The Knox box at the front door is currently keyed to the County key; we should contact the local supplier and try and replace the front door only of the Knox box to the City key. Additionally, the backflow prevention device at the Fire Department Connection (FDC) seems to have a leak on the building side; she recommends we have it inspected and/or repaired. The City requires a MUP to operate a daycare in the C-S zone of the Airport Area (attached). However, the main hurdle is requirements of the County’s ALUP. The parcel is primarily in Airport Safety Zone 4 (teal color) and partially in Safety Zone 6 (purple color). 3 Per Table 4-5 of the ALUP, day care facilities are identified as incompatible uses that “should not be permitted under any circumstances” in Safety Zone 4. There may be a path forward under Section 2.9.1 (Small-Scale Individual Projects). The project would need to demonstrate compliance with applicable noise, building height, land use density/intensity, etc. requirements for Safety Zone 4. Similar to Legacy Daycare, this would require a referral to ALUC for review and a determination of consistency. Legacy Daycare at 4725 Allene Way is located on a lot larger than one acre and a flexible interpretation of “net acreage” was allowed by ALUC and their legal counsel to meet finding (a). The flexible interpretation included the select building square footage and site improvement areas (e.g., parking, etc.) that specifically serve the daycare.
