A RESOLUTION OF THE SAN LUIS OBISPO ARCHITECTURAL REVIEW
COMMISSION, FINDING THAT THE PROPOSED PUBLIC ART PIECE FOR
MEATHEAD MOVERS MEETS THE CITY’S GUIDELINES FOR PUBLIC ART
IN PRIVATE PROJECTS FOR THE PROPERTY LOCATED
AT 3600 SOUTH HIGUERA STREET
(ARCPA 94-09)
WHEREAS, the Architectural Review Commission of the City of San Luis Obispo
conducted a public hearing in the Council Hearing Room of City Hall, 990 Palm Street, San Luis
Obispo, California, on January 20, 2010, pursuant to a proceeding instituted under application
ARCPA 94-09, Aaron Steed, Meathead Movers, applicant; and
WHEREAS, notices of said public hearing were made at the time and in the manner
required by law; and
WHEREAS, the Architectural Review Commission has duly considered all evidence,
including the testimony of the applicant, interested parties, and the evaluation and
recommendations by staff, presented at said hearing.
BE IT RESOLVED, by the Architectural Review Commission of the City of San Luis
Obispo as follows:
Section 1. Findings.
1. The proposed public art is consistent with Architectural Review Commission Public Art
Criteria as stated in the City’s Public Art Manual, Appendix C, and is compatible with the
immediate site and neighborhood in terms of architectural scale, materials, land use, and
the site’s historical and environmental context.
2. The Art Jury approved the artwork design on November 6, 2009.
3. The public art complies with the standards set forth in the Community Design Guidelines
and was approved by the Architectural Review Commission in a noticed public hearing on
January 20, 2010.
Section 2. Environmental Review. Categorically exempt under Class 11, Accessory
Structures, Section 15311 of the CEQA Guidelines.
Section 3. Action. The Commission hereby approves public art application ARCPA 94-
09 allowing installation of a public art piece to satisfy requirements of development on the parcel
at 3600 S. Higuera Street, subject to the following conditions.

1. The art piece shall be constructed according to the written concept, illustration, and
location plan for the art piece approved by the Art Jury and presented for Architectural
Review Commission approval except as required to be modified in conditions of approval
herein.
2. The art piece shall be modified to include more textural contrast such as a chiseled, or rock-
like finish, to the satisfaction of the Community Development Director. The overall height
of the art piece may be increased to a maximum of 10 feet from adjacent grade.
3. Soft lighting shall be incorporated into the installation of the art piece. Lighting details
shall be submitted along with construction permits application documents and are subject
to final approval to the satisfaction of the Community Development Director. The lighting
shall be consistent with the City’s Night Sky Preservation Ordinance and appropriately
shield all lighting sources.
4. A plaque, either of the same material as the piece or other compatible material, shall be
located within the vicinity of the mural, describing its significance in reflecting th e
partnership and the company’s founding in San Luis Obispo. All plaque details shall be
submitted with construction permit documents and are subject to final approval by the
Community Development Director.
5. The property owner is responsible for providing all maintenance necessary to preserve the
public art in good condition, and to protect it against physical defacement, mutilation, or
alteration. Prior to placing the art, the applicant and owner of the site shall execute and
record a covenant requiring public art maintenance.
6. Public art installed or integrated into a construction project may not be removed or altered
without the approval of the City Council. If the art is to be removed, an in -lieu fee equal to
the original art requirement must be provided to the City for deposit into the City’s Art In-
Lieu account, or replace the artwork with one of comparable value approved by the City
Council.
On motion by Vice-Chair Palazzo, seconded by Commissioner Hopkins, and on the following
roll call vote:
AYES: Commrs. Palazzo, Hopkins, Wilhelm, Root, Weber, and Ehdaie
NOES: None

ABSENT: Commr. Duffy
The foregoing resolution was passed and adopted this 20th day of January, 2010.
