SUBJECT: Final map approva'l for Tract No. 683, S.E.B. Estates
SITUATION
The Public Services Departnent has reviewed the final tract map, All conditions
have been met. A set-aside letter guaranteeing the jnstallation of public
improvements and necessary fees have been submitted by the developer. See
remarks below.
STAFF POSITION
Approval of final map for Tract No. 683 and revised agreement. Approve resolutionauthorizing Mayor to sign agreement and recording of final map.
DI SCUSS ION :
The subdivision agreement has been modified from our standard agreement,at the
request of the subdivider, which provides for completion of the improvementsin three phases within 36 months of recordatjon of the map. (This'was donefor Tract B0B recent'ly, however, it provided forr completion in 24 months,with provisions for extensions upon Council approval.) Written verificdtjon
would be required from the surety for extensjons and the Council could requireadditional surety if deemed necessary.
There are provisions also for acceptance of portions of the subdivjs'ion
improvements, 'if completed to the satisfaction of the Council.
Condition nos. B through '11, 25 and 26 contain references to elevati on 127,
which was considered the "lOO-year storm" lake elevation at the time of
approval of the tentative map. That has since been revjsed to be elevation.126 and is indicated on the current flood hazard map. This change has been
reflected on the plans and final map.

The agreement provides for landscaping along Los Osos Valley Road and withjn
the city-owned area norther'ly of Vista del Collados (between lots 86 and 87)
to be maintained by the c'ity upon acceptance of the public improvements.
Landscaping at the rear of lots 95 to i04 and within lot 'l05 are not to be
the responsibility of the city.
All references to lot .l04 (open-space lot) in Resolution No.3656 (.l978
Series) actually pertain to lot 105 on the final map. This is due to the
addition of one lot on Escuella,Courtwhich was previous'ly approved by the
City Council. This was made possible by adjusting 1ots, refi:ning oalculations,
and still complying with subdivision regulations. Public Service and Com-
munity Development staffs jointly agree that this complies with the requirernentof substantial conformity with the tentative map.
Condition no.25, dealing with the number of lots along the lake, was consid-
ered by the Council on February 17,198.l, at the request of the subdividern
in order to avoid possible delays in recording of the final map. The resu'lt
was that lot lines were to be adjusted to provide standard frontages and at
least 6,000 square feet of lot above the .126 elevation; and as long as vari-
ances were not necessary, the Council would not consider this again. Staff
determined that this condition has been net.
Condition no. 20 required drainage improvements to be designed to handle a
"1OO-year storm." City des'ign criteria was adopted subsequent to that
resolution and changed the requirements depending on size of the tributary
area. Therefore, these facilities were designed for a "1O-year storm", with
analysis 0f "100-year storm" impact in compliance with flood ordinance require-
rnen ts .
Condition No. 17 required that two fire hydrants be tied into the l6-inch
water main in Los 0sos Valley Road. This.was accomplished by an alternate
design which provides the same protection.

BE IT RESOLVED by the Councjl of the City of San Luis Objspo as follovrs:
' SECTI0II l. That this Councjl, after consideration of the tentative map
of Tract 683.tnd the Planning Commiss'ion's reconrmendations, staff reconrmendations,
and reports thereon, makes the follorving find'ings:
(l) The tentative map is consistent with the general plan; and
(2)' The design and improvements of the proposed subdivis'ion are consistent
wjth the general pian; and
The site'is physically suitable for the type of development proposed; and
The site is physically suitable for the proposed density of develop-
ment;, and
(5) The design of the subdivision and the proposed improvements are not ljkely
to cause substantial environmental damage or substantially and avoidably
injure fish or wildl'ife or their habitat; and
(6) The design of the subdivision or the type of improvements are not likely
to cause public health problems; and
(i) The design of the subdivison or the type of improvements rvjll not
confl ict vrith easenrents, for access through or use of property with'in
the proposed subdivision
SECTIQII 2. That the approval of the tentatjve map for Tract 683 be subject
to the follovring conditions:
(l) Sidevralk and street trees are hereby waived along all of the frontage
of lot .|04. In ljeu of sidelalk, a lO-foot level area behind the curb
shall be provided.
(2) Subdivjrler shall jnstall street trees along all street frontages in a
standard street tree easement where needed.
(3) A perpetual open space easenent shall be granted to the c'ity for the
area designated as."lot .I04" on the map. The open space easernent will
be to nrajntain the area in jts natural open space character. The ease-
rnent, shall run with the land and prov'i'cie the fo'llovring ljmitations on
use or alterations of the area:
