SUBJECT Consideration of the Abandonment of Street Right-of-Way at the Easterly
Corner of Chorro artd Walnut Streets.
CAO RECOMMENDATION:
Continue abandonment and set for August 3, L982, public hearing until-
reciept of property appraisal and signed agreement by adjacent property
owners to purchase right-of-rn'ay are received.
BACKGROUND:
The City acquired the subject right-of-way in fee from the State of
California as a relinquishment of excess right-of-way aft'et construction of
U.S. Highway 101. !'Ie recommend that final action not take place untll
such time as the adjacent property owner has signed an agreement to acquire
the property at t,he appraised value. An appraiser has been secured,
subject to payment of a $275.00 fee by the applicant per Couneil direction.
The applicant was noti-fied of this fee on l,Iay 17 and lndicated he would
make payment the next day; however, we have not reeeived the payment to date.
The appraisal- would be cornpleted within two (2) weeks from date of authori-
zation to proceed. The abandonment and sale wil-l- besuo"ject Lo reservation
of an easement t.o maintain the present existing sanitary sewer as indicat,ed
in Resol-ution 4B1B (1982 Series).
ALTERNATIVES
Council resolve to abandon the right-of-way subject to acceptable
agreement between City and applicant for purchase by applicant.
Deterrnine that subject right-of-way is needed for present or future
public purposes and should not be abandoned. No further action would
take place on the abandonment request.
CITIZEN PARTICIPATION
Planning Commission reconmended abandonment and sale of this surplus areai
however, they further stated that abandonment should not take pJ-ace unless
the appl-icant agrees to purehase the right-of-way. The applicant
assumed that they owned this right-of-way and would l-lke to include this
area in a future development.
CONCURRENCE
Public Services Department continues to recommend denial of the abandonment
of this area; however, t,he Community Development DepartmenL concurs in the
abandonment. and sale of the property.
FISCAL IMPACT
Sale of the surplus property would bring the city additional- income if
purchased by the adjacent property ornner. The value of same is pending
the appraisal.
