a municipal corporation, as Grantee, all of h s.- right, title, and interest
in the following described property in the City of San Luis Obispo, County
of San Luis Obispo, State of California, to wit:
That portion of the South half of Sec. 36, in Township 30, South
Range 12 East Mount Diablo Meridian, in the City of San Luis Obispo,
County of San Luis Obispo, State of California, according to the
official plat of survey of said land on file in the Bureau of Land
Management, described as follows:.
Beginning at corner No. 16 of the Goldtree Vineyard Tract recorded
September 30, 1893, in book 1. Page 14, of the Record of Surveys;
thence South 2° 371 East a distance of 1190.89 feet to a point on
the Southwesterly line of Johnson Avenue thence South 72° 001 East
along said southwesterly line a distance of 372.70 feet to the true
point of beginning; thence S 30° 411 West a distance of 8.20 feet to
a point, thence S72° 001 E a distance of 150.00 feet to a point,
thence N 30° 111 E a distance of 8.20 feet to a point thence N 72°

AGREEMENT
(Residential Land Subdividable Into Four or Less Lots)
THIS AGREEMENT, executed this day of �6��,�/,d�re' , 19d&, by and
between JOHN GAUSTAD, hereinafter called Grantor, and THE CITY OF SAN LUIS OBISPO,
a municipal corporation,.hereinafter called City, witnesseth:
1. Grantor shall convey .028 acres more or less, lying along Joy hhnns_on
Avenue to the City of San Luis Obispo.
2. City agrees to install curb, gutter., and sidewalk across the entire
frontage of the property and to conduct the normal grading that
would have been involved at the previous curb line on a standard
installation.
3. Parties agree that the value of the land being conveyed to the
City is $240.00 and that in event the cost of the improvements
set forth in Paragraph 2 exceed said value, then the owner will
pay said excess at the time of executing this agreement. Said
excess amount is $705.00; however, the City will give Grantor credit
in the amount of $240.00 for trees that will be lost in the new
drive area and credit for labor to be performed in the amount of
$465.00, leaving a net amount of no dollars to be paid to the City
at the time of executing this agreement. The labor to be performed
by Grantor consists of resetting mail boxes, relocate clothes line,
remove brick planter, fence, roses, sprinkler, and a portion of the
patio including the roof and brick floor to make a finished job,
also to construct the car port after the City pours the slab floor.
4. City will provide all necessary engineering, street work, legal work,
relocation of utilities, construction of concrete steps, and block
retaining wall, remove trees as necessary and construct a redrock
and oil driveway, slope the banks and finish them with top soil
in the front yard area and plant them with a suitable ground cover
such as ivy or ice plant in the front yard area, furnish and plant
four 15 gallon size trees behind the new sidewalk, remove existing
driveway, replace it with top soil, plant lawn seed, and furnish
the materials for the construction of a double carport per Gaustad
Widening Plan No. 8 -64.
5.. Grantor will execute a recordable covenant running with the land
for the benefit of the City, providing that upon any subsequent
subdivision the owner would reimburse the City for the improvement
costs.set forth in Paragraph 2 except an amount equal to the cost
of improvement of one normal residential frontage or that parcel
retained by the subdivider.
