A RESOLUTION OF THE COUNCIL OF THE CITY
OF SAN LUIS OBISPO ESTABLISHING INTERIM
STANDARDS AND PROCEDURES FOR DETERMINING
THE APPLICABILITY OF THE PROHIBITIONS OF
URGENCY ORDINANCE NO. 575 TO PARTICULAR
PROJECTS.
WHEREAS, Urgency Ordinance No. 575 prohibits for a four -month period all
construction of new structures and all grading work in flooded and flood -prone
areas and within twenty (20) feet of top of the banks of all waterways pending
a review by the City of dangers involved in permitting construction work in
such areas and a determination as to whether or not new zoning regulations are
required in such areas; and
WHEREAS, some proposed development projects were in such an advanced
planning stage when said Urgency Ordinance No. 575 was adopted on February 9, 1973,
that the prohibitions of said Ordinance will actually interfere with the developer's
planned construction schedule; and
WHEREAS, said Urgency Ordinance was not intended or designed to halt
development projects in said areas which can be shown to be in no danger of
flooding or of being damaged by erosion caused from storms of the magnitude of
January 18, 1973; and
WHEREAS, it appears necessary to establish standards and procedures for the
guidance of developers and City officials and staff in determining the
applicability of the prohibitions of said Ordinance No. 575 to particular
projects.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo
as follows:
1. The prohibitions of Section 1 of Urgency Ordinance No. 575 against
construction and grading within areas which actually flooded during the storm
of January 18, 1973, as set forth in the shaded areas upon Exhibit "A" Map
attached to said Ordinance, shall not apply in the following situations:
a. When either the City Engineer or the Director of Planning
certifies in writing that there were no flood waters on January 18, 1973,
within the area of any proposed grading or construction.
For the purpose of this paragraph, flood waters shall mean
waters which originated upon real property other than the property
containing the proposed grading or construction site, and which
flowed upon or across any portion of said site with a sufficient
depth, width and current flow to be readily ascertainable as coming
from offsite sources.

2. The prohibitions of Section 2 of Urgency Ordinance No. 575 against
construction and grading within twenty (20) feet of top of the banks of any
waterway, as forth upon Exhibit "B" Map attached to said Ordinance, shall
not apply if both of the following situations exist:
a. When either the City Engineer or the Director of Planning
certifies in writing (1) that the character of the water flow in the
particular waterway during the flood of January 18, 1973, was not so
erosive as to endanger the permanence and stability of the creek bed or
banks within a distance of one hundred and fifty (150) feet upstream
or downstream from the proposed construction site, and (2) that drainage
structures in the vicinity, if plugged or overtaxed, would not cause
the property to be flooded.
b. When, in judgement of the Planning Commission, the setback
proposed by the builder would not detrimentally affect the City's
ability.(1) to correct flood problems along said waterway, and (2) to
regulate future development along the waterway in a manner which will
protect the public health, safety and welfare.
3. This resolution and the procedures and standards set forth herein
shall be applicable only to the prohibitions in Urgency Ordinance No. 575 and
shall be of no force and effect after June 9, 1973.

THE CREEK CHANNELS IN THE UNINCOFcPORATED AREAS
SURROUNI -jING SAID CITY.
WHEREAS, debris in the creek channels ;venerated both within and without the City
limits clogged bridges and drainage structures and interfered with the free flow of water
runoff during the storm of January 18, 1973, thereby aggravating the flood situation and
resultant damage; and
WHEREAS, the watershed within which the City is situated contains property equal
to 3097 of the assessed value of all property within the County, and two- thirds of said
percentage is located within the City of San Luis Obispo; and
WHEREAS, the City has discussed with the County the possibility of forming a
special taxing zone within the County Flood Control District which would provide funds
for the cleanup of creek channels within the whole of said watershed, but said zone would
be unable to provide funds for said purpose before November, 1974; and
WHEREAS, the City with City funds conducts an annual creek maintenance program
and has made an even more extensive cleanup effort since said January 18, 1973 to remove
debris from the creek channels within the City; and
WHEREAS, a considerable quantity of flood debris exists in the creel; channels in
the unincorporated area above the City, and said debris could again clog drainage structures
above and within the City in the event of further major storms and cause flooding in the
City of San. Luis Obispo;
NOVI, THEREFORE, BE IT RESOLVEL by the Council of the City of San Luis
Obispo as follows:
1. The Board of Supervisors of the County of San Luis Obispo is .hereby requested to
immediately re- examine the County budget and to appropriate the necessary monies from
the County general funds or other available funds to accomplish the removal of debris
from the creek channels in the unincorporated areas above the City of San Luis Obispo.
2. The Board of Supervisors is requested to commence this debris clearance
work immediately.

1. The California Division of Highways is hereby requested to take corrective
action to eliminate the flood hazards presently created by the following State Highway
drainage structures which were wholly or partially responsible for flooding certain
Portions of the City of San Luis Obispo during the storm of January 18, 1973:
a. The bridge over San Luis Creel: which connects. Marsh
Street to Highway 101;
b. The Prefumo Creek drainage structures under Highway
101 and the Los Osos Road off - rarnp; and
c. The drainage structure under Highway 101 at Stenner Creel;.
2. It is requested that said hazards be eliminated before the fall of 1973 to
safeguard the City and its residents from flooding in any future rainy season.

1. The Council of the City of San Luis Obispo hereby forwards to the Board of
Supervisors of the County of San Luis Obispo copies of Urgency Ordinances No. 575 and
576 which have been adopted by the City to safeguard persons and property in the event
of future severe flooding. Ordinance 575 prohibits all construction and grading in flood -
prone areas and within twenty (20) feet of the cranks of all waterways until the City can
determine whether or not additional zoning controls are necessary in such areas. Ordinance
No. 576 establishes a procedure for the removal of dangerous obstructions from creels
during the rainy season.
2. The effectiveness of the City's two ordinances in future floods will be so: iewhat
dependent upon County regulation and control of construction in flood -prone areas and the
removal of obstructions from creeks in the unincorporated areas above the City during
the rainy season. Therefore, this Council requests the said Board of Supervisors to
consider the adoption of similar ordinances or other ordinances which the County may deem
more appropriate to regulate such matters.

BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
1. Pursuant to Section 300 of the City Chaster, a general municipal election
shall be held on Tuesday, April 17, 1973, to fill the following elective offices:
(a) mayor - two year term.
(b) Two Councilmen - four year terms each.
2. Pursuant to the requests of the County Superintendent of Schools, and the
governing boards of the San Luis Obispo County Community College District and the
San Luis Coastal Unified School District, the elections for governing board raembers
to be held April 17, 1973, by said districts are hereby authorized to be consolidated
with the City's general election on said date. The City Clerk- is authorized and directed
to canvass the returns and certify the results of said school elections.
3. In order to conform to recent judicial decisions which have invalidated
residency requirements in excess of one year for candidates to public office, there shall
be submitted to the electorate at said general election a proposed amendment to the
City Charter to reduce the City residency requirement for Mayor and Councilmen from
three years to one year.
The proposed charter amendment shall read as follows:
"SECTION 304. Eligibility for Office.
No person shall be eligible for election to, or to hold, the
office of Niayor or Councilman of said City unless he is
and shall have been a resident thereof, or of territory
legally annexed thereto, on or prior to the date of such
election or appointment, for at least one year next preceding
his election thereto, or his appointment to fill a vacancy
therein, and is an elector thereof at the time of such
election or appointment. "
(NOTE: The two underlined words replace the words '"three .years. " There
are no other changes proposed to Section 304.)
The ballot format for the proposition to amend Section 304 of the City Charter
shall read substantially as follows:

Construction and the City of San Luis Obispo, and provides for the relocation of the City's
twenty -four inch diameter transmission water main to enable the State to construct a
new access road to California State Polytechnic University.

SAN LUIS OBISPO REQUESTING FLOOD CLEANUP
ASSISTANCE FROM THE CALIFORNIA NATIONAL GUARD.
WHEREAS, on January lo, 1973, the City of San Luis Obispo suffered its second
disastrous flood within four years with damage to private and public property in excess
of six million dollars; and
WHEREAS, the Federal Government has declined urgent requests that the City
be designated an official Disaster Area, and, therefore, it's not expected that the
City will receive material assistance from the U.S. Army Corps of Engineers in flood
cleanup and rehabilitation efforts; and
WHEREAS, the City and its residents are in urgent need of assistance in cleaning
up the debris and repairing the damage caused by said flood.
NOVI, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The City of San Luis Obispo urgently requests the California National Guard
to provide the City and its residents with whatever assistance can be provided under its
Community Services Program to clean up the debris and repair the damage caused by the
recent disastrous flood in the City.

WHEREAS, during the years 1971 and 1972 the firm of Simon Eisner and
Associates, professional planning consultants, prepared a proposed new General Flan
for the City of San Luis Obispo and submitted it to the Planning Commission for final
consideration on November 14, 1972; and
WHEREAS, the City Planning Commission conducted public hearings upon said
proposed plan and recommended the adoption thereof subject to certain amendments
as set forth in a memorandum to the City Council dated November 30, 1972; and
WHEREAS, at a public hearing held December 11, 1972, this Council approved
said proposed General Plan together with the amendments proposed by the Planning
Commission, and this Council proposed two additional amendments which were referred
to the Planning Commission for a report, as set forth in the Council Minutes of said
date; and
WHEREAS, this Council has considered the report thereon submitted by the
Planning Commission and finds that the two amendments proposed by the Council should
be incorporated into the new General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. A new General Plan is hereby approved and adopted for the City of San Luis

DUE TO FLOOD DAMAGE.
WHEREAS, Mayor Pro Tem Emmons Blake, acting as the Director of Emergency
Services, issued a Proclamation on January 18, 1973, declaring the existence of a local
emergency resulting from floodingr which created conditions of extreme peril to the safety
of persons and property within the City of San Luis Obispo; and
WHEREAS, this Council has reviewed the conditions existing at the time of the
issuance of said proclamation and finds that said proclamation was necessary and proper;
and
WHEREAS, this Council further finds that emergency cleanup operations mill be
necessary for the nest five days through January 24, 1973, and that the City's emergency
powers must be exercised between now and said January 24 to correct hazardous conditions
resulting from said flooding.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The Proclamation issued January 18, 1973, declaring the existence of a local
emergency is hereby ratified in all respects and all actions taken pursuant thereto are
also ratified.
2. The local emergency conditions are expected to continue through January 24,
1973, and the emergency powers set forth in the City's Civil Defense and Disaster Ordinance
are authorized to be used through said date wherever authorized by the Director of
Emergency Services.
3. The City Administrative Officer is directed to provide the State of California
with all information required by the State for processing of the City's request that the
Governor proclaim a "state of emergency" within the City.

copy of said resolution to the San Luis Obispo County Planning Commission for
consideration; and
WHEREAS, thereafter, on December 15, 1972, said County Planning Commission
approved and recommended to the County Board of Supervisors a new revised Yaster
Water and Sewerage Plan which not only ignored the conditions and amendments
presented by City, but which contains additional revisions which jeopardize City's
entitlements to water from the Salinas Reservoir, contrary to the City's previous
understanding with the County; and
WHEREAS, it appears that said new revised Master Water and Sewerage Plan is the
result of expediency and political compromise rather than sound engineering, economic
and water conservation considerations;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The Council of the City of San Luis Obispo disapproves the water element of the
new revised Master Water and Sewerage Plan for the County of San Luis Obispo as
approved by the County Planning Commission on December 15, 1972, because it is not
based upon sound engineering, economic, or water conservation considerations and it
is contrary to both the short and long term interests of the residents of the City and
of the County of San Luis Obispo.

The City of San Luis Obispo hereby endorses and approves the "Summary report -
piaster Water and Sewerage Plan for the County of San Luis Obispo, " prepared by
CDM, Inc., dated October, 1972, as revised by the Board of Supervisors on November 30,
1972, subject to certain conditions and to the revision of Plate A as follows:
1. PLATE A should be revised to reflect only the water development plan
recommended in the text of the report. Additional alternate facilities, such
as storage reservoirs, desalting plants and the transmission facilities
connected therewith should not be shown or noted until such time as a need
for such alternate facilities is demonstrated through the public hearing
process.
2. The cost of implementation of the County piaster Water Plan should
be apportioned on a basis of zones of direct benefit such as has been done
for the Lopez Project.
3. Although initial surpluses of water generated by development of the
Nacimiento Project may be put temporarily to beneficial uses such as ground
water basin recharge and recreational enhancement, Nacimiento water should
be reserved ultimately for municipal uses. As Nacimiento Project surpluses
decrease, non - municipal uses should be satisfied from other sources such as
the Coastal Branch of the State Aqueduct.

WHEREAS, Arnold Volny has petitioned the City of San Luis Obispo to annex to

by him at the termination of Patricia Drive, contiguous to the City, and designated as
'The Volny Annexation"; and
WHEREAS, the San Luis Obispo County Local Agency Formation Commission has
approved and authorized the proposed annexation without notice and hearing and without
an election (LAFCO Resolution No. 72 -15); and
WHEREAS, this Council has been presented with a tentative subdivision map showing
that the parcel of real property proposed to be annexed will be utilized for City street and
subdivision lot purposes in connection with a subdivision (Tract 460) which is otherwise
situated entirely within the City; and
WHEREAS, the records of the Planning Commission of the City of San Luis Obispo
show that said Planning Commission considered the proposed annexation at a duly noticed
public hearing on November 21, 1972, and unanimously approved said annexation; and
