HomeMy WebLinkAboutR-8501 Amending General Plan Housing Element Regarding Minimum Term of Affordability for Affordable HousingRESOLUTION N0.8501(1996 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING GENERAL PLAN HOUSING ELEMENT PROVISIONS REGARDING THE MINIMUM TERM OF AFFORDABILITY FOR AFFORDABLE HOUSING. WHEREAS, the Planning Commission and the City Council have held public hearings on the subject amendment in accordance with the California Government Code; and WHEREAS, these amendments come to the Council upon the recommendation of the Planning Commission; and WHEREAS, the Director of Community Development has determined that proposed amendments are not a "project" as defined in Section 15378 of the California Environmental Quality Act (CEQA) since it involves general policy and procedure making and is, therefore, exempt from the provisions of CEQA; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Environmental Determination. The City Council has determined that adoption of this amendment is not a "project" as defined by CEQA and is, therefore, exempt from the provisions of CEQA. SECTION 2. Findings. The proposed amendments implement, and are consistent with, the Affordable Housing Incentives (SLOMC Ch. 17.90) and State law. 2. The proposed amendment will implement General Plan policies by encouraging the development of housing affordable to very-low and low - income persons. SECTION 3. Term of Affordability Amended. The City Council hereby amends the General Plan Housing Element Policy as follows (strikeout text to be deleted; redline text to be added): A. Policy 1.22.1 shall be amended to read: "For a project to qualify as "affordable housing" under the provisions of this Element, - guarantees must be presented that the housing units will remain affordable foss long e R -8501 Council Resolution No. 8501 (1996 Series) Page 2 B. Program 1. 22. 10 shall be amended to read: "The City will amend its regulations to require that new development projects include affordable housing units, with guarantees that they remain prrpentemly affordable,::.a in -lieu fee re .,q u Affordable iHousin 10 . . On motion of Smith , seconded by Roalman , and on the following roll call vote: AYES: Council Members Smith, Roalman, Romero, Williams, Mayor Settle NOES: None ABSENT: None the foregoing resolution was passed and adopted this 20 day of February , 1996.
