Walter, Director of Public Works Prepared By :Hal Hannula, Supervising Civil Enginee r Diane Dostalek, Engineering Consultan t SUBJECT :APPROVAL OF THE FINAL MAP AND ACCEPTANCE OF SUBDIVISIO N IMPROVEMENTS FOR TRACT 3039,730 FOOTHILL BOULEVAR D (TR 108-07 ) RECOMMENDATION 1.Adopt a resolution approving the Final Map for Tract 3039, 730 Foothill Boulevard ; and 2.Adopt a resolution accepting the public improvements and certifying completion of the require d private subdivision improvements for Tract 3039, 730 Foothill Boulevard . DISCUSSIO N Backgroun d A tentative map for Tract 3039 (TR 108-07) located at 730 Foothill Boulevard (see Attachment 1 fo r vicinity map)was approved by City Council on October 21, 2008, by Resolution No . 10034 (Serie s 2008) (Attachment 2). The tentative map (Attachment 3) approved a one-lot condominium tract map for the purposes of creating six residential units. Approving the Final Ma p The tentative map has an initial 2-year life per Municipal Code Section 16 .10 .150 . With th e automatic extensions granted by the State Legislature per Sections 66452 .22 and 66452 .23 of the Subdivision Map Act, this vesting tentative map now has an expiration date of October 21, 2014 . The final map is ready to be approved and recorded . Section 66474 .1 of the Subdivision Map Ac t states that "a Legislative body shall not deny approval of a final or parcel map if it has previously approved a tentative map for the proposed subdivision and if it finds that the final or parcel map i s in substantial compliance with the previously approved tentative map ."All conditions related to th e map have been met and/or guaranteed with appropriate sureties or agreements . The approval of a final map by the City Council is considered a ministerial action . A draft resolution approving the final map is attached (Attachment 4). Accepting the Public Improvements and Certifying Completion of Private Improvement s Public improvements for this project include sidewalk reconstruction, driveway approach , installation of a street light, and water and sewer connections . The remaining subdivisio n improvements are private improvements including but not limited to driveways,on-site utility services, sewer main, and storm drain improvements . Meeting Date July 17, 201 2 Item Number c 3 Approval of the Final Map for Tract 3039,730 Foothill (TR 108-07)Page 2 With the exception of the street light on Foothill Boulevard, all of the public and private subdivisio n improvements have been completed to the satisfaction of the City . These improvements have been in place for almost one year, and no defects have been found . Therefore, no 10% warranty is bein g collected for the improvements . A $6,000 faithful performance surety has been collected t o guarantee installation of the street light . The street light installation is currently underway . A draft resolution Accepting and Certifying Completion of the Subdivision Improvements is attache d (Attachment 5). This resolution also authorizes the Public Works Director to accept the street ligh t improvements upon completion to the satisfaction of the City . FISCAL IMPAC T There is no significant financial impact to the City associated with approving the final map fo r Tract 3039 . The public improvements constructed with this proposed subdivision will result in a mino r increase in maintenance costs for the water services and street light facilities . Those additional expenses will be absorbed by Public Works and Utilities within existing budget authority . CONCURRENCE S The Community Development Department concurs with the recommended action . ALTERNATIVE Deny tentative map .Pursuant to Section 66473 of the Subdivision Map Act, the City could den y approval of the final map, if findings are made that the requirements or conditions of the tentativ e map have not been met or performed . Staff does not recommend this alternative because all of th e conditions of the map will be met or securities deposited prior to map recordation . (2012 Series) Attachment 5 A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISP O ACCEPTING THE PUBLIC IMPROVEMENTS AND CERTIFYING COMPLETION O F THE PRIVATE IMPROVEMENTS FOR TRACT NO .303 9 (730 FOOTHILL BOULEVARD,TR 108-07) WHEREAS,the City Council made certain findings concerning Tract 3039, a s prescribed in Resolution No . 10034 (Series 2008); and WHEREAS,the City Council approved the final map for Tract 3039 per Resolution No . (2012 Series); an d WHEREAS,the subdivider has satisfactorily completed the public improvements for Tract 3039, except for the street light on Foothill Boulevard, in accordance with City standard s and specifications and has requested acceptance of the public improvements for maintenance an d operation by the City ; and WHEREAS,the subdivider has satisfactorily completed the private improvements fo r Tract 3039 in accordance with City standards, specifications and the approved plans, and ha s requested that the city certify completion of these private improvements ; an d WHEREAS,the public and private improvements, except for the street light, have bee n in place for almost one year, and no defects have been found . WHEREAS,the subdivider has submitted a surety guaranteeing installation of the stree t light . NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Lui s Obispo as follows : SECTION 1 .The City Council hereby accepts the public improvements for Tract No . 3039, except for the street light on Foothill Boulevard . SECTION 2 . The City Council hereby certifies completion of the private improvement s for Tract No . 3039 . SECTION 3 .The Public Works Director is hereby authorized to accept the street ligh t on behalf of the City and release the surety upon its completion to the satisfaction of the City .
