CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on August 20, 2024 at 5:30 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart. 2. PLEDGE OF ALLEGIANCE Vice Mayor Pease led the Council in the Pledge of Allegiance. 3. PRESENTATIONS 3.a OATH OF OFFICE - CITY MANAGER WHITNEY MCDONALD City Clerk Teresa Purrington administered the Oath of Office to the new City Manager, Whitney McDonald. 3.b SLO TRANSIT 50TH ANNIVERSARY PROCLAMATION Mayor Stewart presented a proclamation in recognition of SLO Transit's 50th anniversary to Deputy Director Jennifer Rice on behalf of the Mobility Services Division. 3.c CITY MANAGER REPORT City Manager Whitney McDonald provided a report on upcoming projects. 2 4. Ayes (5): Council Member Francis, Council Member Marx, Council Member Shoresman, Vice Mayor Pease, and Mayor Stewart CARRIED (5 to 0) 5.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 5.b MINUTES REVIEW - JULY 9, 2024 AND JULY 16, 2024 COUNCIL MINUTES Approve the following minutes of the City Council: • July 9, 2024 - Special Closed Session • July 16, 2024 - Regular Meeting 5.c APPROVE A MILLS ACT HISTORICAL PROPERTY PRESERVATION AGREEMENT FOR THE BRECHEEN HOUSE AT 1133 PISMO STREET (HIST-0211-2024) Adopt Resolution No 11511 (2024 Series) entitled “A Resolution of the City Council of the City of San Luis Obispo, California, approving a Historic Property Preservation Agreement between the City and the owner of the Brecheen House at 1133 Pismo Street (Application No. HIST-0211 -2024).” 3 5.d APPROVE A SIDE LETTER REGARDING PARAMEDIC INCENTIVE PAY TO THE JANUARY 1, 2024 THROUGH JUNE 30 2027, MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN LUIS OBISPO AND THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS, LOCAL 3523 Adopt Resolution No. 11512 (2024 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving a Side Letter to the January 1, 2024 through June 30, 2027 Memorandum of Understanding between the City of San Luis Obispo and The International Association of Firefighters, Local 3523.” 5.e AWARD A CONSTRUCTION CONTRACT FOR THE LAGUNA LAKE DOG PARK REVITALIZATION PROJECT, SPECIFICATION NO. 2001068 1. Award a Construction Contract to R. Burke Corporation for the Laguna Lake Dog Park Revitalization Project, Base Bid and Additive Alternate A, in the amount of $1,560,191.30; and 2. Approve a budget transfer of $485,000 from the Laguna Lake Park Improvements project account (2000057-01) to the Laguna Lake Dog Park Revitalization project account (2001068); and 3. Authorize City Engineer to approve Contract Change Orders up to the available project budget. 5.f ANNUAL SPECIAL TAX LEVY REPORT FOR THE COMMUNITY FACILITIES DISTRICT NO. 2017-1 (AVILA RANCH) FOR FISCAL YEAR 2024-2025 Receive and file the Annual Special Tax Levy Report for the City of San Luis Obispo Community Facilities District No. 2017-1 (Avila Ranch) for Fiscal Year 2024-2025. 5.h SECOND READING AND ADOPTION OF ORDINANCE NO. 1737 (2024 SERIES) AMENDING TITLE 10, CHAPTER 36, OF THE MUNICIPAL CODE Adopt Ordinance No. 1737 (2024 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, amending Title 10, Chapter 36 (Designation of Residential Parking Permit Areas), of the Municipal Code modifying the sections pertaining to Dana Street Preferential Parking District.” 4 5.i APPROVAL OF CITY MANAGER CONTRACT AND APPOINTMENT OF CITY MANAGER 1. Adopt Resolution No. 11513 (2024 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving a Contract of Employment for City Manager”; and 2. Appoint Whitney McDonald as City Manager; and 3. Adopt a Regular Salary Schedule as required by California Public Employees Retirement System (CalPERS). 5.j ADVISORY BODY APPOINTMENT FOR AN UNSCHEDULED VACANCY ON THE CULTURAL HERITAGE COMMITTEE Confirm the appointment of Ivan Simon to the Cultural Heritage Committee (CHC) to fill an unscheduled vacancy with term ending March 31, 2027. 5.k APPROVAL OF THE FINAL MAP FOR TRACT 3136 PHASE 1, 3580 BULLOCK LANE (SBDV-0490-2019) Adopt Resolution No. 11514 (2024 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving the Final Map for Tract 3136 Phase 1 (3580 Bullock Lane, SBDV-0490-2019),” and authorize the Mayor to execute a Subdivision Agreement in a form subject to the approval of the City Attorney. 5.g ANNUAL SPECIAL TAX LEVY REPORT FOR THE COMMUNITY FACILITIES DISTRICT NO 2019-1 (SAN LUIS RANCH) FOR FISCAL YEAR 2024-2025 Council Member Marx declared a conflict on this item and recused due to owning property in San Luis Ranch subdivision. Motion By Council Member Francis Second By Council Member Shoresman Receive and file the Annual Special Tax Levy Report for the City of San Luis Obispo Community Facilities District No. 2019-1 (San Luis Ranch) for Fiscal Year 2024-2025. Ayes (4): Council Member Francis, Council Member Shoresman, Vice Mayor Pease, and Mayor Stewart Recused (1): Council Member Marx CARRIED (4 to 0) 5 6. PUBLIC HEARING AND BUSINESS ITEMS 6.a POLICE DEPARTMENT 2023 ANNUAL REPORT AND MILITARY EQUIPMENT USE (AB 481) ANNUAL UPDATE (Estimated Time: 60 minutes) Police Chief Scott, Deputy Chief Brain Amoroso, and Deputy Chief Mickel provided an in-depth staff report and responded to Council questions. Ayes (5): Council Member Francis, Council Member Marx, Council Member Shoresman, Vice Mayor Pease, and Mayor Stewart CARRIED (5 to 0) 6.b INTRODUCE AN ORDINANCE AMENDING TITLE 6 (ANIMALS) OF THE SAN LUIS OBISPO MUNICIPAL CODE (Estimated Time: 30 minutes) Police Chief Scott and Deputy Chief Brain Amoroso provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Mayor Stewart Second By Council Member Francis Introduce Ordinance No. 1739 (2024 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, amending Title 6 (Animals) of the Municipal Code to adopt and incorporate by reference San Luis Obispo County Code Title 9 (Animals) and to retain certain city requirements regarding animals.” with the following change: • Amend SLOMC Sections 6.28.070 and 6.28.080 to permit bee keeping and animal breeding for educational purposes on school district owned and designated properties and for agricultural purposes located within a Conservation/Open Space or Agriculture zoning district within the City. 6 Ayes (5): Council Member Francis, Council Member Marx, Council Member Shoresman, Vice Mayor Pease, and Mayor Stewart CARRIED (5 to 0) 6.c INTRODUCE AN ORDINANCE TO AMEND TITLE 17 (ZONING REGULATIONS) OF THE MUNICIPAL CODE TO ADD RESIDENTIAL USES AS CONDITIONALLY ALLOWED WITH A MINOR USE PERMIT IN THE NEIGHBORHOOD COMMERCIAL (C-N) ZONE (CODE-0224-2024) (Estimated Time: 30 minutes) Associate Planner Hannah Hanh provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Vice Mayor Pease Second By Council Member Shoresman Introduce Ordinance No. 1740 (2024 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, approving an amendment to Table 2-1 (Uses Allowed by Zone) in Title 17 (Zoning Regulations) of the Municipal Code with an exemption from environmental review (CEQA) (CODE-0224-2024).” Ayes (5): Council Member Francis, Council Member Marx, Council Member Shoresman, Vice Mayor Pease, and Mayor Stewart CARRIED (5 to 0) 7. LIAISON REPORTS AND COMMUNICATIONS Vice Mayor Pease attended the SLOCOG meeting. Council Member Marx attended a neighborhood watch gathering in the San Luis Ranch development, the Mayor and Advisory Body Chair meeting, a neighbors night out in San Luis Ranch, the ribbon cutting at the North Broad Street park, the IWMA Board meeting, and the Investment Oversight Committee meeting. Council Member Shoresman attended the Homeless Services Oversight Committee meeting, Labor breakfast at the Elks Lodge held by Assembly Member Addis, a Welcome Home Village meeting, participated in a tour of the Anderson Hotel, and volunteered at Concerts in the Plaza. 7 Council Member Francis went to the Labor Presentation at the Mid State Fair, a Tobacco Coalition meeting, Student Community Liaison Committee meeting, and the CAPSLO monthly meeting. Mayor Stewart attended the Mayor and Advisory Body Chair meeting, the Labor presentation at the Mid State Fair, the Duval Park Monday meet-up, and the Student Community Liaison Committee meeting. She also visited Bubble Gum alley with Senator Laird, spoke at the Restorative Partner's event, and participated in a ride-a-long with the Police Department. 8. ADJOURNMENT The meeting was adjourned at 9:02 p.m. The City Council will hold a Special Closed Session Meeting on August 21, 2024 at 5:30 p.m. in the Council Hearing Room at City Hall. The next Regular Meeting of the City Council will be held on September 3, 2024 at 5:30 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo. _________________________ APPROVED BY COUNCIL: 09/03/2024
