CLOSED SESSION (4:00 - 4:30 PM) 1.a CALL TO ORDER Mayor Erica A. Stewart called the Closed Session of the San Luis Obispo City Council to order at 4:00 p.m. in Conference Room 6 at City Hall, 990 Palm Street, San Luis Obispo with all Council Members present. 1.b PUBLIC COMMENT FOR CLOSED SESSION ITEMS ONLY Public Comments: None ---End of Public Comment--- 1.c CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION ACTION: City Attorney Christine Dietrick reported that the Council met in closed session on two matters, one on exposure to litigation and the other on consideration of initiation of litigation as set forth in claims against the City by Righetti NC, LLC, received March 13, 2023, and December 12, 2024, and the City’s response thereto dated August 7, 2023. The city has been in negations to resolve the dispute but have been unable to do so ; based on those facts, and upon a motion by Council Member Marx, seconded by Mayor Stewart, with a vote of 5 – 0, the Council authorized the initiation of litigation against Righetti NC, LLC. 1.d ADJOURNMENT The City Council adjourned Closed Session at 4:25 PM to the Annual Advisory Body Recognition at 4:30 PM. 2 2. ANNUAL ADVISORY BODY RECOGNITION (4:30 - 5:30 PM) The Mayor and City Council recognized Advisory Body members for their service to the City of San Luis Obispo. 3. REGULAR MEETING CALL TO ORDER (5:30 PM) A Regular Meeting of the San Luis Obispo City Council was called to order on April 1, 2025 at 5:30 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart with all Council Members present. 4. PLEDGE OF ALLEGIANCE Council Member Marx led the Council in the Pledge of Allegiance. 5. PRESENTATIONS 5.a MONTH OF THE CHILD & CHILD ABUSE PREVENTION MONTH PROCLAMATION Council Member Marx read the proclamation declaring the month of April as "Month of the Child" and "Child Abuse Prevention Month." Mayor Stewart presented the Proclamation to Molly Myers and Kimberly Aguirre on behalf of the San Luis Obispo County Early Care & Education Planning Council. 5.b SEXUAL ASSAULT AWARENESS MONTH PROCLAMATION Vice Mayor Shoresman read the proclamation declaring the month of April as "Sexual Assault Awareness Month." Mayor Stewart presented the Proclamation to Emilie de la Motte on behalf of Lumina Alliance. 5.c AUTISM AWARENESS MONTH PROCLAMATION Mayor Stewart presented a proclamation declaring the month of April as "Autism Awareness Month" to Naliah DuBose on behalf of XiXi Chapter of Zeta Phi Beta Sorority. 5.d CITY MANAGER REPORT City Manager Whitney McDonald provided a report on upcoming projects. 6. Ayes (5): Council Member Boswell, Council Member Francis, Council Member Marx, Vice Mayor Shoresman, and Mayor Stewart CARRIED (5 to 0) 7.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 7.b MINUTES REVIEW - MARCH 18, 2025 COUNCIL MINUTES Approve the minutes of the City Council meeting held on March 18, 2025. 7.c 2025 ANNUAL APPOINTMENTS TO CITY ADVISORY BODIES As recommended by the Council Liaison Subcommittees, make appointments to the City of San Luis Obispo's advisory bodies and continue to recruit for any unfilled vacant positions. 4 7.d 2024 GENERAL PLAN ANNUAL REPORT As recommended by the Planning Commission, receive and file the 2024 General Plan Annual Report. 7.e SECOND READING AND ADOPTION OF ORDINANCE NO. 1743 (2025 SERIES) AMENDING TITLE 16 (SUBDIVISION REGULATIONS) AND TITLE 17 (ZONING REGULATIONS) OF THE MUNICIPAL CODE Adopt Ordinance No. 1743 (2025 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, approving an update to the City’s Subdivision Regulations (Title 16) and Zoning Regulations (Title 17) to implement State Legislative Updates on Accessory and Junior Accessory Dwelling Units and Urban Lot Splits; and an Update to the City’s Zoning Regulations (Title 17) to Provide Clarifications to Regulations for Affordable Housing Projects with an Exemption from Environmental Review (CEQA).” 7.f SECOND READING OF ORDINANCE NO. 1744 (2025 SERIES) RESTATING THE CITY’S EXISTING SOLID WASTE, RECYCLING, AND ORGANICS FRANCHISE AGREEMENTS WITH SAN LUIS GARBAGE COMPANY AND ORDINANCE NO. 1745 (2025 SERIES) AMENDING SLOMC SECTION 8.04.070 1. Adopt Ordinance No. 1744 (2025 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, restating its existing franchise agreements with San Luis Garbage Company into one Discarded Materials Agreement”; and 2. Adopt Ordinance No. 1745 (2025 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, amending Section 8.04.070 (Use of Disposal Service Mandatory – Collection Charges) of the Municipal Code modifying the process of collecting delinquent solid waste collection and disposal accounts.” 7.g FISCAL YEAR 2024–25 SAN LUIS OBISPO COUNTY INTEGRATED WASTE MANAGEMENT AUTHORITY TECHNICAL ASSISTANCE GRANT APPLICATION 1. Authorize the Utilities Department to apply for the Fiscal Year 2024 - 2025 Integrated Waste Management Authority Technical Assistance Grant in the amount of $10,000; and 2. If the grant is awarded, authorize the Utilities Director, or their designee, to execute necessary grant documents and direct the appropriation of monies to the accounts required to administer the grant. 5 8. PUBLIC HEARING AND BUSINESS ITEMS 8.a REVIEW OF AN INITIATION OF A GENERAL PLAN AMENDMENT, REZONE, AND ANNEXATION TO FACILITATE BROADSTONE VILLAGE, A PHASED RESIDENTIAL DEVELOPMENT PROJECT, AT 12500 AND 12501 LOS OSOS VALLEY ROAD Council Members Shoresman, Francis, Marx, Boswell and Mayor Stewart noted their Ex Parte Communications regarding the project. Community Development Director Timmi Tway, Transportation Manager Luke Schwartz and Associate Planner Hannah Hanh provided an in -depth staff report and responded to Council questions. Stephen Peck, Applicant's Representative and Matt Wade, Applicant , provided a presentation. Directed staff to initiate review of the General Plan Amendment, Rezone, and Annexation applications. 2. Confirmed staff’s recommendation that funding strategies for the construction and maintenance of the bypass road be developed during the review process with the understanding that general fund contributions to its construction would not be provided. 3. Provided the following directional items for the review process: o Evaluate all three Bob Jones Trail alignment options (presented in the staff agenda correspondence) and obtain input from the ATC and community. 2 o Explore the possibility of completing the bypass and trail as part of Phase 1 for the project. o Conduct analysis on density alternatives for R-3 and R-4 zoning as part of the environmental review. o Include 10% affordable units (mix of senior and multifamily units) if possible. o Evaluate different site designs that include additional community benefits such as incorporating the creek as an amenity, providing additional park or recreational space, or creating a development that is less car dependent. o Conduct a fiscal impact analysis to evaluate ongoing costs associated with maintenance of new infrastructure/facilities, services, etc. o Prepare a cost analysis for the construction and maintenance of the bypass. Ayes (4): Council Member Boswell, Council Member Francis, Vice Mayor Shoresman, and Mayor Stewart Noes (1): Council Member Marx, who explained that she voted no because she feels this is taking on way too much, given everything the city has going on at this time. CARRIED (4 to 1) 8.b REVIEW OF PROPOSED CIRCULATION MODIFICATIONS TO THE PREVIOUSLY APPROVED 600 TANK FARM ROAD PROJECT, AND ASSOCIATED ADDENDUM TO THE CERTIFIED FINAL ENVIRONMENTAL IMPACT REPORT Council Members Shoresman, Francis, and Marx noted their Ex Parte Communications regarding the project. Council Member Boswell and Mayor Stewart reported having no Ex Parte Communications. Contract Planner John Rickenbach and Associate Planner Callee Taylor provided an in-depth staff report and responded to Council questions. Ayes (5): Council Member Boswell, Council Member Francis, Council Member Marx, Vice Mayor Shoresman, and Mayor Stewart CARRIED (5 to 0) Motion By Council Member Marx Second By Vice Mayor Shoresman To adopt Resolution No. 11553 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving the proposed Circulation and Condition Modifications for the previously approved 600 Tank Farm Road Project and approve the associated Addendum to the Certified Final Environmental Impact Report as represented in the City Council Agenda Report and attachments dated April 1, 2025 (MOD-0753-2024)” to: 1. Approve a modification to conditions of approval related to revised offsite public circulation improvements for the previously approved 600 Tank Farm Road project; and 2. Approve an Addendum to the previously certified Final Environmental Impact Report (FEIR) for the 600 Tank Farm Road project, pursuant to the California Environmental Quality Act (CEQA). Ayes (5): Council Member Boswell, Council Member Francis, Council Member Marx, Vice Mayor Shoresman, and Mayor Stewart CARRIED (5 to 0) 9. LIAISON REPORTS AND COMMUNICATIONS By consensus, the Council directed staff to place an item on a future agenda to review fines assessed against a residential property owner for conducting unpermitted trimming of multiple trees and in a manner that damaged the trees. The matter was brought up during Public Comment for items not on the agenda. The item will be agendized for a future meeting, tentatively scheduled for July; until that time, the fine will be placed on hold. 4 Mayor Stewart • SLO Council of Governments (SLOCOG) – Plans to attend the meeting on April 2nd where they will be reviewing the Regional Transit Plan. • Central Coast Clean Energy - Attended the grand opening of their new offices. • Presented to students from Bishop Peak Elementary School, Old Mission Elementary School, and to the Girl Scouts. Vice Mayor Shoresman • Homeless Services Oversight Committee - Attended the March 19th meeting, which was a planning and listening session. Council Member Marx • Air Pollution Control District (APCD) - Participated in the interviews for the Executive Director position. • Attended the Central Coast Community Energy grand opening of their San Luis Obispo office. • Attended the City/University quarterly lunch. • Attended a meeting with staff and tenant protection advocates. 10. ADJOURNMENT The meeting was adjourned at 11:11 p.m. The City Council will hold their annual Retreat on Friday, April 4, 2025 at 8:30 a.m. in the City/County Library Conference Room, 995 Palm Street, San Luis Obispo. Additionally, a Special Closed Session will be held on Tuesday, April 8, 2025 at 5:30 p.m. in the Council Hearing Room at City Hall. The next Regular Meeting of the City Council will be held on April 15, 2025 with Closed Session at 4:30 p.m. in the Council Hearing Room and the Regular Meeting at 5:30 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo. _________________________ APPROVED BY COUNCIL: 04/15/2025
