DATE September 6, , 1960 CITY OF SAN IRIS ORISPO vAyor 4 City Clerk 40 � AGREDIENT 0 b �c � THIS AGRE3 ENT, executed this 1st day of September , 1960, by and between JOHNSON HIGHLANDS, INCORPORATED, hereinafter called Grantor, and the CITY OF SAN LUIS OBISPO, a municipal corporation, hereinafter called City, witnesseth: For and in consideration of the conveyance by Grantor: of 0.014 acres more or less lying along Johnsen Avenue, and in consideration of Grantor agreeing to install curb and gutter along said right -of -way granted the City and to complete the earthwork sufficient to provide a six.foot (61) landing on the property side of the curb line; across the entire frontage, the City agrees to assume engineer- ing and legal expense, to complete the earthwork on the street side of the curb line and to place base and paving to meet the new curb and gutter. It is understood that the city, at its option, may proceed with their portion of the improvements set forth hereinabove at any time the city so desires, but that the City is not under any obligation to do so unless and until the Grantor has installed its improvements. It is further understood that the Grantor need not install its share of said improvements unless and until Grantor subdivides or erects structures on its property in accordance with the Curbs, Gutters and Sidewalk Area Ordinance.
