SUBJECT: Street Abandonment - Consideration of abandonment of street right-of-way and
se1-1-ing city property at the east corner of Chorro and l,,Ialnut Streets.
CAO HECOMMENDATION:
Adopt resol-ution of intention to abandon street right-of-way and authorize staff to
have the surpl-us property appraised.
BACKGROUND:
The city acquired the subject right-of-way from the State of Cal-ifornia as a
re1-inquishment of excess right-of-way after construction of U.S. Highway 101-. The
city owns the subject right-of-way in fee.
The applicant is requesting the city to abandon right-of-way as shown on Exhibit A.
Because the city owns the property in fee, it must not only abandon the right-of-
way but also sel-l- it, according to procedures of state law for the disposal of
publ-ic property. The required finding for street abandonment is that the street
right-of-way in question is no longer needed for present or future public purposes.
The City Council must also find that the disposal of property owned in fee
by the city is consistent with the general p1-an. If the street right-of-way is
abandoned, it could be sol-d to the adjacent property owner.
The subject portion of right-of-way is not being used for street purposes. However,
there is an existing sewer line running diagonal-1-y across the rniddl-e of the right-
of-way from Walnut to Chorro Street. Easements would have to be reserved for the
publ-ic sewer if the street right-of-way is abandoned and sol-d. If the street
right-of-way becomes part of the adjacent property, l-t is the appl-icantrs intent to
redevel-op the property from the existing legal- non-conforming use as a plant nursery
to a multipl-e-farnily residential devel-opment which would be consistent with the
zoning. There are no known overhead or underground utilities within the subject
right-of-way. Frontage improvements are existing and are located in the proper
pl-ace to provide a continuous uniform street section on both Chorro and Walnut
Streets. The recently adopted Circulation Element of the general- plan does not
recommend any street widenings or intersection modifications in this vicinity
through the year 20L5, though this would not preclude the city from retaining this
right-of-way if it may be of publ-ic benefit.

ALTERNATIVES:

Adopt resol-ution of intention to abandon the subject street right-of-way and
set pubLic hearing for June L, L9B2 for consideration of street abandonment.
Authorize staff to have the surplus property (right-of-way to be abandoned)
appraised to determine its value.
Determine the subject street right-of-way is needed for present or future public
purposes and should not be abandoned. No further action would take place on
the abandonment request.
3, Continue the hearing on the abandonment request with specific direction to
staff and the applicant.
CITIZEN PARTICIPATION :
The Planning Commission reviewed the abandonment request at a publie hearing on
April 14, 1982 and on a 7-0 vote recommends the subject street right-of-way be
abandoned. In taking this actionn the connnission makes the following reconmen-
dations:
I A finding be made that the subject portion of Wal-nut and Chorro Streets
right-of-way is not needed for present or future publ-ic purpose and should
be abandoned.
A sewer easement be reserved as shown on Exhibit A to the approval of the
Public Services Department.
A finding be made that sale of the abandoned right-of-way (city property) is
consistent with the adopted general pJ-an.
The entire abandoned right-of-way be declared surplus city property and offered
for sale at fair market value to the adJoining property owner, who would have
first right of refusal.
If the adjacent property or^lner declines to purchase the offered abandoned
right-of-way, the city retain titl-e and the right-of-way not be abandoned.

CONCURRENCES:
The Public Services Department reconrnends the subject right-of-way not be abandoned
becairse it may be needed in the future by the State of California or the city for
street widening or unspecified intersection modifications.
FISCAL IMPACT:
Sale of surplus property wouLd bring the city additional- income. Planners
estimated va1ue is $5000. Note - The council may wish to consider charging the cost
of the appraisal to the purchaser.

RECOMMENDATIOItr:
Adopt the attached resoLution of intention to abandon the subject street right-of-
way for that portion of right-of-way is not needed for present or future pubLic
purposes and set a public hearing for June l-, 1-982 to consider final- abandonment.
Also authorize staff to have the surplus property appraised.
