SUBJECT:
Ferrini Park Landscape and Irrigation - City Plan No . M53-Y
CAO RECOMMENDA110N:
Adopt Resolution approving Plans and Specifications , authorizing
staff to advertise for bids , appropriating $20 , 000 , and
authorizing the CAO to award a contract within the available
funding.
BACKGROUND:
The dedication and landscaping of Lot A was a condition of approval
of Tract 1182 , Ferrini Ranch Estates III . The developer entered into
an agreement to pay the City $14 , 000 to install the landscaping after
the completion of subdivision improvements ( Exhibit A) . The funds
have been earning interest in the Parks-in-Lieu Fund since February ,
1985 .
This project will provide the passive landscaping required by the
condition of the subdivision and the agreement with the developer .
Coordination :
This project received final ARC approval on November 9 , 1987 .
The subdivision Environmental Impact Report covers this project .
Purchasing_Control_Procedure :
Purchasing Control Procedure 403-3 applies to this contract .

$14 , 000 were deposited to the Parks-In-Lieu Fund in , 1985 to accom-
plish this landscaping. With interest , the amount available for
construction is over $18 , 000 .
Recommendation :

Adopt Resolution approving Plans and Specifications , authorizing
staff to advertise for bids , appropriating $20 , 000 , and authorizing
the CAO to award a contract within the available funding.

God or strikes, the Suodivider shall have an additional period of time
equivalent to such period of delay in which to complete such work. Any
extension of time hereunder shall not operate to release the surety on
the Improvement Security filed pursuant to this agreement. In this
connection, the surety waives the provisions of Section 2819 of the
Civil Code of the State of California.
No building permits will be issued nor occupancy granted after the
expiration date of the agreement until completion and acceptance of all
public improvements unless specifically. approved by the City Council .
The subdivider does also agree to comply with the following
conditions established by the Planning Commission and/or the City
Council .
1 . The Subdivider shall deposit a monumentation bond of
121000_00 to cover the installation of survey monuments
in accordance with the approved map and payment for
same. Said deposit will be released to the Subdivider
upon receipt by the City of a letter from the Engineer
indicating they have completed the work and have been
` paid.
2. The subdivider shall pay water acreage fees of
$54,404.00 (46.90 AC (net) x $1160/AC) .
3. The subdivider shall construct and dedicate. offsite
water tank, tank site, pump and pumpsite and all
piping, fencing, sitework and appurtenances to the
approval of the Public Works Department.
4. The subdivider shall improve the common driveways for
lots 79 thru 86 for the approved plans as well as
extension of respective utilities as subdivision
improvements.
5. The subdivider shall take appropriate precautions to
minimize adverse construction impacts on neighboring
properties due to dust, noise, erosion, etc. as
enumerated in the Council Resolution and on the
approved plans.
6. The Subdivider shall pay $14,000.00 toward the cost of
park landscaping. (Condition 31 per Resolution No. 5428-1984 Series)

RESOLUTION NO. (1988 SERIES)
A RESOLUTION OF THE COUNCIL OF THE
CITY OF SAN LUIS OBISPO APPROVING A
PROJECT AND APPROPRIATING FUNDS
WHEREAS, dedication and landscaping of Lot A was a condition of the
approval of Tract 1182; and
WHEREAS, the City entered into an agreement to accept payment of
$14,000.00 from the developer to have the City complete the landscaping
after the completion of the improvements; and
WHEREAS, said $14,000 was deposited to the Parks-in-Lieu Fund in
February 1985; and
WHEREAS, the design of the landscaping is complete and was approved by
the ARC on November 9, 1987.
NOW THEREFORE BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Plans and Specifications for City Plan Number M-53Y,
Ferrini Park Landscape and Irrigation are approved and staff is authorized
to advertise for bids.
SECTION 2. Funds in the amount of $20,000 are appropriated for design
and construction of City Plan No. M-53Y.
SECTION 3. The Finance Director shall transfer $20,000 from the
Parks-in-Lieu Fund into the following project accounts:
040-9562-092-571 $1,750.00 for design
040-9562-092-572 $18,250.00 for construction
The City Clerk shall advertise for bids and report these bids to the
CAO.
SECTION 4. The City Administrative Officer is authorized to award the
contract within the available funds.

SECTION 5. The City Clerk shall furnish a copy of this resolution to
the Public Works Director and the Finance Director.
