MUGM COUNCIL AGENDA REPORT U �: FROM: Nancy Knofler; Transit Manager Via: Paul Lanspery, CAO(4,,Vr\-- SUBJECT: Consideration of resolution approving purchase of.property adjacent to the Southern Pacific railroad depot. CAO RECOMMENDATION:. Adopt the resolution which approves the purchase of the property and authorizes the Mayor to execute all necessary documents. BACKGROUND: The City is currently working on a project (SLO Intermodal Facility Project) to improve the railroad.depot and the adjacent parking area. This project has two phases: Phase I -=the purchase of land from Southern Pacific and the preparation of plans for improving the area and the terminal, and Phase II --the construction of improvements.. -- r It is now time to purchase the property from the Southern Pacific Transportation Company. The City has an agreement with Caltrans to share the costs of the property purchase (State 50%, City 50%) and the appropriate City funds are budgeted for this fiscal year. Although it is apparent with the grant and the budgeted funds that the City intends to purchase the property, the City Attorney's Office has advised that an additional resolution be.approved by the Council. This resolution will specifically approve the property purchase and authorize the Mayor to execute all the necessary documents. The legal description of the property and the escrow documents are available in the Council office for review. The documents include the 7_• License Agreement. and an Assignment Agreement. The primary purpose of the License Agreement is to allow the City, or its designated contractor, to enter the depot in order to make improvements during the construction period. The Assignment Agreement will assign four leases to the City, three parking leases and one encroachment lease. Southern Pacific Transportation Company would like to close escrow this month. If the attached resolution is approved, the City will be able to meet this request. ALTERNATIVES ANALYSIS 1. Approve the resolution. This is the recommended alternative. The property will be purchased which will, in turn, allow the work on the SLO Intermodal. Project to continue. 1 2. Do not approve the resolution. This alternative is not recommended because the SLO Intermodal Project would cease.. A" Uy �,J� san A oBispo MOGS COUNCIL AGENDA REPORT CONCURRENCES The project's preliminary plans have been approved by the City, Caltrans, and Amtrak. Once Southern Pacific approves the preliminary plans, the final working drawings can be completed. FISCAL IMPACT City share for the property purchase will be approximately $250,000. The closing costs have not been finalized, but in no event will the costs exceed $250,000, which is the budgeted amount.
