I have consulted with a Landscape Architect and Arborist, and Structural Engineer, regarding the proposed plan to construct a continuous concrete footing with a wooden fence above, as described on Sheet 1(Site Plan) and Sheet 1.2 (Wall Profile) of the Project submitted Drawings. The Arborist said if the fence with concrete footing were built as currently designed, the Tree Roots would be cut and the Tree’s would die, and eventually fall on my house from a strong South wind. This will create a significant reduction in my Quality of Life. As proposed, the new fence would run 174.31 along the South property line. The property on my side of the fence is lined with mature Tree’s next to the fence, some 100’ tall with 3’ trunk diameter. Acacia creek Top of Bank is 25’ from the property line, and provides for an aviary sanctuary for a variety of Wildlife. Protected wildlife (Raptors – Hawks) are currently nesting in the taller trees. The Tree’s and Drip line & Root Zone do not appear to be shown on the Site Plan, but should be, as the Drip line typically determines the Root zone. The Drip line measures from 15’ to 25’ into the newly created Lots. The over-excavation required for the proposed buildings encroach into the Root zone. 50% of the largest tree root zone would be lost. The Structural engineer said there were numerous alternative ways to build a fence while saving the trees. I have reached out to the City Arborist and City Biologist to visit the Site, in hopes of finding an alternataive fence design that would protect and preserve my Trees and the wildlife, and also allow the applicant to build his own fence. In talking with the applicant, I believe he wants the same thing. My request is for a Report from the City Arborist regarding Tree Root Protection, and the city Biologist regarding Wild Life Survey and Nesting Disruption Impaacts. I believe the applicant has the right to subdivide and develop his Lot…. Just as I equally have the right to preserve and protect my Property and Quality of Life.
