BACKGBOUND:
At its meeting on August 7, 1979 the city council adopted ResolutionNo.3931 abandoning the portion of Garden Street between Hieh and
Broad Streets (see Exhibit A attached to the draft agreenent). Theeasterly half of the street reverted to the adjacent property owners
while the westerly half of the street becane city property. At the
same neeting the council by motion directed staff to prepare the
documents necessary to transfer the city property to the adjacentproperty owners,
At its meeting on November 20, 1979 the city council adopted
Resolution No. 4022 approving an agreement to convey a portion of thewesterly half of the street from the city to AIan R. MacMeekin, Susan
J. MacMeekin and Paul David Porter, the adjacent property owners. In
Novenber 1982 the approved conveyance was conpleted.
At its meeting on November 20, 797 9 the city council also adopted
Resolution No, 4027 approving an agreenent to convey a portion of the
westerly half of the street from the city to Mary Margaret Wagner,
the adjacent property owner, for $2,880.00. This approved conveyance
was never consummated, and the adjacent property owned by Ms. Wagner
was eventually sold to Aaron Corob.

FISCAL IMPACT

him to pay the city $3,500.00 for the property conveyed.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
AUTHORIZING THE CONVEYANCE OF CITY-OWNED PROPERTY
AT THE SOUTHEASTERLY CORNER OF BROAD AND HIGH STREETS
WHEREAS, the City of San Luls Obispo has determined that the portionof Garden Street between Broad and High Streets is no longer needed forpresent or future street uses; and
WHEREAS, the clty has abandoned the portion of Garden Street between
Broad and High Streets; and
WHEREAS, the abandoned portion of Garden Street still belonging to thecity was so small that it was unusable except by the adjacent property
owners; and
WHEREAS, the city has already sold part of the city-owned abandonedportion of Garden Street to adjacent property owners; and
WHEREAS, Aaron Corob has requested that the city sell to hin the
city-owned abandoned portion of Garden street adjacent to his property;
NOW THEREFORE
BE IT RES0LVED by the Council of the City of San Luis Obispo as
foLlows:
1. to declare surplus the city-owned property at the southeasterly cornerof Broad and High streets indicated as parcel 1 on Exhibit A of the
attached agreenent;
2. to approve the attached agreement between the City of San Luis 0bispo
and Aaron Corob to convey the city-owned property at the southeasterly
corner of Broad and High Streets;
3. to authorize the mayor to execute the agreement:
4. to direct the city clerk to furnish copies of this executed resolution
and the fully executed agreement to the city attorney, the public worksdirector and:

AGREEMENT
The City of San Luls Oblspo ("the Clty") and Aaron Corob ("Corob") agree
as follows:
1. The City shall convey to Corob 7,440 square feet of property, nore or
less, at the southeasterly corner of Broad and High Streets indicated as
parcel 1 on the attached Exhibit A.
2. Corob shall pay the City $3,500.00
3. According to the Cityrs subdlvision ordinance a parcel map shall be
recorded to show the new parcel.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
FINDING THAT A PORTION OF GARDEN STREET BETWEEN HIGH AND
BROAD STREETS IS NO LONGER NEEDED FOR STREET PURPOSES
AND ABANDONING SAME.
WHEREAS, the Planning Commission, after hearing, has determined that
this portion of street is no longer needed for street purposes; and
WHEREAS, ihis Council held a pub'lic hearing on August V,1979, ta
consider the abandonment of this portion of Garden Street as shown on the
map marked Exhibit "A," attached hereto and incorporated herein by
reference; and
WHEREAS, this Council finds that the described portion of Garden Street
between High and Broad Streets is not needed for present or future street
purposes;
N0l^l,'THEREFORE, BE IT RES0LVED by the Council of the City of San Luis
Obispo as follows:
SECTI0N l. That the portion of Garden Street between High and Broad
Streets as shown on Exhibit "A" attached, is hereby abandoned.
SECTI0N 2. That the City C'lerk shall cause a certified copy of this
Order of Abandonment, duly attested under the seal of the City, to be
recorded in the San Luis 0bispo County Recorder's 0ffice.

THIS AGREEMENT, execuLed this 20th d ay of November
L979, by and between MARY MARGARET I^IAGNER hereinaf ter called "I^IAGNER" and
the CITY 0F SAN LUIS OBISPO, a municipal corporation, hereinafter called
CITY, wi-tnesseth:
City shall convey to rrWagner" L440 square feet, more or
less, at the southeasterly corner of Broad and High Streets
indicated as Parcel 1 on the attached Exhibit A.
t'Wagner" agrees to const.ruct curb, gutter and sidewalk to
comply with the established setback for Broad Street if
and r^rhen Broad Street is ever widened. "lniagner" shall
sign a covenant to this effect.
"Wagner" shal1 pay the sum of two-tr :usand eight-hundred eighty($2,880.00) dollars to Ciry.
A parcel map shall be recorded to reflect the new parcel,
i-n accordance with the Cityrs subdivision ordinance.
