SUBJECT : Mission Plaza Walkway and Patio CAO RECOMMENDATION : By resolution approve the award of a contract to Whitaker Construction in the amount of $74 , 697 . 60 to complete project - Mission Plaza Walkway and Patio - City Plan Nos . M-02Y and M-03Y ; direct the transfer of $30 , 000 to account 040-9547-091-572 from Mission Plaza Reserve CRP Appropriations ; and appropriatp an additional $50 , 000 to this project from Mission Plaza Reserves BACKGROUND : The FY 1987-89 Capital Reinvestment Plan identified $30 , 000 in FY 1987-88 for the Mission Plaza patio and walkway and $10 , 000 in FY 1988-89 for the kiosk. On February 9 , 1988 , City Council approved the plans and specifications with reservations on the construction of a Kiosk . The project was bid with the kiosk and directories as an alternate . On April 21 , 1988 , the bids were opened . A summary of the bids is attached (Attachment 1 ) . All four bids are over the estimate of the landscape architect who prepared the plans and specifications . The apparent low bid submitted by Complete Development Services , Inc . is not responsive . This firm does not have a Class A Contractors License as required by the specifications . Staff has reviewed the Contractors Licensing Law and has confirmed that a Class A license is the only appropriate license for the contractor performing this work . 0 tions 1 . Appropriate $50 , 000 and award the contract without the kiosk to the lowest qualified bidder - contract cost $74 , 697 . 60 . 2 . Appropriate $60 , 000 and award the contract with the kiosk to the lowest qualified bidder - contract cost $84 , 589 . 80 . 3 . Reject all bids and redesign the project for a lower cost . 4 . Reject all bids and cancel the project . Pros_and_Cons 1 . It is unlikely that this project can be accomplished at a lower cost . A comparison of these bids with other recent bids indicates that the estimate was low. Recent experience with rebidding of projects has been that the low bids increase on the second bidding. The landscape architect has discussed the bids and alternatives with the Namans ' . They said that the gift of the use of the land was made with the understanding that the City would construct a walk and seating area . 2 . The kiosk and directories increase the contract cost $9 , 900 which is excesive for the contribution they will make to the plaza . 3 . The possibility of redesigning the project has been reviewed with the landscape architect . Significant cost savings are not possible if the project is to provide a walkway . A walkway through this area requires a retaining wall , guard rails and lighting to highlight the steps . 4 . Cancellation of the project would save the City the cost of the project . However , the City would then need to address the gift of the use of the land which was made with the understanding that the walk would be constructed . The landscaping in this area would still need major renovation that could be accomplished as part of the normal maintenance of the area . Purchasing_Contral_Procedure Purchasing Control Procedure 403-3 applies to this contract . (1988 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROPRIATING FUNDS AND AWARDING A PROJECT WHEREAS, the City requested bids for the construction of a walkway and patio in the Mission Plaza; and WHEREAS, bids were received from four contractors on April 21, 1988; and WHEREAS, Complete Development Services, Inc. , which submitted the J lowest bid, does not have a Class "A" Contractors License as required by the Specifications and by the Contractor's Licensing Law; and WHEREAS, the low responsive bid was submitted by Whitaker Construction for the amount of $74,697.60; and WHEREAS, the agreement with the Namans' for the use of the land commits the City to construction of a walkway and seating area; NOW THEREFORE BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The bid submitted by Complete Development Services, Inc. is not responsive because the contractor is not properly licensed for this class of work. SECTION 2. An additional $50,000.00 is appropriated from Mission Plaza Reserves and the Finance Director is to transfer the present $30,000.00 from Mission Plaza Reserve CRP Appropriations to the Project Account 040-9547-091-572. SECTION 3. The award of a contract to Whitaker Construction, Inc. in the amount $74,897.60 is approved and the Mayor is authorized to sign the contract.
