FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, Lawrence J.
Martinelli and Phyllis May Martinelli, Trustees and Successor Trustees of the Lawrence J. Martinelli and
Phyillis May Martinelli Trusts, U/T /A dated January 21, 1983 ( "Owner ") hereby OFFERS to the City of
San Luis Obispo, a chartered Municipal Corporation, as OFFEREE, an irrevocable easement for public
street and utilities purposes over a portion of certain property described as Lot 33 of the San Luis Obispo
Suburban Tract filed in Book 1 of Record Surveys at Page 92 in the Office of the County Recorder, City
of San Luis Obispo, County of San Luis Obispo, State of California, as more particularly described on
Exhibit A, and depicted on Exhibit B.

That portion of Lot 33 of the San Luis Obispo Suburban Tract in'the City of San Luis Obispo
filed in Book 1 of Record of Surveys at Page 92 in the County Recorder's Office, County of
San Luis Obispo, State of California, lying northerly of the following described line:
Commencing at a pin in monument well on the centerline of Prado Road at the westerly
terminus of the course described as " N89 °58'56" W 994.29' " as shown on the map filed in
Book 94 of Record of Surveys at Page 55 in said County Recorder's Office; thence
South 0 °01'04" West, a distance of 53.00 feet to a line parallel with and 53.00 feet south of
said centerline of Prado Road and the TRUE POINT OF BEGINNING; thence
Along said parallel line South 89 °58'56" East, a distance of 557.71 feet to a curve concaved
to the southwest having a radius of 50.00 feet; thence
Easterly and southeasterly along said curve through a central angle of 45 °42'32 ", an arc
distance of 39.89 feet to a reverse curve concaved to the northeast having a radius of .97.50
feet, the radial to the beginning of said reverse curve bears .South 45 °43'36" West; thence
Southeasterly along said curve through a central angle of 12 °27'59 ", an arc distance of

upon completion of the public improvements to the satisfaction of the City, by the undersigned
officer on behalf of the City Council pursuant to authority conferred by Resolution No. 5370 (1984
Series), recorded June 15, 1984, in Volume-2604, Official Records, Page'878, -San Luis Obispo
County; California, and the Grantee consents to recordation thereof by its duly authorized officer or
his agent. .
