Cooney Recorder May 18, 1994 Time: 08:00 31_ _ COVENANT TO INSTALL PUBLIC IMPROVEMENTS UPON REQUEST OF CITY W_ Rec No: 00037213 RF 13.00 ;TOTAL 13.00 WHEREAS, the undersigned own certain real property commonly known as Tract 1750 - Units 1 & 2 and WHEREAS, the undersigned have requested and been granted a temporary exception by the City Council from the requirement of installing certain public improvements on said property conditioned upon execution of a covenant by the property owner agreeing to install said .improvements at such time in the future as the city may request same. NOW THEREFORE, in consideration of the granting of permission to temporarily defer installation of certain public improvements consisting of: Orcutt Road improvements adjacent to Lots 4 & 5 and "remainder parcel ", Tract No. 1750 and Islay Park, required as conditions of said Tract 1750, including necessary undergrounding and extension of utilities and services. A use permit, development or further subdivision of said lots shall require all or part of the above - mentioned improvements. The City Engineer may postpone any portion of the required improvements deemed unnecessary at that time. The Orcutt Road improvements may be required prior to any use permit or development if deemed necessary by a resolution of the City Council. The undersigned owner(s) of property hereinafter described hereby covenant with the City of San Luis Obispo to install the above mentioned public improvements without cost to City upon one hundred. eighty (180) days written notice from the City of San Luis- Obispo requesting that said improvements be installed. Said property is located in the City of San Luis Obispo, County of San Luis Obispo, State of California, and is described as follows: 1. A.P.N. 53- 091 -012 & 013 (portion). 2. Legal Description Tract .1750 -.Lot Nos.. 4 &5 & "remainder parcel This covenant shall run with the land and shall be binding upon the undersigned owners, their heirs, exelutors, administrators, and assigns.
