A RESOLUTION AUTHORIZING CITY CLERK TO
ACCEPT AND RECORD DEED FROM SINSHEIMER
BROS.
BE IT RESOLVED by the Council of the City of San
Luis Obispo as follows:
That the City Clerk be and he is hereby instructed to
receive and record a deed from Sinsheimer Bros. deeding to the
City of San Luis Obispo the following described property:
Real property in the County of San Luis Obispo,
State of California, described as follows:
The Southwest quarter of the Southwest quarter
of Section 4; the .West .half of the Southeast
quarter and the Southeast quarter of the
Southeast quarter of Section 5, and Lot 48 of
Township 31 South, Range 14 East, Mount Diablo
Base and Meridian, in the County of San Luis
Obispo, State of California, according to
the official plat or plats of the survey of
said lands returned to the General Land
Office by the Surveyor General.
RESERVING, however, to the Grantor fifty
50 %) per cent of the oil, gas and mineral
rights in said property.
PASSED AND ADOPTED this 27 day of June, 1955, by
the following vote:

To the Mayor and City Council
of the City of San Luis Obispo:
In connection with the gift of 320 acres of land in Lopez
Canon to the City of San Luis Obispo as set forth in the
accompanying deed it is requemted that the City enact such
regulations as to Health and Safety as may be deemed advis-
able. To this end we submit the following additional sug-
gestions:
1. That no firearms be permitted on said property.
2. That no trail riding be permitted.
3. That the property be used for daytime recreation only.
4. That the land be not rented or leased, except as to oil
and mineral rights, and as -to such government agencies as
the FistL and Game Commission and Division of Forestry.

5. That the natural beauty of the property /as far as may
be possible in connection with its development as a recreation
area or as a source of water supply.

1. Provisions recited in the Patents from the United States dated
November 1, 1904 and recorded January 17, 1905, in Book H. at page
421 of Patents, affecting Lot 48 herein described, and dated September
30, 1899 and.recorded November 1, 1902 in nook H, at page 323 of Patents,
affecting the West half of the Southeast quarter and the Southeast
quarter of the Southeast ouarter of Section 5; and the Southwest quarter
of the Southwest quarter of Section 4, as herein described, issued
under Act of Congress of May 20, 1862 entitled "To Secure Homesteads
to Actual Settlers on the Public Domain ", and the Acts supplemental
thereto as follows:
Subject to any vested and accrued water rights for mining, agricultural,
manufacturing or other purposes and rights to ditches and reservoirs
used in connection with such water rights as may be recognized and
acknowledged by the local customs, laws and decisions of courts.
The right of the proprietor of any vein or lode to extract and remove
his ore therefrom should the same be found to penetrate or intersect
the premises.
A right of way for ditches or canals constructed by the authority of

the United States as reserved in above mentioned Patent.
2.,* As to the West half of the Southeast quarter and the Southeast
quarter of the Southeast quarter of Section 5 and the Southwest quarter
of the Southwest quarter of Section 4, Township-31 South, Range - East,
herein described:
Said land was thus described in. the -Patent from the United States to
Robert L. Wilson, dated September 30, 1899 and recorded oh November 1,
1902, in Book H, at page 323 of Patents, records of San Luis Obispo
County. The Official Plat of s aid Township filed in the United States
General Land Office on October 3, 1903, designates the area embraced
in said description as being a portion of Lot 49 thereon, and a
notation appearing on said plat indicates that Lot 49 is the claim of
one, ±.R. L. Nilson.
Official Records of San Luis Obispo County do not reveal any
reconciliation of the description used in said Patent with the land
designated as Lot 49 -on said official plat, and no liability is
assumed by this report as to the apparent variation of the boundari
of the land as_ described in as iri A o Tn n
October 3, 1903.
We suggest that the United States Bureau of Land' Management at
Washington, D. C., be contacted relative to clarification of the
description.
3. An easement for public roads as set forth in that certain Decree
of Condenmation dated July 12, 1909 issued out of the Superior CourtoftheStateofCalifornia, in and for the County of San Luis Obispo,
entitled "County of San Luis Obispo, Plf, vs. P. A. Harding, et al.,
Dfts," Case No 4766, a certified copy of said Decree was recorded
July 12, i1909 n Book 81, at page 3.52 of Deeds, and as granted to the
County of San Luis-Obispo, by deed dated June 22, 1909 and recorded
July 21, 1909 in Book 81, at page 393 of Deeds.

4. An Oil and Gas Lease, with option to purchase, affecting the South: j west quarter of the Southwest quarter of Section 4; the West half ofitheSoutheastquarter <,and the Southeast quarter of the Southeast quarter
of Section 5, herein described, dated November 1, 1907, executed byR. L. Vvilson, as lessor and by Geo. E. Klink'; as lessee, for the term
and upon the conditions therein set forth, recorded February 8., 1908
in Book F. at page 388 of Leases, records of said.County.
By assignment attached thereto Geo. E. Klink assigned all his right,
title and interest in said lease and option to Geo. E. Klink, Ben
Younken, Stone Hastings, F. Morgeson, Chas. Davis, E. G. Field, Elmer
Fields, J. F. Fields, Jef. Jones, Roscoe Jones and Joe Meachem.
