DEED OF EASEMENT
SAN LUIS OBISPO CITY SCHOOLS, as Grantor, hereby grants to the CITY OF
SAN LUIS OBISPO, a municipal corporation, San Luis Obispo County, California, as
Grantee, the following easement in the County of San Luis Obispo, State of California,
to wit;
A ten (10) foot easement for a sewer trunk line being five (5) feet
on each side of the following described centerline and being in
Lot 27 of the Orcutt Subdivision and Section 36, T 30 S, R 12 E, MDM.
Commencing at the northwest corner of a tract of land conveyed to The
General Fireproofing Company as shown of Licensed.Surveyors map in
Vol. 7, page 114, and running thence N 390 17' E along the north
line of said tract'35.90 feet to the true point of beginning; thence
from said true point of beginning N 410 041 W 242.20 feet to a point;
thence N 310 021 W parallel with the easterly Southern Pacific Railroad
right -of -way, 237.85 feet to a point; thence N 480 07' W 256.88 feet to
a point; thence S 480 29+ W 5 feet to the present Southern Pacific
Railroad right -of -way line.
TO HAVE AND TO HOLD said easement for the purpose of laying, maintaining,
repairing, replacing, enlarging, operating and removing sanitary sewers and
appurtenances for said city, together with the right of ingress and egress therefor.
The Grantee shall, at its cost and expenoe, and without delay, restore any
improvements danaged or destroyed at any time by reason of the laying of said
sanitary sewers, or by Grantee in maintaining, repairing, operating or removing
any sanitary sewer or sewers in said easement, and shall restore the surface of the
ground to as near its original condition as possible, including an equal distribution
of surface earth, and shall save the Grantor from any suits or damages arising from
and during the construction, or by reason of maintaining, repairing or operating
said sanitary sewer or sewers therein.
