HomeMy WebLinkAboutR-3953 Granting Approval of Tentative Tract Map Minor Subdivision 79-162, 531 LunetaU r_ J � rJ RESOLUTION N0. .3953 (1979 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO GRANTING APPROVAL OF TENTATIVE MAP FOR MINOR SUBDIVISION 79 -162, LOCATED AT 531 LUNETA STREET. BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. That this Council, after consideration of the tentative map of Minor Subdivision no. 79 -162 and the Planning Commission's recommendations, staff recommendations and reports thereon, makes the following findings: 1. The proposed parcel map and design are consistent with the General Plan. 2. The site is physically suited for the proposed type and density of'develop- ment which is permitted by the R -1 zone. 3. The design is not likely to cause substantial environmental damage, or cause serious public health problems. 4. The design of the proposed subdivision will not conflict with public easements for access through, or use of property within the proposed subdivision. EXCEPTIONS: The following lot depth exceptions are hereby approved, based upon findings below: 1. Lot 1: 100' average depth where 120' is normally required. 2. Lot 2: 71.9' average depth where 90' is normally required. a. The variances granted do not constitute a grant of special privilege inconsistent with the limitations upon other properties in the same vicinity. b. Because of special circumstances, notably the shape and topography of the property, the strict literal application of the Subdivision Ordinance would deprive the property of privileges enjoyed by other properties in the vicinity. c. Under the circumstances of this particular case, the variances requested carry out the spirit and intent of the Subdivision Ordinance. SECTION 2.. That the approval of the-tentative map for Minor Subdivision 79 -162 be subject to the following conditions: 1. Subdivider shall comply with conditions of Use Permit BA 38 -79. 2. Subdivider shall pay sewer and water fees, as determined by the City Engineer-prior to final map approval. R 3953 FAI F Resolution No. 3953 Page 2 3. Subdivider shall obtain necessary easements and extend sewer main as necessary and water mains across entire frontage to the approval of the City Engineer. 4. Subdivider shall dedicate a 28= foot.strip for widening of Luneta Drive and install curb, gutter and.sidewalk across the frontage.of lot 2, to the approval of the City Engineer. 5. Applicant shall paveout Luneta Drive along the frontage of lot 2, to city standards.(T.I. = 5.5) and the approval of the City Engineer. 6. Subdivider shall prepare a common driveway agreement for city approval and recordation prior to final map approval. 7. Subdivider shall pay park -in -lieu fees as required by Municipal Code Section 9100.3.12 prior to final map approval. 8. Subdivider shall install individually metered water service to both lots. Meters shall be located in the sidewalk at Luneta Drive frontage. 9. All new utilities shall be installed underground. 10. Subdivider shall install street trees to the approval of the Public Services Department. 11. Dead trees shall be removed (5) and the remainder shall be professionally trimmed and safety - pruned, to the approval of the Public.Services Department prior to final map approval. 12. All new lot corners shall be staked by a licensed surveyor or registered civil engineer. 13. The final parcel map shall contain a note that building permits will not be issued for the two undeveloped lots until required public improvements are installed.
