THE OVAL. WHEN VOTING ABSENTEE USE ANY BLACK OR BLUE
COLORED PEN OR PENCIL TO FILL IN THE OVAL.
To vote for a candidate for Associate Justice of the Supreme Court; Presiding Justice, Court of Appeal; or
Associate Justice, Court of Appeal, FILL IN THE OVAL left of the word "YES"To vote aaainst that candidate,
FILL IN THE OVAL left of the word "NO."
To vote for any other candidate whose name appears on the ballot, FILL IN THE OVAL to the left of the
candidate's name. Where two or more candidates for the same office are to be elected, FILL IN EACH OVAL
to the left of the names of all candidates for the offices for whom you desire to vote, not to exceed, however;
the number of candidates to be elected.
To vote for a qualified WRITE-IN CANDIDATE, write the person's name in the blank space provided for
that purpose after the names of the other candidates for the same office and FILL IN THE OVAL to the left
of the name you have written in, or your vote will not be counted.
To vote on any measure, FILL IN THE OVAL to the left of the word "YES" or to the left of the word "NO."
All distinguishing marks or erasures are forbidden and may make.the ballot void.
If you wrongly mark, tear or deface any portion of your ballot, replace the ballot in the secrecy sleeve and
return it to the Precinct Board Member and obtain another ballot. For an absentee ballot, replace the ballot in
the I.D. Return Envelope, fill out the appropriate lines, mark the SPOILED box and return it to our office.
MAKE SURE YOU VOTE BOTH SIDES OF YOUR BALLOT. AFTER YOU HAVE COMPLETED VOTING,
at the polls, place your ballot in the secrecy sleeve with the NUMBERED STUB AT THE TOP, hand it to the
Precinct Board Member who shall, in your presence, remove the numbered stub, hand it to you and direct
you to deposit your voted ballot in the ballot box. If you are voting by absentee ballot, when you have completed
voting, place the ballot in the I.D. Return Envelope, fill out the appropriate lines, affix a postage stamp and
return it to our office by mail or in person.
HOW TO MARK YOUR BALLOT
STEP 1
Fill in the oval to the left of the
candidates or measures of your
choice. Make sure the oval is filled in
completely or your vote may not be
counted. Use only the marking device
provided at the poll to mark your ballot.
For an absentee ballot use any black
or blue colored pen or pencil to fill in
the oval.
STEP 2
After you have completed voting, place
your ballot, with the stub at the top in
the secrecy sleeve and hand it, along
with the marking device to the Precinct
Board Member. Absentee voters, place
voted ballot in the I.D. Envelope and fill
in the appropriate lines. Return it to our
office by mail or in person.

EARLY TOUCHSCREEN VOTING
Beginning Monday, October 7, touchscreen voting will be available for early voting in the
County Clerk -Recorder's Office in San Luis Obispo and Atascadero. The touchscreen
operates much the same way as an ATM and is put through the same rigorous testing as the
ballot counting system for paper ballots. Once you are ready to cast your ballot, come in and
try out the latest in election technology.
Early Voting Hours
Atascadero: Oct. 7 to Nov. 4 Monday through Friday
7:30 a.m. to 12:30 p.m. and 1:00 p.m. to 4:00 p.m.
Nov. 5 (Election Day) 7:00 a.m. to 8:00 p.m.
San Luis Obispo: Oct. 7 to Nov. 4 Monday through Friday 8:00 a.m. to 5:00 p.m.
Nov. 2 & Nov. 3 8:00 a.m. to 1:00 p.m.

booklet is further reduced to fit on the letter size pages. 'If you have difficulty reading any of
the information on the sample ballot, please contact our office at 781-5228 and a full size copy
of the ballot will be mailed to you.

PERMANENT ABSENTEE VOTER STATUS
Effective January 1, 2002, any voter can request to be placed on the permanent absentee
voter list. If you are a permanent absentee voter, your absentee ballot will be automatically
mailed to you at the address on. our voter files.
HOW TO BECOME A PERMANENT ABSENTEE VOTER
1. Check to make sure you are not already on the list. On the back.of this sample ballot
is an application for absent voter ballot. If you are a permanent absent voter the
following statement is printed next to Polling Place Location and your ballot will be
mailed on October 7 for this election.

the California Government Code. This is a result of Proposition 34 adopted by the voters

profession. You don't hear that much any more. Politicians are the butt
of jokes from the internet to late night N shows.
So what went wrong? Did the system of government envisioned by
our founders turn out to be a bad idea?
Of course not. But somewhere along ,the way, too many politicians
stopped thinking about the common good, and started thinking about
their own good.

the people of San Luis Obispo County as a criminal prosecutor for
the last 18 years.
In that time I have tried cases ranging from simple misdemeanors
to the most high-profile cases in the history of San Luis Obispo
County, including the death penalty cases of Dennis Webb and Rex
Allan Krebs.
A Judge's primary duties are to conduct fair trials and to efficiently

me back to the Port San Luis Harbor Commission. A major principle
that I believe in is that your property taxes should be spent only on
the part of the Port that is available to the general public. I have
been doing my best to protect your property tax money from being
spent to subsidize the operations and leases and licenses at the
Port. It is a up -hill battle I have taken on.
I have been a commercial fisherman, merchant mariner, Viet Vet
and am an ardent sportfisherman, and own and operate a auto
repair shop and a fly shop in Arroyo Grande, I am the only employee.
My goals: Rebuilding the Harford Pier, it needs help, especially the
walk/roadway out to the end. To establish a profitable enterprise on
Harbor Terrace. And to get the businesses off of the taxpayers backs,
this is a very unpopular idea at the Port, you might imagine. I want
every business that makes a living at the Port to be as prosperous
as it can be, but not on the backs of the property tax payers.

Avila Beach restrooms and beach access.
This list could continue and I am proud to have contributed to the
most progressive period Avila Beach and Port San Luis has ever

Education and Qualifications: As your Councilman for 8 years,
and as Public Works Director for the previous 36, 1 have devoted
over 44 years to protecting and enhancing the unique quality of life
we enjoy in our city. l am known for a common sense approach to
issues, for honesty and for keen negotiating skills. In recent years
I have worked closely with officials from nearby cities, with members
of the Board of Supervisors, with city representatives in the Tri -
Counties (as League of Cities Division president), with Cal Poly,
Cuesta, California Mens Colony, and with our state and federal
legislators.
With my extensive background and reputation for integrity, I have
unmatched qualifications to serve as Mayor. I will be a Mayor with
vision, one you can depend on for decisiveness, and I will make
every effort to restore a sense of trust between government agencies
and the city.
As a fulltime Mayor, I will concentrate on resolving our long standing
water supply and housing needs, completion of the Margarita and
Airport Area annexations, resolving downtown parking needs,
continuing to improve and enhance downtown, and protecting and
preserving our city's neighborhoods. I will continue to support
acquisition of open space, development of the Youth Sports Complex,
improved Senior Center Facilities, and, most importantly,
enhancement of our quality of life.

Occupation: Restaurateur/Soldier
Education and Qualifications: San Luis Obispo is the best city on
earth. Anyone who doesn't believe that shouldn't ask for your vote.
This city is home to diverse people with diverse opinions about how
our city should function today, and what it should be like in the
future. Everyone's opinion is important. Anyone who expresses one
should be honored, not ignored. That's what makes America great,
and one of the reasons why I've worn a military uniform.
I'm not sure the political elite believe that. They seem to think our
city government is their private club, to be managed by them for
themselves and their friends. Anyone who wants to "join" the club
by participating in civic discourse is viewed as a malcontent. Anyone
who isn't opposed to everything is viewed as a nut or a closet
developer (not that there's anything wrong with that).
I want to change that kind of thinking. This is what I think: Effective
management means listening to everyone and deciding what's best
for the common good. Even if it means someone gets upset. It
means being a leader instead of just talking like one.
Here's why you should vote for me: I'm owner of the award-winning
Mother's Tavern, an instructor for at -risk youth at the Grizzly Youth
Academy, a U.S. Army military police sergeant, lead singer for the
Sugar Daddy Swing Kings swing band, and a dedicated rugby player.
Vote for me because I'm not like the typical policy wonk talking a
good game but getting nothing done. I get things done. I have to.
I don't know any other way to live.
After so many years of studying, talking, talking and studying, have
the wonks solved the housing problem in town? The sorry state of
some of our city's neighborhoods and parks? Our precarious supply
of water? Necessary jobs disappearing to other cities? The flight of
families from the city?
Of course not. That would mean they'd have to do something. That
just isn't the comfortable Club SLO way. Make a tough decision?
What would people at the club say?
Vote for me because my diverse background and real-world
experience in business, the military, entertainment, and athletics
have given me the gift of tolerance, understanding, and compassion
for those whose voices may be weak, but whose hearts are strong.

Esta ciudad es el hogar de personas diversas con opiniones diversas
sobre como nuestra ciudad debe funcionar hoy en dfa, y como debe
ser en el futuro. La opinion de todo el mundo es importante. Se
debe honrar y no desatender a cualquier persona que exprese una
opinion. Eso es Io que hace que Estados Unidos sea grande y una
de las razones por las cuales he Ilevado un uniforme militar.
No estoy seguro de que la elite politica piense asi. Ellos parecen
pensar que nuestro gobierno municipal es su club privado y que
debe ser administrado por ellos mismos y sus amigos. Cualquier
persona que quiera "asociarse"'al club por participar en un discurso
civico se considera un insatisfecho. Cualquier persona que no se
oponga a todo se considera un loco o un urbanizador disfrazado
(no que sea esto tan mato).
Quiero cambiar esa forma de pensar. Esto es to que creo yo: La
administracion eficaz significa escucharle a todo el mundo'y decidir
que es to mejor para el bien com6n. Aun si a consecuencia alguien
se enoja. Significa ser un lider en lugar de solamente hablar como
uno.
He aqui las razones por las cuales debe votar por mf: Soy dueno

Despues de tantos anos de estudiar, conversar, conversar y estudiar,
khan podido estos chapuceros solucionar los problemas de vivienda
en nuestro pueblo? LY el estado lamentable de algunos de los
vecindarios y parques de nuestro ciudad? LNuestro precario
suministro de agua? el--Empleos necesarios que desaparecen a otras

Vote por mf porque mis antecedentes diversos y experiencia en el
mundo real en negocios, en el servicio militar, en el mundo del
espectaculo, y en los deportes me ha dado el don de tolerancia,
comprension y compasion para aquellas voces que podrfan ser
debiles pero cuyos corazones son fuertes.

Education and Qualifications: In the past four years, housing
affordability in San Luis Obispo has fallen from 40% to 266. This
means only one in five households can afford the price of an average
home. Since housing prices continue to rise, most residents will
never be able to afford a house no matter how much they scrimp
and save ... unless the City takes dramatic action now.
Here are some of the things I think the City should do:
Require all new commercial developments to include an affordable
housing component or pay in -lieu fees. New residential
developments are already required to do this, yet commercial
developments create the housing need.
Develop incentives to encourage existing commercial
developments to add second -story apartments. This would free
up housing in our neighborhoods for families.
Accelerate the build -out of previously approved housing
developments. The General Plan allows residential growth of 1 %
per year. We're averaging half that. We can build the houses
faster and still stay within the 1% cap.
• Zone more land for housing and less for commercial.
• Encourage the County to develop a "new town" at Camp San
Luis. This town would be close to jobs at the Men's Colony,
Cuesta College, and County operations. It could include dorms
for out -of -area Cuesta students.
• Work with the Dalidio family and the Airport Land Use Commission
to make sure housing and not just stores are built on the Dalidio
property.
• Take aggressive action at the state and local level to force Cal
Poly to house more of its students on campus. In particular, this
means the fast -tracking of additional dorms on campus and no
enrollment increases until after those dorms are built.
I've been talking about affordable housing at City Council meetings
for over a year now. In that time, little action has been taken. I
believe the City must be more aggressive in meeting the affordable
housing need. If elected, I'll make sure that need is addressed ...
now.
On election day, I'd appreciate your support. Vote Andrew Carter for

porcentaje de vivienda asequible en San Luis Obispo ha bajado del
40%al20%. Esto significa que solamente una familia en cinco puede
pagar el precio promedio de una casa. En vista de que los precios
de vivienda siguen subiendo, la mayor parte de los residentes nunca
podra comprar una casa, no importa cuanto economizan y cuanto
ahorran ... a menos que la ciudad tome medidas radicales ahora.
utas son algunas de las cosas que yo creo que la ciudad deberia
hacer:
• Exigir que todas las nuevas urbanizaciones comerciales incluyan
un componente de vivienda econ6mica o que paguen un cargo
en su lugar. Las nuevas urbanizaciones residenciales ya tienen
que hacer eso, pero son las urbanizaciones comerciales que
crean la necesidad de vivienda.
• Desarrollar incentivos para estimular a las urbanizaciones
comerciales actuales a agregar apartamentos en el segundo
piso. Esto aliviarfa la vivienda en nuestros vecindarios para las
familias.
Acelerar la construccibn de urbanizaciones residenciales
previamente aprobadas. EI plan general permite un crecimiento
residencial anual del 1%. Nuestro promedio es la mitad de eso.
Podemos construir las casas mas rapido y todavia cumplir con
el Ifmite del 1%.
• Dedicar mas zonas para vivienda y menos para construcci6n
comercial.
• Estimular al condado a desarrollar un "nuevo pueblo" en el
Campamento San Luis. Este pueblo estarla cerca de Jos empleos
en la Colonia de Hombres; en el Colegio Universitario Cuesta,
y en las operaciones del condado. Podr(a incluir dormitorios para
los estudiantes de Cuesta que provengan de otros lugares.
• Trabajar con la familia Dalidio y con la Comisi6n de Usos de
Suelo del Aeropuerto para garantizar que se construya vivienda
y no solamente tiendas en la propiedad de Dalidio.
• Tomar medidas en6rgicas a nivel estatal y local para obligar a
la Universidad Politacnica de California a hospedar a mas de
sus estudiantes en el plantel escolar. En particular, esto significa
una aceleraci6n en la construcci6n de dormitorios en el plantel
sin aumentos en la matrfcula hasta que se hayan construido
esos dormitorios.

Occupation: Mayor and Council member/Educator
Education and Qualifications: I have lived in San Luis Obispo for
32 years with my wife Kathi, and our two sons. I am currently a
member of the council and a professor specializing in municipal
government, finance, law and public administration. My service record
covering a period of twenty-six years includes city planning
commissioner, city council member, and mayor.
I strive to reconcile environmental and business concerns with
emphasis on maintaining the small town atmosphere that makes
San Luis Obispo such a genuinely attractive place to live and work.
I will continue to build consensus on the council and in the
community with consultation and respect.
One of my major goals is resolving our housing needs and adopt
a new housing element in the general plan. I continue efforts to stop
Sacramento's plan to double the city's population in twelve years
costing you the taxpayer over 25 million dollars with their new housing
allocation plan that ignores growth management, land use policies
and water limits.
I will continue actions to secure our share of a reliable water source
using a desalination program saving the taxpayers three million dollars
a year in water rates. Nacimiento Reservoir project remains as a
backup resource. These efforts to augment our water sources are
to protect our City from the danger of future droughts.
I have worked to improve intergovernmental relations with other
cities, the county, the schools, and the university. I have initiated
joint meetings with all seven cities and the county to help resolve
common problems such as housing and state actions that take away
our revenues and local control.
I support job stability with higher paying employment opportunities
and attract businesses such as the Copeland downtown project. I
support athletic fields, senior center and the success of the
Performing Arts Center.
I support the green belt around the city along with waterway and
habitat preservation.
I support improved public works projects such as street maintenance,
and additional downtown parking.
I have worked for neighborhood preservation and continued
communication with neighborhood associations. Viable neighborhoods
are vital to our quality of life.
I continue to support sound finance policies that have rewarded our
city with the highest financial ratings. I will continue to work to
achieve future balanced budgets for the city.
Help me achieve these goals and objectives. I ask for your vote to
be elected council member on November 5th.

recurso de resguardo. Estos esfuerzos para aumentar nuestras
Fuentes de agua sirven para proteger nuestra ciudad del peligro de
sequias en elfuturo.
He trabajado para mejorar las relaciones intergubernamentales con

SECTION 901. PUBLIC WORKS TO BE DONE BY CONTRACT
"(A) except as provided in subsection (D) of this section, every
roject involving an expenditure of City monies of more than the
imount specified in Section 20162 of the Public Contract Code of
he State of California, as the same now exists or may hereafter be
[mended for the construction or improvement of public buildings,
corks, drains, sewers, utilities, parks, playgrounds, and streets
exclusive of projects for resurfacing, maintenance, and repair of
treets) shall be let by contract to the lowest responsible bidder
[fter notice by publication in the official newspaper by one or more
nsertions the first of which shall be at least ten (10) calendar days
[efore the time for opening bids.
"(B) All bids shall be accompanied by either a certified or
:ashier's check, or a bidder's bond executed by a corporate surety
wthorized to engage in such business in California, made payable
o the City. Such security shall be in an amount not less than that
specified in the notice inviting bids or in the specifications referred
o therein, or if no amount be so specified then in an amount not
ess than ten percent (10%) of the aggregate amount of the bid. If
he successful bidder neglects or refuses to enter into the contract,
vithin the time specified in the notice inviting bids or specifications
eferred to therein, the amount of the bidder's security shall be
ieclared forfeited to the City and shall be collected and paid into
is general fund and all bonds so forfeited shall be prosecuted and

nay eject any and all bids presented and may readvertise at its

"(C) The Council, after rejecting bids or if no bids are received,
nay declare and determine that, in its opinion, based on estimates
approved by the City Administrative Officer, the work in question
nay be performed better or more economically the City with its
)wn employees and after the adoption of a resolution to this effect
)y at least four (4) affirmative votes of the council and containing
a declaration of the facts constituting such urgency.
"(D) Nothing in this section shall be construed to apply to any
xoject involving the expenditure of City monies by the City for public
Norks in cooperation with a developer or subdivider for oversized
acilities or such cooperative extension or replacement of mains and
appurtenances. For those projects the City shall have the authority
:o make funds available to the cooperating developer or subdivider
in a fixed formula basis established at least annually by Council

MEASURE L-02
Section 901 of the San Luis Obispo City Charter currently requires
that most City public works construction contracts which cost more
than the amount specified in California Public Contract Code Section
20162 must be awarded to the lowest responsible bidder after notice
and a formal bidding process. Public Contract Code Section 20162
(which was last amended in 1982) sets the expenditure limit requiring
public bidding at $5,000.00. Because of inflation, this $5,000.00 limit
requires the City to prepare formal plans and specifications and
conduct a formal bidding process for even minor projects, which
increases costs and extends the time necessary to award contracts.
This Charter amendment would allow the City to award maintenance
related Projects using a "unit price contract" for all necessary labor,
materia s, and equipment provided such contracts are secured on
a competitive basis as otherwise required by Public Contract Code
Section 201285. A "unit price contract" is a competitively bid, fixed
unit price, indefinite quantity contract for renovation, repair,
remodeling, alteration, or other repetitive work. New construction
would still be subject to bidding requirements. The City Council must
establish guidelines by ordinance for the award and use of such
unit price contracts, and may set an amount below which the City
Administrative Officer may award such contracts.
In addition, this Charter Amendment would allow public works
contracts of. $100,000 or less to be awarded by the alternative
procedures of the Uniform Public Construction Cost Accounting Act,
as set forth commencing with Public Contract Code Sections 23032.
This would allow for simplified bidding procedures for projects under
$100,000.00, provided specified competitive safeguards are met.
The City Council must establish guidelines by ordinance for the use
of such contracts.

ARGUMENT IN FAVOR OF MEASURE L-02
The City contracting process is governed by a decades -old method
of determining which projects must be put out to formal public bid.
The current City Charter has very restrictive provisions regarding
contracting for construction projects. Any project greater than $5,000
in value must be competitively bid using formal plans and
specifications. The fact is, not every project needs individual formal
bid documents to be completed. That's just too much paperwork and
bureaucracy.
Amending the City Charter to adopt Unit Price contracts and Uniform
Public Construction Cost Accounting Act provisions will enhance our
ability to get projects under construction, with an emphasis on quality
construction. These alternative methods greatly enhance the City's
flexibility to deal with changing priorities.
Adoption of these two methods of contracting will significantly
increase the amount of work available for local contractors. It will
focus on expediting construction rather than forcing every project
through the same formal bid procedures. We will still seek formal
bids for new construction, but there will be many more chances for
smaller, more specialized contractors to be successful.
You can help to modernize an old process that will result in a real
boost to our local economy. Imagine a City whose infrastructure is
maintained in a timely and efficient manner. Streets, buildings, parks
and utilities are in good working order and construction projects for
repairs are quickly initiated and completed by skilled contractors.
We have the opportunity to make this vision a reality and update
our contracting practices by adopting two alternative methods of
contracting for construction Projects. If you want to help the City
achieve its vision to get projects done faster and more efficiently,
please vote yes on Measure L-02.
