A. RESOLUTION OF 'THE COUNCIL: OF THE .CITY OF SAN LUIS.
OBISPO,. CALIFORNIA; RELATING TO THE'ISSUANCE OF STREET.
INPROVEMENT BONDS PURSUANT TO RESOLUTION OF INTENTION.
NO'. 241 (NEW SERIES) DETERILTINING THE AMOUNT OF UNPAID-
ASSESSETNTS', PRESERIBING THE DENO11INATIONS' OF SUCH BONDS
AND PROVIDING FOR THEIR ISSUANCE..
AREAS', the City Council. of the City of San Luis Obispo
did, on the 26th day of September; 1927, pass and adopt its Resolu-
tion--'of Intention No.241 (New Series) relating to certain work to be
done in said City as therein described, under and pursuant to the
/provisions of the—"'Improvement Act of 1.911 ", as amended, and did by
said resolution of Intention provide that serial bonds to.represent
unpaid assessments, and bear interest at the rate of six per cent
(6 %) per annum; will be issued thereunder in the manner provided by
the "Improvement Bond Act of 1915" the last installment of which
bonds shall mature nine (9) years from the second day of July next
succeeding ten (10) months from their date,, reference to said Resolu-
tion of Intention being hereby expressly made for further particulars;
and
WF3REAS, the contract for -said work and improvement was duly
awarded and thereafter completed to the satisfaction of the Super-
intendent of Streets of said City and this Council, whereupon in.due
course an assessment, diagram and warrant were made, recorded and
delivered to the contractor in time, form and manner as required by
law, and the contractor or his assigns having made•due return thereon
and the same having been duly filed; and
AREAS, on the 27th day of July, 1928, the Street Super-
intendent of said City made and filed with the Clerk of this Council
a complete list of all assessments unpaid thereunder upon the res-
pective assessment or diagram numbers thereon, whereupon_ said Clerk
gave notice of the filing of said list, and fixed in said notice
Monday the 6th day of August, 1928, at the hour of 7::30 o'clock P.M.
of said day, at the regular meeting place of said City Council as
the. time. when interested persons: might appear before. the said City
Council and show-cause-why bonds.should'not be. issued upon these=
curi.ty of the. unpaid assessments shown on said list as appears from
affidavits: on file. in the office: of said Clerk;. and said City Council
having heard all objections against the, issuance of bonds: as afore-
said, 'presented before.or at the. time set for said hearing, and said
City Council hereby passing upon and overruling and denying the same,;
and
WREREAS, since said filing by said Street Superintendent
of. said. list -of assessments- unpaid, the following assessments- have:

the inter — section of the center line of Pacific Street with the center
line of Santa Rosa Street.
There is excepted from said work above mentioned,, any and all
such work already done to, official line and grade and there is excepted
therefrom any duplication of work at the same place due to the re— crossing
of linesin the foregoing description of work, or duplication of language,
it being the intention to describe only one improvement of the same class
at any one point;: and there, is further excepted 'therefrom,''' any work at
the inter - section of Brood Street with Pacific Street, and any work at

and specifications for the following work to be done and improvement to be
made in said City, to —wit:
That the hereinafter mentioned streets in said City, between the
lines.hexeinafter mentioned•, be improved as follows : -
That Monterey Street.between the Westerly line. of Toro Street
and the. Westerly line: of Ida Stre:et.be. improved by constructing in said
street a reinforced concrete box storm drain of the length, form; size and
dimensions and at the particular location to be -shoom on said plans; said
storm drain to be connected with the present culvert storm drain at the
intersection of Toro and Monterey Streets, and to be constructed with a
headwall at its northeasterly terminus, all as shown on said plans.

office of the City Clerk of said City of San Luis Obispo, and are hereby
referred to f.ox a full and detailed description of said work and improve-
ment and of the location at which the same is to be done..

shown on.the plans above mentioned,. and reference. is hereby made to
said plans and to the specifications above refe.rred to, for a further
description of the grades t.o which said work, is to be done.. All grades
between the grade points: as shown on said plans, shall be on a straight
line between said points -.. Any official-grades heretofore es-tablished are
hereby modified to conform to the changed "elevations as above recited.
Elevations are established according to.the heights in feet and
decimals of a foot above city datum,. which datum is the horizontal plane

California, at the next general election of said city to be held
on the first day of April, 1929; the following proposal for the
amendment of the Charter of said city, to wit:
Section 54 of Article IX.of the Charter of the.City of
San Luis Obispo is hereby amended so that the sane shall be and
read as follows:-
Seca 54. LIMIT OF TAX LEVY. The tax levy authorized
by the council for any one year for all municipal
purposes, other than for the payment.of principal or
interest on any bonds of the city, or for school
purposes, shall not exceed eighty -five cents on each
one hundred dollars worth of taxable property in said
city, except as herein provided. The council may,
however, in any year, by ordinance adopted not later
than the first TuesdEy in September, levy in addition
to the rate in-this section above authorized, a tax of
not to exceed fifteen cents on each one Hundred
dollars worth of taxable property in said city which
shall be collected at the same time and manner as
other taxes levied by said city, the proceeds of
which said tax shall belong and be paid to a fund
designated as the Improvement Fundof said city and
shall be expended only for .public improvements and
betterments in said city:
That the City Clerk be and she is hereby directed to publish
this resolution, together with the ayes and noes, in the Daily
Telegram, a daily newspaper printed, published and circulated in
said city, in the manner and form and for the time reouired by

WHERKAS, ordinance No, 135 (New Series).of. the City of San
Luis. Obbispo,. was an ordinance calling a. special. election, and submitting
to the qualified electors: of the City of San Luis Obispo, the proposition
of incurring a debt, and bonding said City for certain municipal improve -
ments.
AND SAS, said ordinance provided that the bonds to be
issued shoul'd.be payable in Gold Coin of the United States of America,
AND' WHMAS, they qualified electors of the City of San Luis
Obispo approved the,issuance. of said bonds.
AND WHERSAS, by Resolution No. 290 (New Series)'-, the City
Council. provided for the issuance of 825,000.00 principal amount of
