Cal Poly Recognized Locations Issued Use Permit Locations Campus-Recognized Sorority and Fraternity Transparency Act (AB 524) Each campus-recognized sorority or fraternity shall submit to the institution on or before July 1, 2023, and annually thereafter: •Number of active and new members •Average GPA of the membership and new members. •Number of community service hours completed. •Total amount of money fundraised. •Current recognition status and conduct status as determined by the institution. •Addresses of all chapter houses affiliated with the campus-recognized sorority or fraternity. •Location, date, and time of any sanctioned event. Campus-Recognized Sorority and Fraternity Transparency Act (AB 524) The institution of higher education (Cal Poly) is required to: •Suspended from campus recognition any campus-recognized sorority or fraternity that does not submit required information. •Compile and maintain all collected information into a publicly accessible report published online for ten years •Report must contain: •The number of citations, or disciplinary actions taken, relating to misconduct at a chapter house or sanctioned event. •The addresses of chapter houses and sanctioned events and names of sororities and fraternities where misconduct occurred. I explained the strategy used by fraternities with multiple addresses on one APN, and how they game the system by cycling through each address to have a zero- fine DAC issued before it requires SLOPD response and a potential citation with a fine. The parties are held outside in a central courtyard so essentially, this property will likely get four DACs before it ever moves to a citation. As predicted, the address at 1275 Stafford received another DAC by shifting the address from unit B to unit A of the house. A screenshot of the relevant portion of my Noise Report 10/25- 10/26/2024 is below: Regarding the “Negative Violation” at 1229 Fredericks/Hathway Alley for a car wash with loud music - noted as calls #15 and #16 - this property I called SLOPD for this at 12:58 pm and don’t know who called the second time. The car wash was blaring music, heard clearly inside our house, and guys were standing in the street on Fredericks and Kentucky holding signs, so people kept honking at them as they drove by. My husband was working nightshift and trying to sleep during the day because he had to leave for work at 7 p.m. for a 12-14 hour shift, and the noise made it impossible to rest. The noise ordinance is a 24/7 regulation. The exterior decibel limit prohibited during the day from 7 a.m. to 10 p.m. is only 5 decibels more than the noise level prohibited during nighttime from 10 p.m. to 7 a.m. During the day, noise with music or speech measuring 70 dBA is prohibited according to a “noise standard” table in SLOMC 9.12.060. (I can’t believe I know this stuff and wish I never had to look it up to understand but have done so because of over-the-top disruptive noise in our neighborhood since the Fall of 2021.) I took a screenshot of Phi Gamma Delta’s Instagram post advertising the carwash (below). It happened and unfortunately was not cited. 1 The proliferation of fraternity houses in our R-1 and R-2 neighborhoods, especially the Alta Vista and Monterey Heights neighborhoods which border Cal Poly, has increased dramatically over the past decade and has had a severely negative impact on the quality of life for the people who live there. Many long-term residents have been driven out of the neighborhood and sold their houses to get away from the problematic noise and other issues associated primarily with the illegal fraternity houses. Investors have bought those homes and they have become student rentals. Many are illegal fraternity houses or “satellite fraternity houses”, According to Cal Poly’s definition, “any house that has more than 50% of members from one chapter living there and/or anywhere that the fraternity/sorority wants to host an official chapter event.” (See attachment email from Elizabeth Aiello-Coppola, Assistant Director of Fraternity and Sorority Life at Cal Poly.) Below are some of the issues our neighborhoods have encountered as a direct result of the illegal fraternity houses: • Noisy parties with booming music and screaming people, especially on Thursday, Friday and Saturday nights from 8 p.m. - 2 a.m., and during the day on Saturday and Sunday. • Noisy drinking games involving a 4’ x 8’ table, including beer pong and various dice games including “Die is Life” and a game that makes a distinctive loud popping sound like a firecracker as the die is slammed against the table repeatedly for the duration of the game. The participants cheer loudly throughout the duration of these drinking games, which can last for hours. • Roving parades of college students traveling on foot throughout the neighborhood from one fraternity party to another fraternity party until early morning hours. They often yell at one another and randomly scream, especially late at night when they are intoxicated. • When students don’t walk to the parties, they generally call an Uber or Lyft which has caused a serious increase in traffic as a non-stop stream of rideshare drivers stop in the middle of the street with hazard lights flashing to drop off people at fraternities to “pre-game” before going to other parties or to stay at the fraternity to party; to pick up people leaving fraternity parties late at night; and to drop off fraternity members returning from other parties or bars downtown. At the later hours, guest s are often intoxicated and yell loudly while waiting for their ride or being dropped off, which wakes up neighboring residents. • Trash thrown in yards, especially empty beer cans, bottles and miniature bottles of hard liquor. • Vomiting and urination in residents’ yards. • Vandalism of property, including broken side mirrors on vehicles parked on the street, objects taken from yard or porches and thrown into the street, fence boards kicked in and broken, etc. • Screeching tires from vehicles peeling out at all hours, day and night. • Lack of parking due to the increased occupancy of many college students in single-family homes. San Luis Obispo’s municipal code defines fraternities as residences that have gatherings or meetings associated with a fraternity but does not classify a “satellite fraternity house” as associated with the occupancy of greater than 50% of fraternity members, like Cal Poly does. Still, using the SLOMC definition of a fraternity, there are over 50 recognized fraternity houses that are illegally situated in our R -1 and R-2 neighborhoods. Zoning for Fraternities in General It is well-established that fraternities are a unique classification of housing that have an adverse effect on neighboring properties due to noise, increased traffic, and other issues, therefore cities have specific zoning regulations associated with their placement in a community. Courts have repeatedly upheld zoning regulations that prohibit fraternities in residential neighborhoods. “The facts of life dictate that there is a vast difference between a boarding house or lodging house and a fraternity house... The city council apparently was fully a ware that college spirit contemplates frequent 2 gatherings with attendant boisterous conduct on occasions. The rush parties, the dances, the rallies and other manifestations of the collegiate spirit are present in a fraternity house and frequently absent in a boarding house, a lodging house or an apartment.” in City of Long Beach v. California Lambda Chapter of Sigma Alpha Epsilon Fraternity “Where that is possible in situations closest to those here involved, as, for example, college fraternities and sororities, such uses have generally been successfully barred from residential districts in college towns, on the basis that the frequently boisterous and overexuberant conduct of their members clashes with the general peace and good order usual and expected in such zones” in Kirch Holding Co. v. Borough of Manasquan “The court, with an apparent low regard for the conduct of students living in a fraternity house, pointed out that many attributes of the lifestyle in a fraternity house were absent in a permitted boarding house, lodging house or apartment.” in Town of Los Altos Hills v. Adobe Creek Properties “College students in general, and fraternity members in particular "are for the most part exuberant... do not ordinarily keep regular hours and are addicted to the use and abuse of vibrant and sonorous musical instruments.” in Pettis v. Alpha Alpha Chapter of Phi Beta Pi There is no doubt that fraternities present a host of problems to neighboring properties, including parties with loud music and screaming into the early morning hours. To mitigate these issues, San Luis Obispo Municipal Code 17.86.130 specifically addresses Fraternities and Sororities as defined in Chapter 17.156 (Land Use Definitions) and where permitted in Chapter 17.10 (Use Regulations). San Luis Obispo Municipal Code 17.86.130 (Fraternities and Sororities), Chapter 17.156 (Land Use Definitions), and Chapter 17.150 (Use Regulations) “This section is intended to promote the quality of life in residential neighborhoods by ensuring that dwelling units housing multiple persons who are members of a fraternity or sorority provide adequate support facilities for the intensity of associated use, and that such uses are operated in a manner that is not detrimental to the neighborhood in which they are located due to excessive noise, inadequate off-street parking, general property maintenance, and similar conditions.” (SLOMC 17.86.130 A.) To mitigate the issues related to fraternities, San Luis Obispo’s zoning regulations restrict fraternity houses to R - 3 and R-4 zones and require them to obtain a conditional use permit, which sets forth terms of operation. The terms of the conditional use permits define a multitude of requirements to ensure that the fraternity does not adversely affect the neighborhood. Conditional Use Permits in General The purpose of a conditional use permit is to enable a municipality to control certain uses which could have detrimental effects on the community1. The permit consents to a use not allowed by-right in a particular zone and is approved under a set of terms and conditions. 1 Neighborhood Action Group v. County of Calaveras (1984) 156 Cal. App. 3d 1177 at 1184. 3 Conditional Use Permits for Cal Poly Fraternities In response to a public records request for all the conditional use permits for fraternities in the city of San Luis Obispo, the City Clerk produced only seven conditional use permits, although there are 18 Cal Poly fraternities recognized by the Interfraternity Council. The use permits provided were for the following fraternities and addresses: 1. Sigma Nu 1304 Foothill & 190 Crandall2 U 1484-90 2. Alpha Epsilon Pi 280 California U 1099 3. Phi Kappa Psi 1335 Foothill U 47-10 4. Delta Upsilon 720 Foothill U 36-09 5. Delta Chi 1236 Monte Vista U 106-98 6. Lambda Chi Alpha 1292 Foothill3 U 174-97 7. Alpha Gamma Rho 132 California U 144-97 (See Attachment: Use Permits for Cal Polly Fraternities ) The terms of the use permits include, among other things: • Maximum occupancy of residents at the fraternity house; • Maximum number of persons allowed on site for routine meetings and gatherings; • Prohibition of parties or other types of similar activities between the hours of 10 p.m. and 9 a.m.; • Prohibition of using open space on the premises as a gathering area; • Requiring a neighborhood relations plan with information provided about upcoming events at the house. It is clear from the noise complaints documented by the San Luis Obispo Police Department dispatch log, that the fraternities with conditional use permits have repeatedly violated the terms of those permits without consequences to their permits. For example, Sigma Nu’s conditional use permit at 1304 Foothill limits occupancy of the site to 19 residents. Fraternity activities are limited to meetings and gatherings with 19 or fewer fraternity members and guests. “No meetings or other gatherings involving persons other than fraternity members living on this site are allowed between the hours of 10 p.m. and 9 a.m.” Amplified sound equipment is not allowed at the fraternity house. “No hosted Greek events on the site shall be allowed (i.e., TG' s, rush events, little sisters, etc.).” The only gathering allowed is “One parents' barbecue and one alumni barbecue may be held at the site each year. Not more than 38 persons may be present at either event, including fraternity members.” However, Sigma Nu regularly has large noisy parties at 1304 Foothill that extend into the front yard and sidewalk. Since January 2022, they have received three noise citations. On 10/27/2022, they received a citation for an “unruly gathering”. Sigma Nu also has several illegal fraternity houses in R-1 and R-2 neighborhoods including at 301 Hathway, 250 Grand Ave, 1621 McCollum and 290 Chaplin. The location at 301 Hathway is especially disruptive and has received ten citations in the past three years! 2 190 Crandall is currently occupied by Kappa Sigma 3 1292 Foothill is occupied by Sigma Nu. Lambda Chi Alpha operates at 1264 Foothill (among many other addresses) 4 Another fraternity, Alpha Sigma Pi, has a use permit at 280 California that limits occupancy to 19 persons including the resident manager. The terms of their permit state “No meetings, parties or other types of activities involving persons other than residents living on the site shall be allowed between the hours of 10:00 p.m. and 9:00 a.m.” But Alpha Sigma Pi regularly has large parties including a loud party last month (October 2023) with at least 150 party guests that spilled into the road behind the fraternity house on Hathway Avenue. Since October 2022, they have received at least five noise citations for loud parties after 10:00 p.m. or during the morning of the St. Fratty’s Day neighborhood takeover. They also have a non-permitted fraternity house next door to their main house at 331 Hathway, which has been cited for noisy parties four times just this year in 2023. Phi Kappa Psi at 1335 Foothill has had five noise citations for loud parties since June 2022, even though their use permit states “No meetings, parties, or other types of fraternal activities that would exceed the residential occupancy of persons (11) may take place between the hours of 10 p.m. and 7 a.m." Delta Upsilon at 720 Foothill has had five noise citations for loud parties since June 2022. Their use permit states that a maximum of 21 persons are allowed on site for routine meetings and gatherings, and “No meetings, parties, or other types of similar activities that would violate City Noise Ordinances, or that would exceed the maximum 21 pe rsons provision between the hours of 10 p.m. and 9 a.m.” Delta Chi at 1236 Monte Vista has had five noise citations for noisy parties since November 2021. Their use permit states “#5. No meetings, parties, or other types of similar activities involving persons other than residents are allowed between the hours of 10 p.m. and 9 a.m.” Also, “#7. Events, including meetings or parties on site, shall be limited to those listed on a meeting and activities schedule submitted to and approved by the Community Development Director in the fall of each year.” Lambda Chi Alpha operates at 1264 Foothill. On Friday 10/27/2023, they had an enormous out -of-control party during “Halloweekend” (Cal Poly’s annual three-night celebration on the Thursday, Friday and Saturday closest to Halloween) with several hundred college students. A SLOPD officer requested backup to help shut down the party. Several police units and bicycle officers arrived on scene as the college students streamed from the property onto the sidewalk and street. The party was NOT CITED and there is no indication in the SLOPD dispatch log that there was a “noisy party” so there is no record of the occurrence, except for the entry in the SLOPD dispatch log for “Assistance Requested”. The clearance code says, “No Report”. 5 Alpha Gamma Rho at 132 California was suspended from Cal Poly for repeated violations of their alcohol policy and other violations, therefore their use permit “shall be revoked” by the city, according to SLOMC If no action is taken to hold fraternities responsible for the terms of their conditional use permits, the bad behavior continues without abatement. To complicate matters, most Cal Poly fraternities do not have use permits and are operating anyway to the detriment of their neighbors. Assembly Bill 524: The Campus-Recognized Sorority and Fraternity Transparency Act Assembly Bill 524 went into effect in 2023 and requires that California colleges and universities publish online, a publicly accessible database that includes a wide variety of aspects of their fraternities and sororities including the location, date and time of any sanctioned event off campus during the previous academic year. The deadline for posting the information online is October 1, 2023. Cal Poly SLO posted the information online which led to the discovery of the addresses of fraternities in San Luis Obispo. Most of the addresses were already known through the various fraternity's social media posts, advertising their rush activities at specific addresses. However, the information provided by Cal Poly on their website verifies the fraternity house locations within San Luis Obispo, and that they held “sanctioned events” at those addresses. This meets the definition of a fraternity according to the SLOMC Land Use Definition (Chapter 17.156) as a “Residence for college or university students who are members of a social or educational association that is affiliated and in good standing with the California Polytechnic State University and where such an association also holds meetings or gatherings.” Fraternities are Premised (No Warning List) Fraternities in San Luis Obispo are automatically premised with the San Luis Obispo Police Department, which means they are not eligible for a warning or Disturbance Advisory Card (DAC). If there is a noise complaint for a noisy party at a fraternity, a police officer responds and if the noise is verified, a citation is written which includes a fine. This policy was implemented to hold fraternities accountable for their impact on neighboring property as outlined in their use permit. If a fraternity is not on the Premised List and a noise complaint is made to SLOPD between 7:30 p.m. – 2:30 a.m., a SNAP (Student Neighborhood Assistance Program) officer is dispatched. A SNAP officer is a Cal Poly student and does not have the ability to issue a citation but can issue a DAC at their discretion. By not being included on the Premised List, a fraternity is able to escape accountability and receive a DAC inst ead of a citation. SLOPD released their Premised List of fraternities and sororities with their addresses. There are seven fraternities listed on their Premised List. Foothill) Beta Theta Pi at 1327 E. Foothill does not appear on the Premised List provided by SLOPD. However, a posting on the SLOPD dispatch log shows that it is Premised because the name of the fraternity appears on the log and “NOISE POLICE” is noted in the upper left corner. If it were not premised, the notation would say “Noise Party” and SNAP would respond. Below is an example of Sigma Pi fraternity, which is in an R-3 zone at 124 Stenner but is not on the SLOPD Premised List. They had a party on 9/22/2023 at 124 Stenner with 100 people. But since they are not on the Premised List, the call is listed as “Noise Party” instead of “NOISE POLICE” and a SNAP officer was dispatched, listed as “P1”. The large, noisy party was issued a Disturbance Advisory Card for a fraternity party with 100 people instead of a citation. It is also notable that the Sigma Pi fraternity has occupied 124 Stenner for several years and has a history of noise complaints to SLOPD yet is not held accountable under the terms of a conditional use permit because they do not have one. 7 There are several fraternities in R-3 and R-4 zones which could be eligible for a conditional use permit but do not have them and therefore, are not included in the Premised List. They are unfairly eligible for a DAC instead of a citation, and do not have terms and conditions listed in a use permit. For example, as mentioned earlier, SLOPD responded to Lambda Chi Alpha at 1264 Foothill to shut down a large party. The dispatch log does not indicate that the address is for the fraternity Lambda Chi Alpha even though it is obviously a fraternity house with their Greek letters mounted prominently on the front of their house because Lambda Chi Alpha is not on the Premised List. Below are fraternities in R-3 and R-4 zones that do not have use permits, according to records received from the City Clerk. Beta Theta Pi 1327 E. Foothill The policy behind the Premised List is to hold fraternities accountable for their impact of noisy parties. When they are not included on the Premised List, they are issued a Disturbance Advisory Card (DAC) instead of a citation and are not held responsible for the noisy party. All fraternities should appear as Premised in SLOPD dispatch records. 4 Lambda Chi Alpha has a use permit for 1292 Foothill but there is no record of a use permit for 1264 Foothill 5 740 W. Foothill is the former bar and restaurant called This Old House. It may be located in the County of San Luis Obispo 8 Party Registration San Luis Obispo implemented a Party Registration program in 2017 which became permanent in 2018. The program allows students and residents to register parties with the San Luis Obispo Police Department to avoid party-related noise fines. If a resident calls the police with a noise complaint for a registered party, police will call the host and allow 20 minutes for the noise to settle down before any fine is given. The program is designed to help students avoid fines for noise complaints. (See Attachment: The Mustang Daily, “How students can avoid party-related fines with permanent city-wide program”, 10/3/2018) Another issue related to the Party Registration program is that fraternities are allowed to register their parties with the SLOPD for parties that last up until 2 a.m. This policy conflicts with the fraternity's use permits which do not allow meetings, parties or other types of activities involving persons other than the residents after 10:00 p.m. It encourages and allows a fraternity to violate the terms of their use permit, which does not make sense because it is inconsistent with the city’s regulations. Somehow, the overall regulation of fraternities through their use permits was overlooked when the Party Registration program was enacted. According to a fraternity’s use permit, failure to comply with any of the conditions of the use permit, or code requirements such as noise violations, is prohibited and could be grounds for revocation of the use permit. Here is a recent example: On 10/28/2023, the Sigma Nu fraternity at 1304 Foothill had a large party with blaring music heard from a block away and party guests in the house and yard. At 9:35 p.m. a complaint was made to SLOPD for a loud party at 1304 Foothill but since Sigma Nu was allowed to register their party, there was no police response, and they were not cited. The call for a noisy party does not show on the SLOPD records, which otherwise lists residents’ calls to SLOPD for noisy parties. Meanwhile, Sigma Nu’s use permit for 1304 Foothill states: • Occupancy of the site is limited to 19 residents. • The fraternity use is to be confined to the house only. The permit is for residential use only. Fraternity activities conducted from the fraternity house shall be limited to meetings of the executive council and other meetings and gatherings involving 19 or fewer fraternity members and guests. • No meetings or other gatherings involving persons other than fraternity members living on this site are allowed between the hours of 10 p.m. and 9 a.m. • No events involving the use of amplified sound equipment shall be allowed. • No hosted Greek events on the site shall be allowed ( i.e., TG' s, rush events, little sisters, etc.). One parents' barbecue and one alumni barbecue may be held at the site each year. Not more than 38 persons may be present at either event, including fraternity members. 9 Fraternities are bound by the terms of their use permits. The Party Registration allows fraternities to violate the terms of their use permits, which goes against the regulations enacted by the planning commission and/or city council, when they approved th e terms of the fraternity's use permits. Therefore, the Party Registration program should be modified to remove fraternities from the program and allow them to operate consistent with their use permits. Another issue related to the Party Registration program is that a noise complaint call does not show up on the SLOPD dispatch log as a “noisy party” if a complaint comes in and the party is registered. For example, a public records request was made to SLOPD for all noise complaints for certain addresses and SLOPD provided a list associated with each address. The list does not include complaints for noisy parties that were “registered parties”. It is impossible to ascertain the exact number of complaints made for each address because if the party was registered, it does not show up on the SLOPD log as a complaint when a resident calls to complain about the noise. Here is a recent example: Theta Chi has a fraternity house at 191 Kentucky. They registered a party at that address on 10/28/2023. A resident called SLOPD dispatch at 11:08 pm to complain about a loud party at 191 Kentucky. No officer responded because it was a registered party and was cleared as “No Report”. Forty minutes later, at 11:46 pm, a resident called SLOPD to report a loud party at 191 Kentucky. An officer responded at 12:02 pm and cleared the call at 12:11 pm with a negative violation. The dispatch log from SLOPD for 191 Kentucky shows the second call on 10/28/2023 at 11:46 pm but the first call at 11:08 pm does not appear on the printout because it was a “registered party”. Essentially, if someone registers their party and a resident calls to complain about the noise, that call is not included in the permanent records for “noisy parties” by SLOPD. This does not give an accurate record of noisy 10 parties in our neighborhoods. Fraternities are the primary offenders of noisy parties and there should be a record of each noise complaint for each address regardless of whether the party is registered. Cal Poly SLO Transitioning to Year-Round Classes Beginning Fall 2024 The only reprieve from the noisy and disruptive fraternity houses in our neighborhoods has been during summer break and Christmas break, when most students return to their hometowns and fraternities cease operations. This is evident by looking at the SLOPD response to noisy party calls. The calls typically begin at the start of the academic year in September and slow down significantly when summer begins, and the students return to their hometowns in June. However, Cal Poly announced they are increasing enrollment and will mitigate the impact of more students in the community by having students attend classes year-round. Presumably, year-round operations of regular classes with a fully enrolled student body will cause noisy parties to occur year-round. The warmer weather in summer and longer days will likely contribute to increased parties during this time. Therefore, it is imperative that a solution is found to address the fraternity noise in our neighborhoods and illegal fraternity houses in R-1 and R-2 neighborhoods must be eliminated. “St. Fratty’s Day” and “Halloweekend” Most fraternities at Cal Poly are in the Alta Vista neighborhood. Historically, there have been some annual events that have been extremely problematic for the neighborhood because they are hijacked by fraternities for a reason to party. Thousands of students converge into the neighborhood, with fraternity parties at the hub of the disturbances. Poly Royal and Mardi Gras are examples of events that led to riots in the neighborhood and were ultimately canceled by the city of San Luis Obispo and/or Cal Poly. In 2009, the fraternity house at 348 Hathway had a party that began the tradition of “St. Fratty’s Day” which has a St. Patrick’s Day theme but is a stand-alone event held outside the safety enhancement zone period of St. Patrick’s Day. St. Fratty’s Day takes place on the Saturday before winter finals at Cal Poly, whereas St. Patrick’s Day is always on March 17. Since 2009, St. Fratty’s Day has gained traction and has become a complete neighborhood takeover that begins at 4:17 am, with fireworks being set off, thousands of students blocking the streets around Hathway, Bond, Fredericks and Kentucky. Music blares from the fraternity houses, people are on rooftops and yards, openly drinking, chanting and screaming for hours. SLOPD has been overwhelmed by the sheer volume of people and generally stand on the outskirts of the party until it fizzles out at around 10:00 am, six hours after it began. On Saturday night, the fraternity parties start up again into the early morning hours. “Halloweekend” is a three-night party nearest Halloween, on Thursday, Friday and Saturday nights. It is centered around fraternity parties in the Monterey Heights and Alta Vista neighborhoods (mostly Alta Vista). Parades of students travel from one fraternity party to the next, screaming while they walk down the sidewalks and in the middle of the streets. The noise starts at about 7:00 pm and lasts until 2:00 am or later. During “Halloweekend” this year, SLOPD leadership said they added four officers to patrol the neighborhood to address the loud parties. However, there were many, many parties that were listed on the SLOPD log as “Negative Violation” even though video documentation shows a loud party was taking place. Most calls were handled by Cal Poly student SNAP officers. On one occasion, two SNAP officers were standing in the middle of Albert Drive attempting to cite a party and were surrounded by fraternity guys who we re intimidating and 11 arguing with them. In other instances, SNAP officers shut down obviously loud parties that were called in, such as a Sigma Nu fraternity party at 290 Chaplin with hundreds of college students, and they did not cite the party. An inquiry was made to SLOPD leadership on 11/1/2023 about the discrepancy between the lack of citations versus video documentation of parties during the weekend, with a list of specific addresses. SLOPD Chief Rick Scott responded that his staff is “still in the process of collecting data and reviewing the events” and he would get back when information was available. As of one week later, 11/7/2023, there has been no response to the questions. Both “St. Fratty’s Day” and “Halloweekend” events are listed in the spreadsheets provided online by Cal Poly, as required under the Transparency Act, as “sanctioned events” for numerous fraternities in the R-1 and R-2 neighborhoods. In some cases, fraternities do not list the events on the spreadsheet, but there are videos posted online that show fraternities in the neighborhood having parties anyway. One aspect of these fraternity events that is intolerable is the constant screaming of college students throughout the night while they walk from fraternity party to fraternity party. If fraternities were no longer allowed to operate in R-1 and R-2 neighborhoods, it would significantly decrease the disruption of the “St. Fratty’s Day” and “Halloweekend” because those events are centered around the fraternity parties being hosted by fraternities in the neighborhood. It would also decrease other loud disruptive parties that take place in the neighborhood throughout the academic year. Overall, there is a general complacency associated with enforcement of noise violations in the neighborhoods near Cal Poly, which are primarily held by fraternities. It is reminiscent of the boiling frog syndrome which is a metaphor for the inability or unwillingness of people to react or to be aware of threats that arise gradually rather than suddenly. If the fraternities and their associated problems with loud parties and other disruptions, were present in the Sinsheimer neighborhood, or San Luis Drive, or Ferini Heights, they would not be tolerated. Unfortunately, it was allowed to happen, as shown in this report, and it has increased exponentially over the past decade. It has changed the fabric of the neighborhood to such an extent that permanent residen ts have had to move away because they can no longer handle the problems, which is a travesty. Now, fraternity houses are beginning to pop up in other neighborhoods further from the Cal Poly campus as enrollment increases, so will the illegal fraternity houses. Proposed Solutions Remove fraternities from R -1 and R-2 neighborhoods. o Contact property owners for each of the fraternities operating in R -1 and R-2 neighborhoods and require that they cease operations. o Monitor noise complaints and social media to ensure that they do not continue to operate illegally. o If fraternities continue to operate illegally, issue a Notice of Violation with fines. 12 Communicate with Cal Poly regarding SLOMC and Zoning Regulations. • Contact Cal Poly leadership, including Greek Life, and explain that fraternities and sororities are only allowed to operate within R-3 and R-4 zones in San Luis Obispo. • Explain that each fraternity and sorority is required to have a conditional use permit to operate within San Luis Obispo. • Cal Poly should explore the idea of creating a Greek Row on Cal Poly’s campus. In 2013, this idea was contemplated when new regulations for Greek organizations were adopted by Cal Poly following numerous alcohol-related incidences that led to the death of two (fraternity) students and the suspension or elimination of several chapters from the campus. The idea was never followed through but would be an excellent solution. o It would provide the opportunity for many, many students in fraternities and sororities to live on campus in their Greek organization. o It would lessen the impact of fraternity parties and other disruptions in our residential neighborhoods. o It would ease the burden on SLOPD for responding to hundreds of fraternity parties each year, saving money for the city of San Luis Obispo 6. Require use permits for every fraternity house that hosts meetings, gatherings or other events, according to the SLOMC and Land Use Regulations. Define “satellite fraternity house” consistent with Cal Poly’s definition, according to the occupancy of fraternity members. • Obtain the list of satellite fraternity houses from Cal Poly, which they have in their records. • Require satellite fraternity houses (that do not host meetings, gatherings, events) be on the premised list to hold them accountable for the impacts of a fraternity house. Implement a “zero-tolerance” zone in the Alta Vista and Monterey Heights neighborhoods to stabilize them from the damaging environment that has evolved. • The SLOMC noise ordinance would be strictly enforced within a ¼ mile by 1 mile area of the Alta Vista and Monterey Heights neighborhoods. • Limit the program to a certain amount of time (such as 12-18 months) to mitigate the damage that has caused the excessive noise and parties to become common in the neighborhood, without consistent enforcement. 6 SLOPD staffing for St. Fratty’s Day 2023 cost the city of San Luis Obispo hundreds of thousands of dollars. 13 Hire Civilian Police Technicians trained in PC 832a non-lethal force to respond to noise calls within the heavily impacted Alta Vista and Monterey Heights neighborhoods. • In the past, the then-SLOPD Chief said it was too dangerous for non-sworn police personnel to be responding to large parties. However, current policy sends Cal Poly student SNAP officers to those same parties. They have been witnessed not citing obvious parties and being intimidated by fraternity members. A non-peer should be responding to the large fraternity parties in the neighborhoods. Implement a threshold of noise violations within a certain duration for a fraternity’s use permit which triggers an automatic review. Implement a “Chronic Party House Program” such as that used in San Diego which aims to curb nuisance behavior at chronic party houses. • Chronic Party Houses - Community Assisted Party Program (CAPP). A house is CAPP’d for several reasons including: o Two responses for noise within 60 calendar days o A minor in possession of alcohol citation is issued at a party o A social host violation is issued at a party o A violent crime is committed at a party or resulting from a party • If a residence receives a CAPP designation: o Officers will show zero tolerance when responding to all future party calls o All responsible parties will receive an Administrative Citation for any valid follow-up noise complaints. o An Administrative Citation is a $1,000 fine o Administrative Citations are not reserved solely for a CAPP -designated house and may be issued at the discretion of the responding officer(s). Factors may include history of similar incidents at the location, cooperation/attitude of party hosts and guests, severity of the noise relative to time of day, ambient noise, proximity to neighbors, etc. and use of alcohol and ease of its access. • If a house is CAPP'd, it will remain on the CAPP list for 1 year, regardless of occupant changes. Any inspection shall be at a reasonable time and shall be preceded by a twenty -four-hour notice to the residents. 2.The maximum number of persons allowed on site for routine meetings and gatherings shall not exceed the limit established by the applicable conditional use permit. 3.The fraternity or sorority shall remain affiliated and in good standing with the Interfraternity Council of Student Life and Leadership at California Polytechnic University, San Luis Obispo. If the fraternity or sorority becomes unaffiliated or no longer held in good standing with California Polytechnic University, the conditional use permit shall be revoked. 4.The landlord shall provide names and telephone numbers of responsible persons to the community development department and SLOPD neighborhood services manager on an annual basis.
