HomeMy WebLinkAbout1236 Monte Vista Pl NOV 10-31-2024 Notice to Correct Code Violation(s)/Notice of Violation (Courtesy Warning Prior to Issuance of Administrative Citation) November 1, 2024 Michael J & Kimberly J Ernst P O Box 4616 Santa Clara, CA 95056 SUBJECT ADDRESS: 1263 Monte Vista Pl San Luis Obispo, CA 93405 APN: 052-071-028 Code Case #: CODE-000421-2024 Dear Property Owner, On October 16, 2024, City of San Luis Obispo Community Development Department staff Observed penetrations in the car port(s), fire separation, tarps on the roof, visible storage blocking the stairway, broken windows, accumulation of rubbish, building material and debris, exposed junction boxes with exposed wiring, unsecured electrical meter wall, several penetrations in interior walls, water damage in ceiling(s), and several penetrations in doors with visible damage. Staff noted the following violations of the San Luis Obispo Municipal Code or other relevant codes at the above listed address: 1. Protective Treatment – (SLO MC 15.02.130, IPMC 304.2) “All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches, trim, balconies, decks and fences, shall be maintained in good condition. Exterior wood surfaces, other than decay-resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted,. All siding and masonry joints, as well as those between the building envelope and the perimeter or windows, door and skylights, shall be maintained weather resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated in inhibit such rust and corrosion, and all surfaces with rust or corrosion shall be stabilized and coated to inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces designed fro stabilization by oxidation are exempt form this requirement.” 2. Roofs and Drainage – (SLO MC 15.02.130, IPMC 304.7) “The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be maintained in good repair and fee from obstructions.” 3. Furniture on Roof – (SLO MC 17.76.090B) “No furniture or equipment, including chairs, mattresses, couches, recreational furniture, or other materials may be placed on any roof, patio cover, carport, shet top, or similar structure, except for the following. A. Roof-top equipment, including antennas, satellite dishes, masts, poles heating, ventilation, air conditioning equipment, and similar devices that are designed for roof- top installation, and were lawfully installed, may remain on the roof as long as they are properly maintained. B. Furniture or other equipment may be placed on a roof deck or other similar place that was lawfully designed and created for such use. All such furniture and accessories located on a roof deck shall be secured as necessary to prevent wind damage ro dislocation.” 4. Exterior Walls – (SLO MC 15.02.130, IPMC 304.6) “All exterior walls shall be free from holes, break, and loose or rotting materials; and maintained weatherproof and properly surface coated where required to prevent deterioration.” 5. Interior Surfaces – (SLO MC 15.02.130, IPMC 305.3) “All interior surfaces, including windows and doors, shall be maintained in good, clean and sanitary condition. Peeling, chippin, flaking of abraded paint shall be repaired, removed or covered. Cracked or loose plaster, decayed wood and other defective surface conditions shall be corrected.” 6. Electrical System Hazards – (SLO MC15.02.140 IPMC 604.3) “Where it is found that electrical system in a structure constitutes a hazard to the occupants or the structure by reason of inadequate service, improper fusing, insufficient receptacle and lighting outlets, improper wiring or installation, deterioration or damage, or for similar reasons, the code official shall require the defects to be corrected to eliminate the hazard.” 7. Means of Egress – (SLO MC15.02.140, SLO MC 15.02.130, IPMC 702.1) “A safe, continuous and unobstructed path of travel shall be provided from any point ina building or structure to the public way. Means of egress shall comply with International Fire Code.” 8. Fire-resistance-rated assemblies – (SLO MC15.02.140, SLO MC 15.02.130, IPMC 703.1) “The required fire-resistance-rating of fire-resistance-rated walls, fire stops, shaft enclosures, partitions and floors shall be maintained.” 9. Accumulation of rubbish or garbage – (SLO MC 15.02.130, IPMC 308.1) “Exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage.” Corrective Action: 1. Acquire a working permit from the city of San Luis Obispo to repair all penetrations and damaged fire rated walls, ceilings, and doors in both exterior and interior walls. 2. If there are any leaks in the roof, repair them and remove the tarps, sandbags, and furniture from the roof. 3. Repair all electrical hazards (Exposed wiring, open junction boxes, unsecured voltage meter wall at the main electrical cabinet). 4. Clean and properly remove all debris from the interior and the exterior premises of the property. We request that you voluntarily take action to correct the above noted violation(s) no later than 1/06/2024. These violations constitute a public nuisance and must be abated. Failure to correct the violation(s) by the specified date will result in the issuance of an Administrative Citation requiring payment of FINES in accordance with SLOMC Chapter 1.24. For Municipal Code violations that remain uncorrected after issuance of an Administrative Citation, the City may seek enforcement by other civil or criminal remedies. Any person having a title interest in the property may request a Director’s review of this Notice by completing the enclosed Request for Director’s Review Form and submitting it to the Community Development Department via email at code@slocity.org or to 919 Palm Street, San Luis Obispo, CA 93401, within five (5) days of the date of this Notice. This Notice shall be deemed final unless you timely file a Request for Director’s Review.
