RESOLUTION NO. 517 -74 •
WHEREA5, the Planning Commission of the City of San Luis Obispo did conduct a
Public-Hearing in the Council Chamber of-the San Luis Obispo City Hall, San Luis
Obispo, California, on February 20, 1974, pursuant to a proceeding instituted
under APPLICATION NO. U 0441 by R. & R. BINRELE.

C -2 (Central Commercial) and R -3 (Restricted Multiple Family Residential
WHEREAS, said Commission as a result of its inspections, investigations, and
studies made by itself, and in its behalf and of testimonies offered at said
hearing, has established existence of the following circumstances.
1.
The subject property is located on upper Monterey at 2865 Monterey Street
adjacent to the Ark II restaurant.
2.
The applicant requests a conditional use permit under authority of Section
9200.35 of the Zoning Ordinance to permit construction of a restaurant with
an occupancy greater than 100 persons.
3.
Surrounding land uses include mixed residential, commercial, and semi public
uses. These is an existing restaurant directly to the north, an existing
single family residence to the south and existing single family residences
directly across the creek to the east.
4.
The applicant is proposing to develop a restaurant usinc an occupancy of
210 persons. The applicant has indicated that he will provide 40 parking

spaces.
The San Luis Obispo General Plan indicates highway commercial uses in this
general area.
6.
It was the opinion of the Commission that the proposed use would not be
detrimental to the health, safety and welfare of persons living and working
in the vicinity.
NOW
THEREFORE BE IT RESOLVED that Application No. U 0442 be approved subject to
the
following conditions:
a.
Development shall be in accordance with the submitted plot plan subject to the
conditions established by the Planning Commission.

A restrictive covenant shall be required as approved by the City Attorney.
c.
A waterways easement shall be dedicated for flood control and creek maint-
enance purposes in accordance with City policies developed by the subcommittee
formed to establish waterway policies.

A total of 53 off street parking spaces shall be provided to serve the rest-
aurant approved in conjunction with this application.
e.
All parking shall meet City standards.
f.
Applicant shall pay water acreage fees.
g.
Cross connection control shall be provided subject to approval by the Health

Department.
One off site fire hydrant shall be provided in the public sidewalk at a location
to be approved by the Fire Dept.
i.
Entrance driveway shall be no steeper than 10b. _

A detailed landscape plan showing plant materials and method of irrigation
shall be provided for staff approval.

Thre6 additional 15 gallon street trees shall be provided along the Monterey

A 3 ft. Nigh screen fence or hedge shall be required along the rear boundary
of the parking lot instead of the 6 ft. high screen fence or hedge normally .
