The question is below with staff’s response shown in italics: 1) Why doesn’t the draft ordinance amending section 8.04.070 describe the new 5-year or $50,000 limits (whichever comes first) for setting a hearing on delinquent fees? I see this is in the agreement, but does this change need to be notated in the ordinance? The proposed municipal code change would make collecting delinquent solid waste accounts less frequent, which is currently identified as an annual process. Meanwhile, the franchise agreement would set stricter limits, requiring collection every five years or when overdue amounts exceed $50,000. Keeping the franchise agreement stricter ensures that future adjustments to the timeline or dollar threshold could be done during future franchise agreement amendments processes, such as amendments directed by state law, and would not require also changing the municipal code.
