This agreement, made and entered into this [V"—day of December, 2013, by and
between Scott R Figenshow and Norman L Gray Jr, (hereinafter called "Owner") and the
CITY OF SAN LUIS OBISPO, A MUNICIPAL CORPORATION (hereinafter called "City ").
WITNESSETH
WHEREAS, owner has obtained a valid construction permit within the City of San
Luis Obispo for the conversion of an existing bedroom. and bathroom, within an existing
single family residence, into a secondary dwelling unit; and
WHEREAS, approval of said permit by City entitles Owner to provide, modify or
construct a secondary dwelling unit on Owner's property at 3133 Johnson Avenue, San
Luis Obispo, California (Legal Description: Lot 4 , Block A Subdivision Laurel Hills )
APN 004 - 961 -008 subject to execution of this agreement by Owner and City.
NOW, THEREFORE, in consideration of the mutual benefits, promises and
agreements set out herein, the parties agree as follows:
1. The parties hereto agree that execution of this agreement by Owner and City
entitles owner to proceed to modify or construct a secondary dwelling unit , as approved
by Construction Permit/Plan Check No. 131167, as approved by Administrative Use
Permit No. SDU 151 -13.
2. Owner agrees that the primary unit or the secondary unit shall be occupied by
the owner. If owner occupancy ceases, the use of secondary unit will terminate and the
structure can no longer be used as an independent dwelling unit. The' conversion shall be
performed to the satisfaction of the Community Development Director and Chief Building
Official, and may be subject to the Building Permit process; and
3. Owner shall reimburse the City for costs of all necessary enforcement actions
concerning the secondary unit on subject property; and
4. Owner agrees that this agreement shall be binding upon and shall inure to the
benefit of, the heirs, assigns, and all other successors in interest of the parties hereto.
