25189.5. (a) The disposal of any hazardous waste, or the causing thereof, is
prohibited when the disposal is at a facility which does not have a permit from the
department issued pursuant to this chapter, or at any point which is not authorized
according to this chapter.
(b) Any person who is convicted of knowingly disposing or causing the disposal of
any hazardous waste, or who reasonably should have known that he or she was
disposing or causing the disposal of any hazardous waste, at a facility which does
not have a permit from the depaftment issued pursuant to this chapter, or at any
point which is not authorized according to this chapter shall, upon conviction, be
punished by imprisonment in a county jail for not more than one year or by
imprisonment pursuant to subdivision (h) of Section 1170 of the Penal Code.
(c) Any person who knowingly transpofts or causes the transportation of hazardous
waste, or who reasonably should have known that he or she was causing the
transportation of any hazardous waste, to a facility which does not have a permit
from the department issued pursuant to this chapter, or at any point which is not
authorized according to this chapter, shall, upon conviction, be punished by
imprisonment in a county jail for not more than one year or by imprisonment
pursuant to subdivision (h) of Section ILTO of the Penal Code.
(d) Any person who knowingly treats or stores any hazardous waste at a facility
which does not have a permit from the department issued pursuant to this chapter,
or at any point which is not authorized according to this chapter, shall, upon
conviction, be punished by imprisonment in a county jail for not more than one
year or by imprisonment pursuant to subdivision (h) of Section 1170 of the Penal

(e) The court also shall impose upon a person convicted of violating subdivision
(b), (c), or (d), a fine of not less than five thousand dollars ($5,000) nor more than
one hundred thousand dollars ($100,000) for each day of violation, except as
further provided in this subdivision. If the act which violated subdivision (b), (c), or
(d) caused great bodily injury, or caused a substantial probability that death could
result, the person convicted of violating subdivision (b), (c), or (d) may be
punished by imprisonment pursuant to subdivision (h) of Section 1170 of the Penal
Code for one, two, or three years, in addition and consecutive to the term specified
in subdivision (b), (c), or (d), and may be fined up to two hundred fifty thousand
dollars ($250,000) for each day of violation.
(f) For purposes of this section, except as otherwise provided in this subdivision,
"each day of violation" means each day on which a violation continues. In any case
where a person has disposed or caused the disposal of any hazardous waste in
violation of this section, each day that the waste remains disposed of in violation of
this section and the person has knowledge thereof is a separate additional
violation, unless the person has filed a report of the disposal with the department
and is complying with any order concerning the disposal issued by the depaftment,
a hearing officer, or court of competent jurisdiction.

Received a voice mail message at 3:0L pm today from Meridith Sprister of OEC Labs in Santa Maria. ICP
equipment used for analyzing Lead samples is down due to mechanical problems and not anticipated to
be back in service until Tues. 5/6/2014. She offered to send out my samples to another contract
laboratory, but we would be charged double the initial cost - I declined and left her a voice mail
message to that effect. I also stated that I wanted our cost to reflect "normal turn-around time" instead
of 24 hour as I requested on the chain of custody form. She will respond back tomorrow with a better
idea of when the ICP equipment will be back up.

S 66261.23. Characteristic of Reactivity.
(a) A waste exhibits the characteristic of reactivity if representative
samples of the waste have any of the following properties:
(1) it is normally unstable and readily undergoes violent change with-
out detonating;
(2) it reacts violently with water;
(3) it forms potentially explosive mixtures with water;
(4) when mixed with water, it generates toxic gases, vapors or fumes
in a quantity sufficient to present a danger to human health or the environ-
ment;
(5) it is a cyanide or sulfide bearing waste which, when exposed to pH
conditions between2and 12.5, can generate toxic gases, vapors or fumes
in a quantity sufficient to present a danger to human health or the environ-
ment;
(6) it is capable of detonation or explosive reaction if it is subjected to
a strong initiating source or if heated under confinement;
(7) it is readily capable of detonation or explosive decomposition or
reaction at standard temperature and pressure;
(8) it is a forbidden explosive as defined in 49 CFR section 173.51 (as
amended April 20, 1987), or a Class A explosive as defined in 49 CFR
section 173.53 (as amended Apfl 5,1967) or a Class B explosive as de-
fined in 49 CFR section 173.88 (as amended May 19, 1980).
(b) A waste that exhibits the characteristic of reactivity has the EPA
Hazardous Waste Number of D003.

(a) A waste exhibits the characteristic oftoxicity ifrepresentative sam-
ples of the waste have any of the following properties:
(1) when using the Toxicity Characteristic Leaching Procedure
(TCLP), test Method 131 I in "Test Methods for Evaluating Solid Waste,
PhysicaVChemical Methods," EPA Publication SW-846, third edition
and Updates (incorporated by reference in section 66260.1 I ofthis divi-
sion), the extracts from representative samples of the waste contain any
of the contaminants listed in Table I of this section at a concentration
equal to or greater than the respective value given in that table unless the
waste is excluded from classification as a solid waste or hazardous waste
or is exempted from regulation pursuant to 40 CFR section 261.4. Where
the waste contains less than 0.5 percent filterable solids, the waste itself,
after filtering using the methodology outlined in Method 131 1, is consid-
ered to be the extract for the purposes of this section;
(A) a waste that exhibits the characteristic of toxicity pursuant to sub-
section (a)(l) of this section has the EPA Hazardous Waste Number'spe-
cified in Table I ofthis section which corresponds to the toxic contami-
nant causing it to be hazardous;
