EASEMENT AMENDMENT
WHEREAS, the STATE OF CALIFORNIA hereinafter called STATE granted to
the UNITED STATES OF AMERICA an easement for pipeline facilities through the
California Polytechnic College campus by the certain document entitled
"Easement" dated July 31, 1942 and recorded in Volume 358, page 383 of Official
Records of San Luis Obispo County, California, and
WHEREAS, said pipeline facilities and easement were sold and assigned
by the UNITED STATES OF AMERICA to the CITY OF SAN LUIS OBISPO, a Municipal
Corporation, hereinafter called CITY, and
WHEREAS, it is the mutual desire of said STATE and said CITY to amend
said Easement,
NOW THEREFORE, said Easement is hereby amended as follows:
(1) The center line of said ten foot easement is amended as follows:
Commencing at a point near the Northwest corner of the Southeast quarter
of the Southwest quarter of Section 15, Township 30 South, Range 12 East
MDM, said point being 3 ft Northeasterly from point of beginning of the
center line of that certain easement dated July 31, 1942 and recorded
in Volume 358, Page 383 of Official Records of San Luis Obispo County,
California, and measured at right angles to the center line of said
easement; thence in a Southeasterly direction parallel to and 3 feet
distant measured at right angles from said center line of said easement
to the Easterly line of the Southern Pacific Company's 100 foot right -of-
way; thence ccntinuing South 840 02' 30" East 15.69 feet more or less
to a point 15 feet measured at right angles Easterly from the Easterly
line of said right -of -way; thence in a Southeasterly direction parallel
to and 15 feet distant measured at right angles from said Easterly line
of the Southern Pacific Company's right -of -way 489 feet.
(2) The STATE hereby grants an additional easement six feet wide the
center line of which is described as follows:
Commencing at the last point described in Amendment No. 1, thence deflect-

(3) The CITY hereby covenants to supply water to the STATE at the
California State Polytechnic College campus on the same basis and at a rate not
to exceed the rates charged to like users within the city limits of said CITY,
subject to any increase or decrease of the rates as may be made by the City
Council.
(4) That all other provisions of said Easement shall remain in full
force and effect.
IN WITNESS WHMOF, the STATE OF CALIFORNIA, by and through the Director
of Finance, together with the consent of the Department of Education, has

The Department of Education and the Department of Finance have signed
the amendments to the water easement that the City of San Luis Obispo
owns across the college property. The Department of finance has given
us some sus -ested language clarification in the event it is necessary
to amend the easement in the future. Because of the urgency of tia-s
project the-r did not insist that the nev language be placed in the
currently proposed easement amendments.
In addition, the Department of Finance pointed oat to us that instead
of having an oral understanding concerning the proper replacement
of corrals and blacktop in our dairy area, damages to any of our
utility lines and fence replacement, that it would be better to have
ti.ese in the easement. We prevailed upon them, however, to agree
that these points could be covered in the specifications or by letter.
As it is too late to include these points in the specifications, I
would appreciate a letter from you giving us the necessary assurance
that the will be protected on those items.

The language of the proposed amendments to the water easement, which.the City
owns and which runs across property owned by California State Polytechnic
College, has been reviewed by our staff and found to be acceptable. I would
suggest that the City prepare the amendments in final form so that I can sub-
mit them to the President of the College for his approval. After approval by
the President, the proposed amendments will have to be processed in Sacramento.
It is our understanding that the City will write the specifications so that the
center of the trench will be on the center of the easement, or east of the cen-
ter of the easement, along California Boulevard. In addition, you will try to
schedule the work along California Boulevard for completion prior to the Fall
term of the college because of the traffic problem.
A relatively minor problem remains which I think can be handled satisfactorily
by a letter of understanding. As I had previously discussed with you and Ir.
Thompson, our Dean of Agriculture is concerned over possible damages to his
land and crops along the length of the easement that runs in a straight line
through the Dairy Unit. There are two problems:
1. Ele would like to have the contractor replace a reasonable amount of
top soil along this stretch of pipe line and in such a manner that we
can expect the filled area to be reasonably level after it settles.
2. Ne understand that you can schedule your work so that you will not
have to go through our corn field prior to October 1. In the event
that you do schedule your work so as to go through this field prior
to October 1 crop damage, which is estimated to be approximately °.500,
should be borne by the City.
