SUBJECT: ADVISORY BODY APPOINTMENT FOR AN UNSCHEDULED VACANCY
ON THE CULTURAL HERITAGE COMMITTEE
RECOMMENDATION
Confirm the appointment of Ivan Simon to the Cultural Heritage Committee (CHC) to fill
an unscheduled vacancy with term ending March 31, 2027.
POLICY CONTEXT
The Advisory Body Handbook, last adopted by City Council in September 2021, with
amendments being made in December 2023, outlines the recruitment procedures,
membership requirements, and term limits for all City advisory bodies. Additionally, the
City Council Policies and Procedures Manual, last updated May 2023, describes the
“Appointment Procedure” and “Process” for Advisory Body appointments. Recruitment
and appointment recommendations were performed in conformance with all recruitment
procedures, processes, and bylaws found in these resources.
California Government Code Section 54972, Local Appointments List (Maddy Act),
requires that on or before December 31st of each year, each legislative body shall prepare
an appointments list for their boards, commissions, and committees whose members
serve at the pleasure of the legislative body. This obligation was met and is ongoing.
Additionally, the Maddy Act limits the posting for upcoming vacancies to be no more than
twenty days in advance of vacancies and that posting must be publicly available for at
least ten days. Posting for this vacancy was made in compliance with the Maddy Act.
DISCUSSION
Per the City Council Policies and Procedures, each City Advisory Body has a respective
City Council sub-committee (“sub-committee”), generally consisting of two Council
members, with several having only one Council member assigned. Membership on the
sub-committees is assigned annually. One of the duties of the sub -committee is to
interview advisory body candidates and make recommendations to the full City Council
for appointment of community members to the respective Advisory Body.

2023. A notice that the City was specifically recruiting for the current unscheduled CHC

ALTERNATIVES
Council could recommend consideration of alternate applicants from the past
annual recruitment or direct staff to re-open recruitment for additional candidates.
This action is not recommended as the Advisory Body annual recruitment yielded multiple
qualified candidates and the Council sub-committee members have been thorough in
their assessment of these candidates.
ATTACHMENTS
The candidate applications are available for review in the City Clerk’s office.
