Item 3 - Use permit U 0672. Request to allow outdoor sales (building materials)
3600 South HiauPra Street, C-H zone, 84 Lumber Company, applicant.
Ken Bruce, Assistant Planner - The applicant is requesting a use permit for a lumber
yard whichis consistent with general plan and zoning on site. Staff has some
concern with development of site which are reflected in recommended conditions of
approval.
Chairperson Schneider opened the public hearing.
Dennis Brook, 84 Lumber Company - Regarding condition five, we are extending sewer
lines across the frontage. There is a development in process across the street
that is thinking of putting a road parallel to South Higuera. I am working with
neighbors in area to create a sewer benefit district. Until everyone is in
agreement to extend the sewer, I would like to use a holding tank. I have done
this in other cities, i.e. San Francisco -and Santa Rosa,for about three years.
Ken Bruce - Under the Municipal Code septic tanks within the city limits are not
acceptable. This area has been noted as a 604-A deficiency, no sewage line ser-
ving the property. The applicant submitted a letter agreeing to provide the sewer
line, therefore, staff did not report the 604-A deficiency. The Eagles Lodge, a
motel housing complex and proposed nursery, are not served by sewer line. Since
you have submitted a request for the use permit, it is your responsibility to
install the sewer line and work out an agreement with the other proposed uses in
the area to contribute to the cost. Or you could wait to build the lumber yard
until the other developers are ready to build, or extend the sewer line.
Commr. Fonte - Is it possible for the city to request a bond be given to the city
to insure the completion of the sewer work until Mr. Brook can organize the sewer
district?
Dennis Brook - Regarding condition 15, I plan to place my outdoor storage about
300 feet from the street. I proposea chainlink fence with vines growing on it be
incorporated within my landscaping plans. Most of the property is in the flood
zone. Jon Ecklund (Architectural Review Commission staff person) gave me suggestions
about how to place redwood on fence for aesthetic purposes.
Ken Bruce - Screening of outdoor storage is a code requirement; there is no
definition of what type of screening must be done. Redwood slates would be
acceptable. Vines may not be acceptable.
Chairperson Schneider closed the public hearing.
Dan Smith - I would suggest that condition five remain as a condition of approval
and applicant appeal the condition to the City Council to request a holding tank
be allowed in interim of getting benefit district together. Staff would like to
see a cooperative effort between the property owners.
Commr. Andrews - I like the idea of submitting a bond to the city; but not for
three years.

Commr. Billig - Stated concern about condition eight; fire alarm with local bells
being required.
Dan Smith - Because the system is a heat -activated alarm, the bells would allow
the Fire Department a faster response time.
Commr. DeNeve - Concerned about condition ten; not specifying how much land would
be required.
Ken Bruce - We are awaiting a response from the Corporation of Engineers regarding
the flood -prone areas in San Luis Obispo. We either had to put -off the applicant's
request until such a report is submitted or require a dedication of land with no
specific amount designated at this time. Staff would suggest that condition ten
be revised to read:, "Applicant shall dedicate sufficient area adjacent to San
Luis Creek to permit possible creek widening to accomodate a 100-year frequency
storm to the approval of the city engineer (per Corporation of Engineer study)."
Commr. Andrews - I do not think condition one should be required in the conditions
of approval since it i,s mandated by city"ordinance.
Ken Bruce - The applicant uses the conditions of approval as a check list. This
is why it is included.
Commr. Andrews - Then I would suggest that condition one be modified to read:
"Applicant shall prepare and submit precise development plans for Architectural
Review Commission review and approval."
Commr. Billig - I have a problem with the sewer line extension and how the matter
will be resolved. I do not like the holding tank idea, but I do understand what
the intent of it is. I do not like to set a precendent of allowing holding tanks
within the city limits.
Commr. Fonte - Condition 15, screening in rear should not be required. Condition
5, the City Council should be aware of the commission's desire to require the
applicant to post a bond to provide required sewer line.
Commr. DeNeve - Condition 5, should pay his share of the extension of the sewer
line. Condition 15, outdoor storage area screening is fine, but not in rear.
Commr. Schneider - Concerned about allowing holding tanks in the city. Question
the need for sidewalks in this area; curbs and gutters are fine. No screening is
needed in back for condition 15.
On motion of Commr. Miller, seconded by Commr. Andrews that the Planning Commission
adopt resolution no. 1199-78 subject to the following conditions:
1. Applicant shall prepare and submit precise development plans for Architectural
Review Commission review and approval.
2. Applicant shall install street trees to the approval of the Public Services
Department.
3. All utilities shall be underground.
4. Applicant shall dedicate to the city and improve sufficient right-of-way on
Higuera Street to accommodate a 42-foot section from street centerline to
property line. Said improvements shall consist of curb, gutter, sidewalk,
and street paving. Dedication and improvements shall be to the approval of the
City Engineer.

5. Applicant shall extend a 12-inch sewer main to serve the subject property to
the approval of the City Engineer.
6. Applicant shall pay water acreage and frontage fees as determined by the
City Engineer.
7. Applicant shall pay water acreage and frontage fees as determined by the
City Engineer.
8. Applicant shall install a heat -activated fire alarm system with local bells
throughout the main structure to the approval of the Fire Department.
9. Applicant shall install city standard fire hydrants at the property frontage
on Higuera Street an on site to the approval of the Fire Department.
10. Applicant shall dedicate sufficient area adj.acent to San Luis Creek to permit
possible creek widening to accommodate a 100-year frequency storm to the
approval of the City Engineer (per Corporation of Engineer Study).
11. All structures on site shall be flood proofed to accommodate a 100-year
frequency storm to the approval of the City Engineer.
12. Applicant shall grant an avigation easement to the County of San Luis Obispo
for the entire property. Said easement shall be to the approval of the County
Airport Land Use Commission.
13. All areas of developed portion of site noted on site plan as "Gravel Area"
shall be covered with an all-weather dust -free surface (oiled redrock)
acceptable to the Community Development Director.
14. The undeveloped rear portion of the site shall be maintained in a clean,
safe, and orderly manner to the satisfaction of the Community Development
Director. 40
15. All outdoor storage areas shall be screened with a six-foot high fence (code
requirement) except rear fence on westerly project boundary.
16. Any extension of the facilities (i.e. additional structures and/or
intensification of the use) shall require conditional use permit approval.

Item 4 - Use permit U 0667. Request to 411ow a single-family residence on a
non -conforming lot, 1900 Woodla d Drive, A/C-40 zone, Neil Maloney,
applicant.
Ken_B_ruce,_Assistant_ Planner - The appli ant needs a use permit to build a house
on a legal non-conf-orming lot in the A/C 40 zone. Staff inspected site and found
the plans and proposed improvements do n t seem to match. Three acres of lot are
within city limits and one acre is in th county. As you will recall, there was
a 604-A water deficiency reported and th Planning Commission recommended miti-
gating measures to the City Council whic was adopted on June 21, 1978. Staff
needs more time to analyze site and requ sts use permit be continued to regular
meeting of July 19, 1978. During this time staff will work with applicant in
rectifying the difference between the si e and plans proposed. Staff has con-
cerns regarding the access to public rig t-of-way, grading on -site, city's
general plan policies, circulation, on M . Maloney's lot and adjacent area,
topography of area, utility extension and loop water line. The applicant has
indicated does not agree to a continuance.
