For good and valuable consideration, the receipt and sufficiency of which is here-
by acknowledged, the undersigned owners of certain property hereinafter described,
hereby covenant with the City of San Luis Obispo on behalf of said owners, their
heirs, executors, administrators and assigns, as follows:
1. That the City of San Luis Obispo Planning Commission, by Resolution No. 152 -61,
has granted an exception to the requirement for sidewalks to property described
below in accordance with Section 7330.8A (3) and has determined that such im.
provements would serve no useful purpose until such time as Fredericks Street
within the applicant's block has had at least 5056 of its lineal frontage im-
proved with curb, gutter and sidewalk, or until such time as a district is
formed for the installation of curb, gutter and sidewalk, whichever instance
happens first and that owners of said property described below will, at owners
cost and expense, install sidewalk along the street frontage of their property
on Fredericks Street, in accordance with the standards of the City of San Luis
Obispo in existence at the time said improvements are made.
2. Said land is described as follows:
Lot 9, Block D, Tract #64, 1616 Fredericks Street, Assessor's No.
52- 324 -09, R-1 zone.
Said owners hereby covenant and agree to comply with the requirements of the terms
of said resolution and that in the event they do not with due diligence so comply,
that the City of San Luis Obispo may install said improvements and make the cost
thereof a lien upon said property. It is further agreed that this covenant shall
run with and bind the land above described and all subsequent owners thereof, and
that this covenant runs in favor of the City of San Luis Obispo, a municipal
corporation.

corded try 26, 1959, in Volume 1002, Official Records, Page 292,
San Luis Obispo County, California, and the grantee consents to
recordation thereof.
