Use caution when deciding to open attachments, click links, or respond. 2024 AB 1600 Development Impact Fee Annual Report Thanks for giving me an opportunity to review this report. I have the following questions and comments. I understand that the AB 1600 program cannot be used to fund infrastructure deficiencies. It can only be used to fund impact that can be attributed to new developments. I would like to make sure that the city is getting what is allowed under this legislation. I am looking forward to your responses and can you please include this email as public comment on this agenda item. 1. When does the city do the review of the estimated cost for the development impact fees? This is the report in which the city reviews all of the potential costs of new development on the city’s infrastructure. This report determines what will be needed as the result of new developments’ impacts on the city’s infrastructure. I suspect there are two di?erent reports in regards to AB 1600. One is the report that discusses the cost that can be attributed to new development and another is the annual report that discusses the approved fees. If this is true I would like to know when the city will be discussing the setting of the fees. Can you tell me when that will happen? I am not sure but I think it may be what is described on Page 2 as the Nexus Study. 2. In setting the city’s budgetary goals, Open Space acquisition and protection is always determined to be an important goal. I see that there was a Fund 502 Open Space Protection In Lieu program. And that this fund is discontinued. This is separate from the need for Open Space acquisition funded through the AB 1600 program. Is there an AB 1600 fee for acquisition of Open Space? Page 33 – The report indicates that the Open Space In Lieu fee was discontinued in 2018. Is there a new or di?erent fee that will fund Open Space acquisition? 3. The 2024 report seems to indicate that there is no fees that will need to be used in the 5 year window. But there appears to be some funds that will age at 5 years in the next year. Are there any funds that are at risk of being forfeited in the next year if not used? 4. On page 14 there is a discussion of a project that is funded but there is a problem with a landowner who is not willing to work with the city on a project. Where is that project and who is the landowner not willing to work with the city? 1 Is there a fall back plan to fund another project if this one cannot be done? 5. On Page 27 there is noted that there is a 2017 Water and Wastewater Capacity and Connection Fee Study that has identified projects that can be funded with AB 1600 revenues. Can you either send me (or tell me where I can find it) that study or tell me what those projects are? 6. Page 30- Police Impact Fee. The last time the fee structure was discussed by the council there was a discussion of a new police station. At that time the council decided to reduce this fee below the recommended amount as the council indicated that collecting all the fees allowed would a?ect the a?ordability of new housing. To me this meant that current residents would have to shoulder the real cost of this improvement. Is the any discussion of raising this fee to cover the total cost of this improvement which could be covered by the AB 1600 fee? I understand that AB 1600 fees cannot fund the entire project as it is can only fund the portion of the project attributed to new development. Thanks for your time. David Blakely 2
