Good Morning,
The City of San Luis Obispo has been selected for a SB 1383 Compliance Review. As part of SB 1383, CalRecycle’s
Jurisdiction and Agency Compliance and Enforcement division (JACE) is required to conduct a compliance evaluation to
ensure that jurisdictions are meeting the requirements of SB 1383. This will include a review of the jurisdiction’s
implementation record, mandatory commercial organics recycling (MORe) and Mandatory Commercial Recycling (MCR)
programs. The IWMA maintains the implementation records for our member jurisdictions and will be the main point of
contact for this compliance review.
The IWMA staƯ has been preparing for this review with assistance from CalRecycle’s Local Assistance and Market
Development Branch and feel confident that our implementation records are complete. If we require any additional
information or assistance in coordinating site visits or record review, we will be reaching out to your team.
We have been in communication with city staƯ to let them know and will be working with the JACE team to complete the
compliance review. If you have any questions or would like any additional information, please feel free to reach out to me.

Dear Chair Robert,
I, Julie Tacker, pursuant to government code section 54960.2, demand the SLO County
Integrated Waste Management Authority (IWMA) Executive Committee cease and desist
the following practice which violates provisions of California’s open meeting laws
(California Government Section 54950 et seq.) to wit, the Ralph M. Brown Act that the
Council make an unconditional commitment as prescribed in subdivision (c) of section
54960.2 not to repeat such practices in the future:
This violation infringes upon the people’s right to remain informed and retain control over
the people’s business and directly address their public servants. Furthermore, this
violation may jeopardize the ongoing business and finality of actions taken by the IWMA.
Factual and Procedural Background
On Thursday, April 3, 2025, at approximately 10:00am the Executive Committee of the
IWMA held a meeting in violation of the Ralph M. Brown Act. The agenda for this meeting
was appeared to be a regular meeting. Although, it was not scheduled previously (no
meetings of the IWMA Executive Committee or the full Board were scheduled for the
entire month of April) per the approved 2025 calendar.

The agenda attached to the email sent to subscribers on Tuesday, April 1, 2025 at
approximately 4:23 PM, posted on the IWMA website and posted to the front door of the
IWMA office at 555 Chorro St., Suite D-2 all violated the Brown Act by failing to identify
that the meeting was special.
In 2003, the California Attorney General’s Office published a 114 page Brown Act
Handbook that says, “Special Meetings Under the Act, the presiding officer or a majority of
the body may call a special meeting. So long as substantive consideration of agenda items
does not occur, a majority may meet without providing notice to the public in order to call
the meeting and prepare the agenda. (216 Sutter Bay Associates v. County of Sutter (1997)
58 Cal.App.4th 860, 881-882.) Notice of a special meeting must be provided 24 hours in
advance of the meeting to all of the legislative body members and to all media outlets who
have requested notification. (§ 54956; 53 Ops.Cal.Atty.Gen. 245, 246 (1970).) The notice also
must be posted at least 24 hours prior to the meeting in a location freely accessible to the
public. The notice should indicate that the meeting is being called as a special meeting,
and shall state the time, place, and business to be transacted at the meeting. No other
business shall be considered at the special meeting. Notice is required even if the meeting is
conducted in closed session, and, even if no action is taken. A member of the local body may
waive failure to receive notice of the meeting by fil ing a written waiver prior to the meeting
or by being present at the meeting. At every special meeting, the legislative body shall
provide the public with an opportunity to address the body on any item described in the
notice before or during consideration of that item. (§ 54954.3(a).) The special meeting notice
shall describe the public’s rights to so comment. (§ 54954.3(a).)”
The agenda that was posted includes instructions for written public comment:
Clearly, there was no way to comply with these instructions on such short notice (i.e. by
9:00am Wednesday, April 2nd).
Additionally, the error was brought to the attention of the IWMA Executive Director, Clerk
and Legal Counsel’s at approximately 4:17pm on Wednesday, April 2nd. The prudent thing
to do at that late notice would have been to reschedule the meeting. Since the meeting
was to be held in the authority’s office, a corrected agenda could have easily been reposted
for a meeting 24 hours later in the same location without having to search for a new
location, as early as 5:00pm on that Thursday. Instead the meeting was held in violation of
the Brown Act.

The District has 30 days from receipt of this letter to provide me with an unconditional
commitment to cease, desist from, and not repeat the practices noted above. The district’s
failure to do so will entitle me to file an action for legal remedy, including attorney’s fees
and costs.

handling, purchasing, travel, timecard tracking, payroll, fiscal processes, and more. While District Management is
ultimately responsible, the County policies, procedures, and systems provide a solid foundational framework for

Thank you for passing this on. No one has jurisdiction except Supervisor Dawn Ortiz-Legg who issues an annual
grading permit for this very unagricultural activity.
Every current construction project within San Luis area is using this site. Just follow the trucks. I will make sure
the city is not using it without permits in upcoming projects.
Eric Hughes of planning department has stated the permit has a “ministerial” designation, meaning there are no
conditions - other than annual volume of 12,000 cubic yards - which is exceeded first 6 months. But the county
isn’t counting, to my knowledge. So the property owner is providing a needed site for construction activity with
absolutely no regulation or monitoring. No one is considering the residential urban/rural interface or dust
control or traffic impacts or noise.

geographically to the Perozzi Ranch 4400 Orcutt Road where we are on the receiving end of the
commercial trucking and leveling of 1,000’s of cubic yards of imported construction soil.
I have reached out continually to Dawn Ortiz-Legg during 2024 as well as code enforcement. You
may know that this importation of epic annual amounts of foreign soil is operating under a
ministerial ag grading permit with annual renewal devoid of any public input. And the county is
counting cubic yards imported currently.
Just wondering if Integrated Waste Management has any oversite or interest in this clearly
commercial trucking activity. We must disclose this to future buyers of our property. Why doesn’t
Waste Management list this for public disclosure?
I am spearheading our neighborhood group. Many of us are furious about this kind of thing
operating under the radar.
Can we bring this topic up before the board?

I’m looking at the CalRecycle permit for this site is for a chipping and grinding operation for green material. The do state that
they were going to import 6000 cubic yards of fill for the project. I think that would be under the County land use. I can inquire
about this in detail once I am back in town. I do not know what the County has permitted on this site for improvements.
The green material site has a permit for 200 tons per day of green material and fifteen truck trips per day.
I recall when this was initially proposed, this facility was the first response to the need for a greenwaste operation to replace the
facility at Cold Canyon when that was forced to close in 2011. Since then, the HZI facility has filled that need.
Traffic and facility siting are always contentious issues with neighbors.

We live on Huckleberry Lane adjacent to Islay Hill Open Space. Our house is probably closest geographically to the Perozzi Ranch
4400 Orcutt Road where we are on the receiving end of the commercial trucking and leveling of 1,000’s of cubic yards of
imported construction soil.
I have reached out continually to Dawn Ortiz-Legg during 2024 as well as code enforcement. You may know that this importation
of epic annual amounts of foreign soil is operating under a ministerial ag grading permit with annual renewal devoid of any
public input. And the county is counting cubic yards imported currently.
Just wondering if Integrated Waste Management has any oversite or interest in this clearly commercial trucking activity. We
must disclose this to future buyers of our property. Why doesn’t Waste Management list this for public disclosure?
I am spearheading our neighborhood group. Many of us are furious about this kind of thing operating under the radar.
Can we bring this topic up before the board?

provide comments for this proposed project and for your agency's consideration of these comments as
part of the Califomia Environmental Quality Act (CEQA) process.
PROJECT DESCRIPTION
The City of Compton Planning & Economic Development Department, Planning Division, acting as Lead
Agency, has prepared and circulated a Mitigated Negative Declaration (MND) in order to comply with
CEQA and to provide information to, and solicit consultation with, Responsible Agencies in the approval
of the proposed project.
Ron Rinell and the Peroui Family Tnnst requested a Conditional Use Permit (CUP) to allow for the
construction and operation of a green waste management composting facility. The facility would collect
and process organic material such as tree waste, leaves, manure and similar feedstock into a soil
amendment material. The facility would consist of two composting sites, approximately 4 acres in size
each. The project would result in the disturbance of approximately 8 acres on three parcels (APN 044-
01 1-003, 004, and 029) totaling 630 acres, including 6,000 cubic yards of till. The proposed project is on
the Perozzi Ranch, a 1,100 acre cattle ranch. The project site is within the Agriculture land use category
and is located at 4400 Orcutt Road approximately % of a mile east of Tank Farm Road, and east of the
city of San Luis Obispo. The site is in the San Luis Obispo planning area.
Each of the 4 acre composting sites would be contained with an earthen berm and would include
operational areas for staging, feedstock storage, grinding, mixing, windrow, curing, screening, storing and
shipping, and holding ponds to contain drainage and mnoff. The daily allowable maximum feedstock
(green waste and manure) received would not exceed 300 tons per day (equivalent to 500 cubic yards per
day). The daily allowable maximum volume of materials onsite for all operational phases (receiving,
processing, windows, curing, screening and storage) would be 41,441 cubic years per day.
The facility would operate Monday through Saturday between the hours of 9:00 AM and 3:00 PM, and
would not be open to the public. The maximum allowable truck/vehicle trips would be 150 per day and
no more than 15 trucks/vehicles per hour.

Air Quality
The MND requires that the Air Pollution Control District (APCD) approve the Odor Impact Minimization
Plan (OIMP). Has the APCD approved the OIMP? Please note that this is not a requirement of Title 14,
Califomia Code of Regulations (14 CCR). CalRecycle staff received a draft OIMP in August 2013 from
the project proponent, and found that this draft version meets the requirements of 14 CCR, Section
17863.4.
Dust control for the proposed facility would be monitored and mitigated through 14 CCR, Section
l7867(a)(2): All handling activities shall be conducted in a manner that minimizes vectors, odor impacts,
litter, hazards, nuisances, and noise impacts, and minimizes human contact with, inhalation, ingestion,
and transportation of dust, paniculates, and pathogenic organisms.
Hours of Operation
The current green material chipping and grinding operation hours of operation are 7:00 a.m. to 3:30 p.m.
Monday through Friday. The MND identifies that the facility will operate from 9:00 a.m. to 3:00 p.m.
Monday through Saturday. Are these the hours for the receipt of materials or do these hours also include
all ancillary,maintenance, material receipt, and processing activities expected to occur at the facility? It
is recommended that the MND state the hours for maintenance, site operations, receipt of materials, and
public and commercial access.
Permitting Requirements
CalRecycle is responsible for providing regulatory oversight of solid waste handling activities, including
composting operations/facilities, relative to permitting and inspections in San Luis Obispo County. The
permitting and regulatory requirements for composting operations and facilities are contained in Title 14
or 27 CCR.
CONCLUSION
CalRecycle staff thanks the Lead Agency for the opportunity to review and comment on the
environmental document and hopes that this comment letter will be useful to the Lead Agency in carrying
out their responsibilities in the CEQA process.
CalRecycle staff requests copies ofany subsequent environmental documents, copies of public notices
and any Notices of Determination for this project. Refer to 14 CCR, Section l5094(d) that states in part:
If the project requires discretionary approval from any state agency, the local lead agency shall also,
within five working days of this approval, file a copy of the notice of determination with the Office of
Planning and Research [State Clearinghouse].
If the environmental document is adopted during a public hearing, CalRecycle staff requests ten days
advance notice of this hearing. If the document is adopted without a public hearing, CalRecycle staff
requests ten days advance notification of the date of the adoption and project approval by the decision-

Thank you for including Peter Cron in my correspondence.
Yes, we are aware of the wood chipping activity on the property with 15 truck trips daily.
Very different from the greenwaste project that was initiated in 2005 with the county to meet needs of or
community with regards to landfill's barring greenwaste. Just before approval, the Arbors neighbors were
noticed by mailing December 17, 2013. Due to overwhelming opposition by local residents in spite of county
approval, the Greenwaste Management application was withdrawn by Tim Perozzi and Ron Rinell. ( see
attachments) Thankfully Kompogas came to the rescue with a very compact, clean and effective m echanism for
recycling greenwaste in San Luis Obispo.
The present use of Perozzi's ranch involves importation of construction dirt from all construction sites south of
the grade. This is done with a "ministerial" agricultural grading permit issued annually by the County Board of
Supervisors without public comment. Our concern is the incredible amounts of truck trips (some summer days
are 50!) to this undisclosed and unregulated site which always exceed the limits of 12,000 cubic yards annually.
I am asking for public disclosure of this commercial activity so that future residents can consider the area on
Hansen Lane and Arbors when deciding to live nearby. We all know where the RR track, airport and landfill is but
no one knows about this site currently except those wondering why dump trucks are traveling by our houses on
a daily basis.
Its under the radar right now. Not happy about this current use with no public disclosure.

that they were going to import 6000 cubic yards of fill for the project. I think that would be under the County land use. I

can inquire about this in detail once I am back in town. I do not know what the County has permitted on this site for
improvements.
The green material site has a permit for 200 tons per day of green material and fifteen truck trips per day.
I recall when this was initially proposed, this facility was the first response to the need for a greenwaste operation to
replace the facility at Cold Canyon when that was forced to close in 2011. Since then, the HZI facility has filled that need.
Traffic and facility siting are always contentious issues with neighbors.

they were going to import 6000 cubic yards of fill for the project. I think that would be under the County land use. I can inquire
about this in detail once I am back in town. I do not know what the County has permitted on this site for improvements.
The green material site has a permit for 200 tons per day of green material and fifteen truck trips per day.
I recall when this was initially proposed, this facility was the first response to the need for a greenwaste operation to replace the
facility at Cold Canyon when that was forced to close in 2011. Since then, the HZI facility has filled that need.

Thank you for including Peter Cron in my correspondence.
Yes, we are aware of the wood chipping activity on the property with 15 truck trips daily.
Very different from the greenwaste project that was initiated in 2005 with the county to meet needs of or
community with regards to landfill's barring greenwaste. Just before approval, the Arbors neighbors were
noticed by mailing December 17, 2013. Due to overwhelming opposition by local residents in spite of county
approval, the Greenwaste Management application was withdrawn by Tim Perozzi and Ron Rinell. ( see
attachments) Thankfully Kompogas came to the rescue with a very compact, clean and effective m echanism for
recycling greenwaste in San Luis Obispo.
The present use of Perozzi's ranch involves importation of construction dirt from all construction sites south of
the grade. This is done with a "ministerial" agricultural grading permit issued annually by the County Board of
Supervisors without public comment. Our concern is the incredible amounts of truck trips (some summer days
are 50!) to this undisclosed and unregulated site which always exceed the limits of 12,000 cubic yards annually.
I am asking for public disclosure of this commercial activity so that future residents can consider the area on
Hansen Lane and Arbors when deciding to live nearby. We all know where the RR track, airport and landfill is but
no one knows about this site currently except those wondering why dump trucks are traveling by our houses on
a daily basis.
Its under the radar right now. Not happy about this current use with no public disclosure.

Dear Ms. Fowler:
Thank you for allowing the Department of Resources Recycling and Recovery (CalRecycle) staff to
provide comments for this proposed project and for your agency's consideration of these comments as
part of the Califomia Environmental Quality Act (CEQA) process.
PROJECT DESCRIPTION
The City of Compton Planning & Economic Development Department, Planning Division, acting as Lead
Agency, has prepared and circulated a Mitigated Negative Declaration (MND) in order to comply with
CEQA and to provide information to, and solicit consultation with, Responsible Agencies in the approval
of the proposed project.
Ron Rinell and the Peroui Family Tnnst requested a Conditional Use Permit (CUP) to allow for the
construction and operation of a green waste management composting facility. The facility would collect
and process organic material such as tree waste, leaves, manure and similar feedstock into a soil
amendment material. The facility would consist of two composting sites, approximately 4 acres in size
each. The project would result in the disturbance of approximately 8 acres on three parcels (APN 044-
01 1-003, 004, and 029) totaling 630 acres, including 6,000 cubic yards of till. The proposed project is on
the Perozzi Ranch, a 1,100 acre cattle ranch. The project site is within the Agriculture land use category
and is located at 4400 Orcutt Road approximately % of a mile east of Tank Farm Road, and east of the
city of San Luis Obispo. The site is in the San Luis Obispo planning area.
Each of the 4 acre composting sites would be contained with an earthen berm and would include
operational areas for staging, feedstock storage, grinding, mixing, windrow, curing, screening, storing and
shipping, and holding ponds to contain drainage and mnoff. The daily allowable maximum feedstock
(green waste and manure) received would not exceed 300 tons per day (equivalent to 500 cubic yards per
day). The daily allowable maximum volume of materials onsite for all operational phases (receiving,
processing, windows, curing, screening and storage) would be 41,441 cubic years per day.
The facility would operate Monday through Saturday between the hours of 9:00 AM and 3:00 PM, and
would not be open to the public. The maximum allowable truck/vehicle trips would be 150 per day and
no more than 15 trucks/vehicles per hour.

COMMENTS
Air Quality
The MND requires that the Air Pollution Control District (APCD) approve the Odor Impact Minimization
Plan (OIMP). Has the APCD approved the OIMP? Please note that this is not a requirement of Title 14,
Califomia Code of Regulations (14 CCR). CalRecycle staff received a draft OIMP in August 2013 from
the project proponent, and found that this draft version meets the requirements of 14 CCR, Section
17863.4.
Dust control for the proposed facility would be monitored and mitigated through 14 CCR, Section
l7867(a)(2): All handling activities shall be conducted in a manner that minimizes vectors, odor impacts,
litter, hazards, nuisances, and noise impacts, and minimizes human contact with, inhalation, ingestion,
and transportation of dust, paniculates, and pathogenic organisms.
Hours of Operation
The current green material chipping and grinding operation hours of operation are 7:00 a.m. to 3:30 p.m.
Monday through Friday. The MND identifies that the facility will operate from 9:00 a.m. to 3:00 p.m.
Monday through Saturday. Are these the hours for the receipt of materials or do these hours also include
all ancillary,maintenance, material receipt, and processing activities expected to occur at the facility? It
is recommended that the MND state the hours for maintenance, site operations, receipt of materials, and
public and commercial access.
Permitting Requirements
CalRecycle is responsible for providing regulatory oversight of solid waste handling activities, including
composting operations/facilities, relative to permitting and inspections in San Luis Obispo County. The
permitting and regulatory requirements for composting operations and facilities are contained in Title 14
or 27 CCR.
CONCLUSION
CalRecycle staff thanks the Lead Agency for the opportunity to review and comment on the
environmental document and hopes that this comment letter will be useful to the Lead Agency in carrying
out their responsibilities in the CEQA process.
CalRecycle staff requests copies ofany subsequent environmental documents, copies of public notices
and any Notices of Determination for this project. Refer to 14 CCR, Section l5094(d) that states in part:
If the project requires discretionary approval from any state agency, the local lead agency shall also,
within five working days of this approval, file a copy of the notice of determination with the Office of
Planning and Research [State Clearinghouse].
If the environmental document is adopted during a public hearing, CalRecycle staff requests ten days
advance notice of this hearing. If the document is adopted without a public hearing, CalRecycle staff
requests ten days advance notification of the date of the adoption and project approval by the decision-
making body.

Dear Ms. Fowler:
Thank you for allowing the Department of Resources Recycling and Recovery (CalRecycle) staff to
provide comments for this proposed project and for your agency's consideration of these comments as
part of the Califomia Environmental Quality Act (CEQA) process.
PROJECT DESCRIPTION
The City of Compton Planning & Economic Development Department, Planning Division, acting as Lead
Agency, has prepared and circulated a Mitigated Negative Declaration (MND) in order to comply with
CEQA and to provide information to, and solicit consultation with, Responsible Agencies in the approval
of the proposed project.
Ron Rinell and the Peroui Family Tnnst requested a Conditional Use Permit (CUP) to allow for the
construction and operation of a green waste management composting facility. The facility would collect
and process organic material such as tree waste, leaves, manure and similar feedstock into a soil
amendment material. The facility would consist of two composting sites, approximately 4 acres in size
each. The project would result in the disturbance of approximately 8 acres on three parcels (APN 044-
01 1-003, 004, and 029) totaling 630 acres, including 6,000 cubic yards of till. The proposed project is on
the Perozzi Ranch, a 1,100 acre cattle ranch. The project site is within the Agriculture land use category
and is located at 4400 Orcutt Road approximately % of a mile east of Tank Farm Road, and east of the
city of San Luis Obispo. The site is in the San Luis Obispo planning area.
Each of the 4 acre composting sites would be contained with an earthen berm and would include
operational areas for staging, feedstock storage, grinding, mixing, windrow, curing, screening, storing and
shipping, and holding ponds to contain drainage and mnoff. The daily allowable maximum feedstock
(green waste and manure) received would not exceed 300 tons per day (equivalent to 500 cubic yards per
day). The daily allowable maximum volume of materials onsite for all operational phases (receiving,
processing, windows, curing, screening and storage) would be 41,441 cubic years per day.
The facility would operate Monday through Saturday between the hours of 9:00 AM and 3:00 PM, and
would not be open to the public. The maximum allowable truck/vehicle trips would be 150 per day and
no more than 15 trucks/vehicles per hour.

COMMENTS
Air Quality
The MND requires that the Air Pollution Control District (APCD) approve the Odor Impact Minimization
Plan (OIMP). Has the APCD approved the OIMP? Please note that this is not a requirement of Title 14,
Califomia Code of Regulations (14 CCR). CalRecycle staff received a draft OIMP in August 2013 from
the project proponent, and found that this draft version meets the requirements of 14 CCR, Section
17863.4.
Dust control for the proposed facility would be monitored and mitigated through 14 CCR, Section
l7867(a)(2): All handling activities shall be conducted in a manner that minimizes vectors, odor impacts,
litter, hazards, nuisances, and noise impacts, and minimizes human contact with, inhalation, ingestion,
and transportation of dust, paniculates, and pathogenic organisms.
Hours of Operation
The current green material chipping and grinding operation hours of operation are 7:00 a.m. to 3:30 p.m.
Monday through Friday. The MND identifies that the facility will operate from 9:00 a.m. to 3:00 p.m.
Monday through Saturday. Are these the hours for the receipt of materials or do these hours also include
all ancillary,maintenance, material receipt, and processing activities expected to occur at the facility? It
is recommended that the MND state the hours for maintenance, site operations, receipt of materials, and
public and commercial access.
Permitting Requirements
CalRecycle is responsible for providing regulatory oversight of solid waste handling activities, including
composting operations/facilities, relative to permitting and inspections in San Luis Obispo County. The
permitting and regulatory requirements for composting operations and facilities are contained in Title 14
or 27 CCR.
CONCLUSION
CalRecycle staff thanks the Lead Agency for the opportunity to review and comment on the
environmental document and hopes that this comment letter will be useful to the Lead Agency in carrying
out their responsibilities in the CEQA process.
CalRecycle staff requests copies ofany subsequent environmental documents, copies of public notices
and any Notices of Determination for this project. Refer to 14 CCR, Section l5094(d) that states in part:
If the project requires discretionary approval from any state agency, the local lead agency shall also,
within five working days of this approval, file a copy of the notice of determination with the Office of
Planning and Research [State Clearinghouse].
If the environmental document is adopted during a public hearing, CalRecycle staff requests ten days
advance notice of this hearing. If the document is adopted without a public hearing, CalRecycle staff
requests ten days advance notification of the date of the adoption and project approval by the decision-
making body.

I’m looking at the CalRecycle permit for this site is for a chipping and grinding operation for green material. The do state that
they were going to import 6000 cubic yards of fill for the project. I think that would be under the County land use. I can inquire
about this in detail once I am back in town. I do not know what the County has permitted on this site for improvements.
The green material site has a permit for 200 tons per day of green material and fifteen truck trips per day.
I recall when this was initially proposed, this facility was the first response to the need for a greenwaste operation to replace the
facility at Cold Canyon when that was forced to close in 2011. Since then, the HZI facility has filled that need.
Traffic and facility siting are always contentious issues with neighbors.

I attended last Tuesday city council meeting regarding Tank Farm Road and Airport area. So appreciate your depth of knowledge
in these areas.
Why doesn’t IWM list 4400 Orcutt Road as a receiving site for construction dirt? I realize the property in question is in the
county, but wanted to know your feeling about residential impacts for city residents.
We live adjacent to Islay Hill Open Space. Our house is probably closest geographically to the Perozzi Ranch
4400 Orcutt Road where we are on the receiving end of the commercial trucking and leveling of 1,000’s of cubic yards of
imported construction soil.
I have reached out continually to Dawn Ortiz-Legg during 2024 as well as code enforcement. You may know that this importation
of epic annual amounts of foreign soil is operating under a ministerial ag grading permit with annual renewal devoid of any
public input. And the county is counting cubic yards imported currently.
Just wondering if Integrated Waste Management has any oversite or interest in this clearly commercial trucking activity. We
must disclose this to future buyers of our property. Why doesn’t Waste Management list this for public disclosure?
I am spearheading our neighborhood group. Many of us are furious about this kind of thing operating under the radar.
Can we bring this topic up before the board?

Please find comments below as they relate to items on the May 14, 2025 agenda.
Please consider this my “Non-Agenda Public Comment.”
A. Again, what is missing on the agenda is a performance review of the Executive
Director and (former) Deputy Director related to the complaint I filed with your
Board on February 17, 2025.
B. Additional missing items from the agenda relate to the Cease and Desist letters for
February 25, related to the confusion surrounding the meeting of February 13, 2025
held at the office at “555 Chorro St., Unit D”, as it turns out the meeting was held in
Suite D-2. The March 17, 2025 regarding your District Legal Counsel’s the failure to
announce the Closed Session items prior to adjourning taking public comment on
the items and adjourning. Lastly, the April 12, 2025 regarding the Executive
Committee’s special meeting agenda that nowhere on it said the word “Special.”
These letters all threaten litigation, it is your responsibility as board members to go
into closed session and discuss how to respond in each instance.
C. On May 9th, at approximately 8:15am I visited the 555 Chorro office. As I entered
the facility, I dodged trash that appears to be left by the unhoused that live in and
around the shrubbery on the property. This is unwelcoming and chronic. You are
obligated to provide a safe environment for all your staff and the public who enter
your facility. Is your staff using the buddy system to come and go into/out of the
building? Perhaps cameras should be installed to monitor any nefarious activity.

D. Additionally, during my visit I learned that Mr. Cron is the only person with the code
to the agency’s safe. As a best practice, the agency should have an inventory of
what’s in the safe, and someone available at all times that can access the safe along
with a second person for an additional set of eyes when it is accessed. Access to the
safe is an important internal controls issue. What if there were an emergency? What
if Mr. Cron couldn't be reached? What if embezzlement were suspected? With only
one person having access, that person would be the first suspected. Please develop
a policy to address this.
Regarding item 7., in reviewing the Monthly Financial Reports, you paid $90.93 for trash
service in February for 555 Chorro. This service is identified as an expense of the
condominium owner’s maintenance fund, per section VII of the CC&R’s.
The recurring expense for a “Controller,” i.e. Heter Accountancy has no contract.
Your legal fees have skyrocketed. The January legal bill I received through the California
Public Record Act has no detail to explain what the AMMCG is doing for the money they
charge. I do not expect to see everything, due to the litigious nature of some of the work,
but each of you should be seeing these bills and scrutinizing them.
In item 9, your board will discuss 870 Osos St., as surplus property. Per the minutes for
March 12, “D) Authorizes and directs staff to take all necessary and appropriate steps to
dispose of the surplus property, including contact at least three brokers
and the selection of a broker for the purposes of the sale.”
The board direction to Mr. Cron, in the motion made by Charles Bourbeau as transcribed
here was: “Authorizes and directs staff to take all necessary and appropriate steps to
dispose of the surplus property in accordance with the resolution, including contact of at
least three brokers for the selection of a broker for the sale.”
The staff report before you makes no mention of which real estate brokers were contacted
and what their respective commission compensation bids were.
Item 11, FY2025/2025, I believe should read “2025/2026”. The plan or preliminary budget
for the next fiscal year 1) page 60 of the board packet is too small of type to read. 2)
without the audit of FY2023/2024 or the year-to-date of FY2024/2025 it is difficult to
judge if FY2025/2026 budget is based in reality. You have nothing to compare to but for
the approved budget from last year, and some estimated accruals. There is nothing
concrete here.
The citizens of this county would appreciate your board further decreasing the waste
management fee.

surprising and unwise. It is hoped that your Board will hire his replacement swiftly. It is
also hoped that your candidates can begin their new position with fresh eyes and not be
influenced by previous management. The history of mismanagement at the IWMA needs to
stop repeating itself.

Recommendation: Authorize the Interim Executive Director to award $10,000 in grant funds to
the City of San Luis Obispo to purchase and install indoor receptables for trash, recycling, and
organics in high-use City facilities to enhance internal recycling efforts.
13. Solid Waste Management Fee Study – Rate Study Final Report
Recommendation: Receive and file the Final Report of the Solid Waste Management Fee Rate
Study and Rate Stabilization Model and add the Report as addendum A-4 to Policy FS-1 Fee
Setting Policy.
14. Mandatory Annual Status Report on Public Sector Vacancies (AB 2561)
Recommendation: Receive and file mandatory annual status report on public sector vacancies.
15. Third Quarter Budget Review for Fiscal Year 2024/2025
Recommendation: Receive, discuss, and file the Third Quarter Budget, Fiscal Year 2024/2025.

The Bioenergy Market Adjusting Tariff (BioMAT) Program is a
California Public Utilities Commission (CPUC) procurement
program initiated to encourage the development of small
bioenergy projects. Eligible generators can enter into a standard
contract with 3CE at a price set by a market-based mechanism.
Program Requirements Projects must meet the following
eligibility criteria: 5MW or less

The team at digester, Kanadevia-Inova are looking to transition away from PG&E for their power purchase agreement. Do
you have a contact at 3CE that I can refer them to? It would be nice to get credit for all of the power generated not just the
parasitic load.
