This change of organization or reorganization has been approved subject to the following condition and said condition has been met: That the annexation will not take effect until the building permit issued by the County become vested in the county to the occurrence of substantial construction which will be determined by the County of San Luis Obispo's Director of Planning and Building and the Local Agency Formation Commission's Executive Officer. 7. The date of adoption of the resolution ordering this change of organization or reorganization without election, or the resolution confirming an order for this change of organization or reorganization after confirmation by the voters was September 20, 2001. Hood Executive Officer ,.� ,. __ .,�. .......,. ..J�. rr �.r� .per .. . •„� air �r �.. r� .Jar IN THE LOCAL AGENCY FORMATION COMMISSION COUNTY OF SAN LUIS OBISPO, STATE OF CALIFORNIA Thursday, September 20, 2001 PRESENT: Coinnussioners Ray Johnson, Peg Pinard, Carolyn Moffatt, Richard Roberts, Duane I'icanco, and Chairman Mike Ryan ABSENT: Commissioner Barbara Mann RESOLUTION NO.2001-16 RESOLUTION CERTIFYING THAT THE NEGATIVE DECLARATION FOR TIT, SPHERE OF SERVICE REVISION PREPARED BY THE CITY OF SAN LUIS OBISPO AS LEAD AGENCY IS ADEQUATE AND COMPLETE, APPROVING THE SPHERE OF SERVICE REVISION, DETER -MINING THAT THE ENVIRONMENTAL DETERhIINATION FOR THE ANNEXATION PREPARED BY TIIE CITY OF SAN LUIS OBISPO AS LEAD AGENCY IS ADEQUATE AND COMPLETE, AND CONDITIONALLY APPROVING ANNEXATION NO. 66 TOTHE CITY OF SAN LUIS OBISPO (CREEKSIDE) The following resolution is now offered and read: WHEREAS, pursuant to Government Code Section 56425 et. seq. and the Commission's duly adopted "General Policies and Criteria" for spheres of influence and service, the Commission has previously adopted a sphere of influence and service for the City of San Luis Obispo (Creekside); and WHEREAS, on September 18, 2001, a request was filed with this Commission to consider a revision to the City of San Luis Obispo's previously adopted sphere of service and a proposal fill Annexation No. 66 to the City of San Luis Obispo (Creekside);.and `VHEREAS, the Bxecutive Officer has given the notices required by law and forwarded copies of his report to officers, persons and public agencies prescribed by law; and WHEREAS, the matter was set for public hearing at 9:00 a.m. on September 20, 2001, and the public hearing was duly conducted and determined and decision made on September 20, 2001; and WHEREAS, at said hearing, this Commission heard and received all oral and written protests, objections and evidence, which were made, presented or filed, and all persons present were given the opportunity to hear and be beard in respect to any matter relating to said proposal and report; and FVIMREAS, a negative deciarationprepared by the City ofSan Luis Obispo. has been duly prepared, noticed, and submitted for this sphere of service revision and annexation and this Commission finds, based upon the information submitted and received at the public hearing, that this project will not have a significant effect on the environment and that the negative declaration is adequate for the Commission's determinations; and WHEREAS, the Commission has considered all factors required to be considered by Government Code Sections 56668 and pursuant to Government Code Section 56425 (e) adopts as its written statements of determinations therein, the determinations set forth on page A-2-8 and A-2-9 of the Executive Officers report dated September 20, 2001, said determinations being incorporated by reference herein as though set forth in full; and WHEREAS, the Commission duly considered the proposal and finds that the territory proposed to be annexed to the City of San Luis Obispo (Creekside), should be located within the sphere of service of die City of San Luis Obispo; and that the proposed annexation should be approved. -.J -r --i --I ,rnn1 rl 4,,I STnl IIPC nnJU1 Aln-T Jf\ CJ a2C NOW. 'THEREFORE, BE IT RESOLVED AND ORDERED by the Local Agency Formation Commission of the County of San Luis Obispo, Stale of California, as follows: I. That the recitals set forth heremabove are true, correct, and valid. 1 "that the negative declaration prepared by the City of San Luis Obispo for this project is complete and adequate, having been prepared in accordance with the provisions of die California Environmental Quality Act and is hereby determined to be sufficient for the Commission's actions. 1 That the existing sphere of service for the area subject to this Resolution, as specifically described in Annexation 66 to the City of San Luis Obispo (Creekside) is hereby revised as forth in Exhibit A attached hereto and incorporated by reference herein as though set forth in full. 4. That Annexation No. 66 to the City of San Luis Obispo (Creekside), being further identified in the files of this Commission as File No. 7-R-01, is hereby approved, subject to the following condition: i. That the Annexation will not take effect until the building pernut issued by the County becomes vested in the County to the occurrence of substantial construction which will be determined by the County of San Luis Obispo's Director of Planning and Budding and the Local Agency Formation Commission's Executive Officer, 5. That the legal description approved by this Commission is attached hereto, marked Exhibit B and incorporated by reference herein as though set forth in full. 6. That the Executive Officer of this Commission is authorized and directed to mail copies of this resolution in the manner provided by law.
