewing the project understand the interior layout, area, and program of the proposed residential units. There are some key differences between the application for ERF, California Building Code, Appendix P, and potentially local amendments we may not be aware of in the City and County. As a follow up to yesterday’s Design Team call, I wanted to follow up to share the notes and recommendations from the WHV tree evaluation site visit that Rob and I conducted with our City Arborist, Walter Gault (cc’d). Based on the site plan that Marissa shared, which noted the trees requiring evaluation, we have provided notes and recommendations that are outlined on the attached spreadsheet – along with a corresponding site map that labels each of the trees. Six trees were identified by Gensler for potential removal, and Walter recommended removing 5 of the 6. The additional tree is being recommended for a raised prune, as noted on the spreadsheet. For the 5 trees that were identified for removal, we have outlined initial conditions for establishing a replanting plan. A minimum of a 1:1 replanting plan is usually required for any tree removals, however based on the stature and value of trees a 3:1 or 4:1 ratio may be required. Walter recommended a 1:1 replanting plan for 4 of the trees identified for removal and a 3:1 replanting plan for the large eucalyptus. With that, 7 trees would need to be planted to replace the 5 trees that will be removed. Walter provided recommendations for potential replanting locations along Bishop St. (noted in green on the site map) and he offered to provide draught resistant species recommendations. We’ve outlined some high-level action items for the replanting plan on the second tab of the spreadsheet and we’d be happy to discuss further whenever we’re able to meet/connect next. In addition to the removal recommendations, four other trees were identified for potential limbing, and Walter recommended raised or structured pruning for each of those trees. Lastly, we included notes for eight additional trees onsite – with pruning recommendations for 5 of the trees and no action needed for the remaining 3. Those recommendations would help maintain and enhance the overall site but don’t have any foreseen site impacts. Derek, I know you mentioned potentially coming to SLO later in July for a site visit, but we are also open to connecting on a call before then if it would be helpful to discuss the tree recommendations and replanting plan – and/or we can address any questions over email. Jeff you are calling the attached a construction schedule. The attachment is Gensler’s preliminary design/construction estimated timeline to develop a workplan and establish the appropriate fee for the project. The construction timeline requires input from the prefabricated vendors and general contractor, we are still working on the site plan and have had preliminary conversations with Specialty Construction. We cannot make a determination on the length of construction beyond what we know today, which is very preliminary. We don’t have a go/no go on a site yet and we are still working from a preliminary site plan.  “ROM for Project Budget”. Gensler is NOT responsible for providing hard costs or soft costs associated with this project. Gensler’s is only responsible for providing costs associated with their scope of work. All other budgetary items will be informed by DignityMoves, Specialty Construction and others, PG&E, and other consultants once they are all engaged, and we have determined if the Bishop Road site is the correct site for this project. Happy to report that if the project needs to be remove the tree shown on the attached photo it can do that. However, coordination is required to ensure the tenant is made aware of the work schedule ahead of time (they’ve requested a mid-week removal), that clean up, debris removal and any restoration of parking spaces disturbed during removal be completed by the project. I have pasted it below. While Cal-ICH does not have specific requirements regarding SROs, projects do need to be in compliant with Housing First and residents must have leases proving tenancy for housing to be considered permanent . I believe this gets us where we need to be on the SRO issue. As far as the question of not having all ensuite bathrooms and kitchenettes in the PSH units, a change request would need to be submitted and reviewed by Cal ICH. At this point, I do not want to do that as it is critical to future funding that the units meet our housing Authority’s voucher requirements. County of SLO received $13.4 million of Encampment Resolution Funds (ERF) that are specifically earmarked to address the Bob Jones Bike Trail encampment. b. The site is at Bishop Street and Johnson Ave c. Will require a multi-phase approach: i. Establish that the County is considering other locations for the Welcome Home Village ii. Reach out to key local stakeholders iii. Conduct door-to-door outreach in the surrounding neighborhoods iv. Host 2-3 smaller community meetings with neighbors v. Widely communicate the new location of the Welcome Home Village 2. Goals: a. Inform the public about the Welcome Home Village project & its role in the County’s regional response to homelessness b. Incorporating the Welcome Home Village into the County Campus on Johnson Avenue will further expand the service offerings and benefits the County provides to the community. In addition to the Welcome Home Village, the Encampment Resolution Fund also provides local jurisdictions with the support and tools required to restore the Bob Jones Bike Trail to its originally intended use for commuters, families, and community members. Welcome Home Village II Communications Plan Strategic Analysis Anticipated New Questions  Why was this project moved? o In order to meet timelines for expenditure and to quickly stand up this project, the Welcome Home Village was going to use a CEQA-exemption. To use a CEQA-exemption, the project needed to fulfill the zoning for this area set by the City. While a project that only provided short-term housing would have been permitted, since the Welcome Home Village incorporates permanent supportive housing, the project’s purposes were no longer congruent with the zoning for this lot.  Was the project moved due to business owner objection? o Officials from the County and City shared productive dialogue with both business owners and community members on multiple occasions. While there were concerns brought up with the project, the County and its partners were fully prepared to thoughtfully address them with practical solutions and effective policies. Unfortunately, the land-use incongruencies ultimately meant that the County had to explore alternative locations for the Welcome Home Village.  What other locations were considered? o Several sites were considered in San Luis Obispo and the targeted encampment corridor, including multiple lots on the County Campus on Johnson Avenue.  What will happen to the DSS Lot on S. The County of San Luis Obispo is hosting a community information session in downtown San Luis Obispo on August 30th about a pivotal piece of the Bob Jones Bike Trail Encampment Resolution Project, also called Welcome Home Village. This new transformative housing program coming to South Higuera Street and Prado Road in San Luis Obispo is possible thanks to a $13.4 million grant aimed at helping those experiencing homelessness find permanent housing. The program mirrors other successful programs in neighboring communities like Santa Maria and Santa Barbara as well as elsewhere in the state. The focus of the San Luis Obispo “Welcome Home Village” is to provide supportive housing and wrap-around individualized case plans for people currently living in open space along the Bob Jones Bike Trail in San Luis Obispo. The success rate of similar programs is phenomenal and provides clients with the support and guidance to receive the services they need to transition into stable housing. Supportive housing is an essential part of the County’s and City’s plans to reduce homelessness. The Welcome Home Village is the first of many supportive housing communities planned throughout San Luis Obispo County. The site aims to establish a non-congregate housing facility equipped with security and on-site wraparound services. It will be strategically situated adjacent to the County’s Department of Social Services headquarters, fostering accessibility to essential resources and services. I wanted to provide a quick update.  We have received a proposal from Specialty Construction regarding Fee and General Conditions in addition to Pre- Construction services. We, Derek Troya and I met with Nate Agin this morning. I had asked Nate to review a few things in his proposal and get back to us by tomorrow at the latest which he did, we will be entering into a pre-con agreement with Specialty tomorrow. We want them at all of our design meetings as we work through the design and any potential issues.  We have the LOA from Gensler, and it’s signed for architectural services.  I am also reviewing consultant contracts for the project, Structural, MEP, and Landscaping, we have Civil.  We are working with LifeArk on their pricing and units, met this morning with LifeArk, Gensler and DM to vet their pricing overage and unit selection. We will have an update to the fit test to show a revised layout for the PSH units, pricing is also underway)HOT DM/Gensler  We still need an answer on project-based vouchers. This will have an impact to the size and type of the units. HOT  I will ask Freya Estreller our COO to designate one of our team members for the communications committee. That’s it for now, we are set for our weekly design meeting kick-off, next Thursday, March 28th at 2 pm. Your support and active participation has helped us keep this project moving forward, and we would not be able to make this project a success without each one of you. As shared at the meeting last week, we will be making some adjustments to the meeting schedule ongoing, please see below for details:  The large group (everyone who has been previously meeting) will now move to meeting once time per month to receive updates and provide input. This meeting will be held the first Thursday of each month from 2-3pm. The next meeting for this large group will be April 4th  Dignity moves will begin convening their weekly design team meeting. One representative from the County of SLO and one from the City of SLO will participate in those meetings and will be a liaison back to the main group. These representatives are still being determined but we will share who is selected as soon as that is finalized. 3  Two subcommittees are forming: o A Parking subcommittee and a Communications subcommittee are being formed. Below is a short description of each, and our staff suggestions for participation in each:  Parking subcommittee:  The parking subcommittee will be working on solving the logistical needs to address the loss of parking spaces with the new build. After becoming a resident of Dignity Moves this individual expressed interest in going back to school. At first they began taking the free courses offered at SBCC and started to familiarize themselves with the school. resources, and the campus. This individual did so well that they are now enrolled in the medical assistant program at SBCC! There have been times they told me the classes were too hard and they wanted to stop. After counseling them about continuing their education and reminding them how far they have come, I suggested dropping a class to lighten the load and help manage the stress of tough scientific courses. This individual took my suggestion and is studying hard to become a medical assistant. Higuera to near the Johnson Ranch Trail) o No PC 290 (registered sex offenders) will be allowed in the program.  Intensive and mandatory case management helps focus program participants on identifying and pursuing their pathway back to stable housing and independence.  The site will be developed by DignityMoves and operated and managed by Good Samaritan Shelter, both known for creating “home-like” and “dignified” housing solutions.  The Welcome Home Village is expected to open in 2025.  Based on an innovative program model used with >75% success rates in Grover Beach and Santa Barbara. Bob Jones Bike Trail Restoration  Includes focused efforts and funding to restore the Bob Jones Bike Trail: o Installation of sanitation services along the Bob Jones Bike Trail to address waste and trash accumulation o Expansion of the City of SLO’s ongoing outreach to those living in the encampment area in collaboration with Good Samaritan Shelter  The Bob Jones Bike Trail corridor was selected because it is a fire and flood zone and has largest concentration of homeless encampments in the San Luis Obispo City .  This project will allow us to address environmental and public safety concerns through compassionate access to a practical and supportive housing alternative. An additional PDF has been included that indicates the general size and layout of the proposed LifeArk units. · Review of the interior layout, area, and program of the proposed residential units for permanent supportive housing based on any local code amendments and the intent behind the ERF application. · Per the ERF Application: “46 units at the Village will be developed by utilizing Life Ark construction, they will each be a SRO model that will consist of a bedroom, bathroom, and a small kitchenette.” · Accessible units will need to include an attached room with an accessible shower/toilet/sink, per accessibility standards (not the ERF application). · The small kitchenette provided in each sleeping room will contain a refrigerator and a sink. There will be no cooking appliances within the unit and therefore will not be considered a kitchen. The County states that this function meets the intent of a ‘small kitchenette’, per the application. Cooking will be done in the main interior community space that connects the sleeping units. · Interior Space Requirements. Related to the above, the minimum interior habitable area of 190 sqft for an EDU is not required, as a full kitchen is not provided within each unit and therefore each unit will be considered a sleeping room and not an EDU. · The enforcing agency does not have any additional requirements regarding the size of the closet, provided it meets SRO requirements. · Review of the interior layout, area, and program of the proposed residential units for interim supportive housing based on any local code amendments and the intent behind the ERF application. · Per the ERF Application: “34 interim housing units that will be developed utilizing Boss Cubez construction, each unit will be comprised of a 10x10 room that will include a bed, desk, heater, a/c, light fixture and electrical plug ins.” Page 2 · The current proposal by LifeArk is an 8’-2” x 8’-2” unit. The team needs confirmation in writing from the Enforcing Agency that Appendix P is being utilized for this location in application to the Interim Supportive Housing scope. The main issue stems from the minimum interior area requirements. Appendix P states 53 sqft can be utilized, if confirmed by the Enforcing Agency. If Appendix P is not being utilized, the minimum interior area would need to be 70 sqft. There will be other ripple effects to this approach such as increasing the quantity of restrooms/showers among a variety of other items. · Confirmation that this site can utilize an R-3 occupancy with multiple buildings approach. The City had no issues with this approach. A response will be needed from the County. LifeArk has confirmed that the individual buildings can be classified as R-3 through HCD. We need verification for the following: · Multiple buildings classified as an R-3 (Congregate residences (nontransient) with 16 or fewer occupants) occupancy can be located on site with an imaginary line and an appropriate fire separation distance between the line and structures. · Verify a deck that is structurally supported independent from the modular buildings can connect multiple R-3 buildings. · Confirm fire lane requirements including minimum width, maximum hose run, maximum back out distance and potentially opportunities to connect to the adjacent parking lot to the east or utilize the existing red curb outside of property line. · The existing red curbed fine lanes adjacent to the property can be utilized. Emergency access gates in fencing will need to be coordinated. · If the site is sprinklered (regardless of whether NFPA 13 or 13D is used) the maximum hose run from the multiple fire access lanes adjacent and within the site is 300’ · Maximum backout distance for the Engine without having to utilize a turnaround is 150’. DATE BILL/CODE LEGISLATION NOTES KEY LEGISLATION 2020 California Gov. Code Sec.8698 This California Government Code Section 8698 (2017) allows a city to declare a state of emergency due to a shelter crisis, and such a declaration allows City to suspend certain regulations and standards of housing, health or safety to the extent strict compliance would prevent, hinder, or delay mitigation of the shelter crisis. It also provides that any city may allow homeless persons to occupy designated public facilities for the duration of the state of emergency. In order to declare a shelter emergency, a city must find that there is an existence of a situation in which a significant number of persons are without the ability to obtain shelter, resulting in a threat to their health and safety. 1st priority action, declare shelter emergency, which unleashes code exemptions and funding. 2019 Cal. Gov. Code § 65660 AB101 AB 101 requires a Low Barrier Navigation Center (LBNC) be a use by right in areas zoned for mixed use and nonresidential zones permitting multifamily uses if it meets specified requirements, including: • Access to permanent housing (e.g. engaged in Continuum of Care) • Use of a coordinated entry system (i.e. Homeless Management Information System). • Use of Housing First according to Welfare and Institutions Code section 8255. (Gov. Code, § 65662.) A LBNC is defined as a Housing First, low barrier, temporary, service-enriched shelter focused on helping homeless individuals and families to quickly obtain permanent housing. Low barrier includes best practices to reduce barriers to entry, such as allowing partners, pets, storage of personal items, and privacy. (Gov. Code, § 65660.). Permits Navigation Center / Interim Supportive Housing project as a ‘by-right’ use i.e. a Ministerial approval and as such is CEQA Exempt. 2019 AB1197 Provides a CEQA exemption for supportive housing and emergency shelters, in the City of Los Angeles. Expires January 1, 2025 Only applicable Los Angeles Expires January 1, 2025 2021 AB140 Homekey only AB 140 (2021) establishes a statutory exemption from the California Environmental Quality Act (CEQA) for activities funded by Homekey Round 2. The exemption remains in effect only until July 1, 2024. All Homekey Round 2 projects are eligible for such streamlining and are “deemed consistent and in conformity with any applicable local plan, standard, or requirement, and any applicable coastal plan, local or otherwise, and allowed as a permitted use, within the zone in which the structure is located, and shall not be subject to a conditional use permit, discretionary permit, or any other discretionary reviews or approvals.” Notably, AB 140 did not place time limits on the use of this land use exemption, in contrast to the CEQA exemption, which is time-limited. This bill would require jurisdictions that adopt ordinances under the act, to, at a minimum, meet the standards provided in the 2019 California Residential Code Appendix X, the 2019 California Building Code Appendix O, and any future standards adopted by the Department of HCD related to emergency housing or emergency housing facilities. AB 2339 provides that the sites identified for emergency shelters must be in residential areas or are otherwise suitable, thus prohibiting local governments from situating shelters in industrial zones or other areas disconnected from services. The law also seeks to ease constraints on the development of emergency shelters by requiring that any development standards applied to emergency shelters be "objective." State mandated program under Housing Elements. 2022 SB561 AB2233 Surplus Lands SB 561 and AB 2233 collectively codify this executive order, requiring DGS to develop a plan with HCD to update screening tools to identify surplus state-owned property by June 1, 2023, to develop criteria to evaluate the suitability of state-owned parcels to be used for affordable housing by Sept. 1, 2023, to conduct a comprehensive survey of state-owned land by July 1, 2024, to update the digitized inventory surplus state-owned by Jan. 1, 2024, and every four years thereafter, and to report its progress annually to the Legislature. AB 2592, meanwhile, focuses on state-owned buildings, and specifically requires DGS to prepare and report to the Legislature a streamlined plan to transition underutilized multistory state-owned buildings into "all types of housing." This legislation is really for permanent affordable housing, we’re seeking a tool to facilitate leasing surplus lands on a temporary, short term basis for interim models. 9/26/2019 AB143 Shelter crisis: homeless shelters: Counties of Alameda and Orange: City of San Jose. This bill adds Alameda County, Orange County, all of the cities within those counties, and the City of San Jose to the list of jurisdictions authorized to declare a shelter crisis, which permits the suspension of state health, planning and zoning, and safety standards; those jurisdictions must then adopt a local ordinance for the design and operation of homeless shelters, which must be approved by HCD. The bill also requires these jurisdictions to develop plans to address the shelter crisis, including how to transition residents from homeless shelters to permanent housing. This bill also extended the repeal date to January 1, 2023. City of San Jose 9/26/2019 AB1745 Shelter crisis: emergency bridge housing community: City of San Jose Earlier legislation (AB2176) authorized San Jose to build and operate emergency bridge housing for the homeless during a declared shelter crisis. The bill, in lieu of compliance with local building approval procedures or state housing, health, habitability, planning and zoning, or safety standards, procedures, and laws, would authorize those jurisdictions to adopt by ordinance reasonable local standards for homeless shelters, as specified. The bill would require the Department of Housing and Community Development to review and approve the draft ordinance to ensure it addresses minimum health and safety standards and to provide its findings to committees of the Legislature, as provided. The bill would require the city, county, or city and county to develop a plan to address the shelter crisis, as specified. The bill would further require any of the specified jurisdictions that have declared a shelter crisis to annually report to the committees of the Legislature specific information on homeless shelters and permanent supportive housing, through January 1, 2021. Initial bill that kick-started tackling homelessness throughout California with innovative solutions. Bill focused on communities that prioritized action on homelessness through emergency declarations, freeing them from red tape. EXPIRED 9/26/2016 AB2176 Shelter crisis: emergency bridge housing communities. This bill, until January 1, 2022, upon a declaration of a shelter crisis by the City of San Jose would authorize emergency housing to include an emergency bridge housing community for the homeless. The bill would define an emergency bridge housing community to include, but not be limited to, housing in temporary structures including, but not limited to, emergency sleeping cabins. The bill, in lieu of compliance with state and local building, housing, health, habitability, or safety standards and laws, would authorize the city to adopt by ordinance reasonable local standards for emergency bridge housing communities. Only applicable to San Jose. EXPIRED Cal. Gov. Code § 54220 (a) In 2014, the State Legislature reaffirmed its declaration that there is a shortage of sites available for housing for residents of low and moderate income and that surplus government land, prior to disposition, should be made available for that purpose. § 54220 (a). The Surplus Land Act requires that local agencies, including cities, counties and special districts such as transportation authorities and school districts, prioritize the development of affordable housing when disposing of publicly held land. The agency is required to notify specific entities of the opportunity to purchase or lease the property and enter into good faith negotiations with priority buyers. In the case that the agency and priority buyer cannot reach an agreement on the price and terms, the agency may dispose of the land to a non-preferred buyer; however, the agency must enforce an inclusionary housing requirement if 10 or more residential units are developed on the site. AB 2873 is designed to encourage affordable housing developers to employ minority-owned business enterprises. It accomplishes this goal by requiring affordable housing developers to report on their efforts to employ women, minority, disabled veteran and LGBT owned business enterprises. This requirement applies to affordable housing developers that receive low-income housing tax credit (LIHTC) on or after Jan. 1, 2024, and that have either: 1) completed five or more housing projects by Jan. 1, 2023; or 2) received an annual LIHTC allocation of at least $1 million. No reason why this cannot apply to interim housing developers such as DignityMoves. 2021 AB362 This bill would require a city or county that receives a complaint from an occupant of a homeless shelter, as defined, or an agent of an occupant, alleging that a homeless shelter is substandard to inspect the homeless shelter, as specified. The bill would require a city or county that determines that a homeless shelter is substandard to issue a notice to correct the violation to the owner or operator of the homeless shelter within 10 business days of the inspection. Ongoing Improves shelter standards 2021 AB816 AB 816 prioritizes resources our state receives through the national Housing Trust Fund to address the needs of people experiencing homelessness. The bill authorize HCD to alter priority for funding to align eligibility for possible benefits, including Medi-Cal benefits intended to assist people experiencing homelessness. 2021 2020 EO N-25-20 The Governor of California proclaimed a Major State of Emergency (Executive Order N-25-20) for Covid19. Statewide Covid emergency. 2020 AB1845 This bill established the Office to End Homelessness within the governor’s office. The new office is under the direction of the Secretary on House Insecurity and Homelessness and charged with coordinating homelessness services, policies, programs, and data among local, state, and federal agencies. 2019 AB139 This bill updates requirements of local governments’ housing plans to address the needs of the homeless crisis, specifically by changing the criterion for assessing the need for emergency shelters to a regional level and requiring that to be accounted for as part of the Housing Element of a city or county’s General Plan. 2019 AB728 Previous legislation gave counties the authority to create Multidisciplinary Personnel Teams (MDTs) for homeless adults and families to facilitate the expedited identification, assessment, and linkage of homeless individuals to housing and supportive services and allow provider agencies to share confidential information for those purposes to ensure continuity of care. This bill creates a five-year pilot program in the following counties (Los Angeles, Orange, Riverside, San Bernardino, San Diego, Santa Clara, and Ventura) to expand the scope of an MDR to include serving individuals who are at risk of homelessness. The program would sunset on January 1, 2025. Coordinated Entry System 2019 AB1188 Creates a legal framework allowing a tenant to take in a person who is at risk of homelessness. 2019 AB1235 This bill renames “youth homelessness and prevention centers,” expands the categories of youth for which the centers are required to provide services, and expands the time a youth can stay from 21 to 90 days. Good evening, Attached are the following for the Thursday Welcome Home Village meeting.  Gensler preliminary design and permit issuance timeline including construction administration.  Preliminary project schedule (without input from contractor, Specialty Construction)  Updated test fit from Gensler based on new survey information. I have not included a preliminary project budget at this time. Once the site is selected, we will enter into a phase 1 pre- construction agreement with Specialty Construction to develop a preliminary ROM project budget for hard costs and project schedule, this will take approximately 2/3 weeks. The project budget and schedule will be site specific. Gensler and DignityMoves has had meetings with modular manufactures to vet the current site and the preliminary site layout to develop pricing. The definitive site selection is key to the final development of our overall budget hard and soft costs and project schedule. I will not be attending the meeting on Thursday, I am in Arizona on a personal family matter. Derek Troya will also be out of the office. Drew Armetta and Dan Baroni from Gensler will be in attendance and will be able to speak to their scope of work, design schedule and site layout. I am happy to schedule another meeting to walk thru the attached documents and the plan moving forward. In addition, we have been working with Jon on the DMA, there are still a few points that need to be worked out. I do think, our CEO and COO will need to get involved in resolving the “termination for convenience” section which is not in any of our agreements with any city or county currently. We are working on a joint ERF-2 application and would like include a Fit Test / Development budget from Dignity Moves as contract DM as our developer if this application is approved. Page 1 of 6 County-Owned Sites Inquiry The Board of Supervisors (BOS) has not delegated authority to Real Property Services with respect to making independent determinations as to what properties are/would be suitable for housing projects with the County of San Luis Obispo. This is a decision to be made by the BOS. Additionally, other municipalities may also be involved in a final approval depending upon location. We would request that any presentation that references any of the accompanying County owned properties not reflect endorsement by the County of San Luis Obispo of any proposed location(s) as being suitable for housing unless otherwise noted.
