THIS AMENDMENT TO AGREEMENT is made and entered in the City of San Luis Obispo on February
4, 2013 ' by and between the CITY OF SAN LUIS OBISPO, a municipal corporation, herein after referred to as City,
and Dokken Engineering, hereinafter referred to as Consultant.
\ryITNESSETH:
WHEREAS, on May 3,2017, the City entered into an Agreement with Consultant for Engineering services
for structural assessment, geotechnical investigation and altematives study for repair or replacement of Marsh Street
Bridge per Specification No. 90480; and
WHEREAS, the City desires to amend the scope of services to include preparing plans, specifications and
estimate; environmental studies, documentation and permitting; and right-oÊway planning, engineering ald
acquisition, and Consultant has submitted a proposal for this pu{pose that is acceptable to the City.
NOW THEREFORE, in consideration of their mutual promises, obligations and covenants hereinafter
contained, the parties hereto agree as follows:

Environmental Clearance and Design

Dear Mr- McGuirc:
Thank you for the opportunity for us to submit the attached scope and cost propôsal for engineering
services to provide envirorunental clearance and design for the Marsh Street Bridge Replacement
Project. We are pleased the City is ready to proceed into the environmental phase of the project
and welcome the chance to help the City through this important project.
Dokken understands the design and construction costs for this bridge rvill be moderate and
relatively straightforward; however, fhe bridge and the surounding project area have a
combination of environmental resources which make the environmental process a very complex
undertaking. I have outlined the following environmeutal concerns to account for the proposed
cost and our estimate of an l8 month schedule to complete the Preliminary Engineering and
Environmental Approval phase of the project:
San Luis Obispo Creek is a rüaters of the United States under Army Corps of Ðngineers
jurisdiction. It is also a Waters of the State under jurisdiction of the California Departrnent
of Fish and Game.
San Luis Obispo Creek is identified as suitable habitat for the Central Valley Steelhead, a
Feclerally Tlueatened Species under protection of Section 7 of the Endangered Species
Act. The project area is also consiclered Critical Habitat for the steclhead. As part of the
NEPA process Section 7 Consultation rvith the Naiional Marine Fisheries Service will be
needed.
The project area is identifrecl as suitable and critical habitat for the California Red-legged
Frog, a Federally Threatened species also protected by section 7, As part of the NEpA
process Section 7 Consultation with the Unitecl States Fish and Wildlife Service rvill be
needed.
The Marsh Street Briclgc is a historic resouÍce eligible for inclusion in the National
Register of Historic Places and is protected under Sectíon 106 of the National Flistoric
Preservation Act. Demolition and replacement of this bridge will require extensive
coordination effofts with Caltrans, the State'I{istoric Preservation Officer, and the local
historic society with an interest in the resoulce.

¡ As a historic resource, the bridge is also protected under Section 4(f) of the Fecleral
Depafiment of Transpoltation Act. Impacts to a historic bridge require documentation
proving that avoidance alter¡ratives have been fully analyzed prioi to wÈpn approval.
Although these elements will require a larger effort than the typical bridge rcplacelnent, we will
make every effort to minimize the cost during the environmental piorerr. Flowever, our
knowledge of the process and the numerous resource agencies invohèd leads to the attached
necessary services. Dokken Engineering management and environmental staff have substantial
experience working with Caltrans and the other regulatory agencies to guide this type of project
through to completion. Having an inhouse environmental team that can work dirååtly with our
engineers allows us to reduce miscommunioations and potential clelays throughout the
environmental phase.
