SUBJECT: ADVISORY BODY APPOINTMENTS FOR UNSCHEDULED VACANCIES
ON THE HUMAN RELATIONS COMMISSION AND THE TOURISM
BUSINESS IMPROVEMENT DISTRICT BOARD
RECOMMENDATION
Confirm the appointment of Jennifer Fields to the Human Relations Commission (HRC)
and Mark Eads to the Tourism Business Improvement District Board (TBID), for the
remainder of the respective vacated terms as detailed in the report.
POLICY CONTEXT
The Advisory Body Handbook outlines the recruitment procedures, membership
requirements, and term limits for City advisory bodies. Also contained in the Advisory
Body Handbook are the bylaws for all advisory bodies, some of which include additional
membership requirements. Additionally, the City Council Policies and Procedures
Manual, describes the “Appointment Procedure” and “Process” for Advisory Body
appointments. Recruitment and appointment recommendations were performed in
conformance with all recruitment procedures, processes, and bylaws found in these
resources.
California Government Code Section 54972, Local Appointments List (Maddy Act)
requires that on or before December 31st of each year, each legislative body shall prepare
an appointments list for their boards, commissions, and committees whose members
serve at the pleasure of the legislative body. This obligation was met and is on -going.
DISCUSSION
Annual appointments to the various City Advisory Body Committees were made at the
April 1, 2025 City Council meeting. The process for those appointments included
recruitment by the City Clerk’s Office, interviews, and recommendations by the respective
Council Liaison Subcommittees, with final confirmation of those recommendations made
by the full Council. The applications of qualified candidates who are not chosen for

immediate appointment are held for one -year for possible consideration in the event an
unscheduled vacancy occurs. When unscheduled vacancies occur throughout the year,
outreach to the qualified applicant list is conducted along with any necessary new
recruitment for the given vacancies.
Human Relations Commission: Due to a resignation in June, there is an unscheduled
vacancy on the Commission. Using the qualified applicants list from the annual
recruitment, the Council Liaison Subcommittee members assigned for the HRC, Mayor
Stewart and Vice Mayor Shoresman, recommend Jennifer Fields to fill the vacant term
ending March 31, 2027.
Tourism Business Improvement District Board: Due to a resignation in May 2025, there
is an unscheduled vacancy on the Board. There was no qualified applicant list following
the recent annual recruitment and therefore recruitment was re-opened (per Maddy Act
requirements) identifying three qualified candidates. The Council Liaison Subcommittee
members assigned for the TBID, Councilmember Francis and Vice Mayor Shoresman,
recommend Mark Eads to fill the vacant term ending March 31, 2028.
Other Vacancies: In addition to these two vacancies on the HRC and the TBID, t he City
Clerk’s Office is currently recruiting for unscheduled vacancies for the Area Agency on
Aging (AAA), the Administrative Review Board (ARB), the Construction Board of Appeals
(CBoA), and the Tree Committee (TC).
The AAA position has been open since April of this year. The City Council appoints
one member to this 12-member Board for this regional body, serving both San Luis
Obispo and Santa Barbara County Senior Citizens.
The ARB position has been vacant since October 2024. This is a three -member
board that acts as the final decision maker for City administrative appeal hearings
relating to administrative citations issued for certain contested San Lu is Obispo
Municipal Code enforcement. If the appellant intends to challenge the City action
by writ, they must appeal the administrative citation to the Administrative Review
Board (rather than a hearing officer.)
The CBoA position is for a regular member (not a member representing the
disabled community) and has been vacant since mid June. The CBoA hears and
decides appeals of orders, decisions, and determinations made by the building
official relative to the applications and interpretations of various technical codes.
In addition, the members of the CBoA may meet as the Appeals Board for Disabled
Access for the purpose of considering appeals to the standards in the California
Building Standards Code regarding accommodations for persons with physical
disabilities.
The TC position has been vacant since the beginning of May. While the annual
recruitment had identified additional candidates that might have filled this position,
due to personal obligations, no applicants were currently able to make the needed
commitment. The TC makes recommendations to the Council and staff on tree

policies and regulations.
Applications for these volunteer positions may be found on the City’s Job Opportunities
webpage.
Public Engagement
Notices that the City was accepting applications for the above listed Advisory Bodies were
placed on the City’s website and “e-notification” service, listed in the annual Local
Appointments List (Maddy Act Notice – GC 54972) posted on the City Website and City
Information kiosk, and distributed via City social media outlets in November 2024, for the
Annual Recruitment cycle. Following Maddy Act guidelines, notices were posted in the
City Information kiosk outside City Hall and on the Advisory Body Vacancies page of the
City’s website alerting the public that the City was specifically accepting applications for
the vacancies on the HRC and the TBID when the vacancies occurred.
CONCURRENCE
As presented in the recommendations, the various Council Liaison Subcommittees for
the Advisory Bodies are in concurrence with the stated recommendations along with the
City Clerk’s Office, who coordinated and organized the process.
ENVIRONMENTAL REVIEW
The California Environmental Quality Act does not apply to the recommended action in
this report, because the action does not constitute a “Project” under CEQA Guidelines
Sec. 15378.

There is no fiscal impact for the appointment of the above Advisory Body members.
Administration of the process is considered in the City Clerk’s annual budget.
ALTERNATIVES
Council could recommend changes to the sub-committee recommended appointments or
direct staff to re-open recruitment for additional candidates.
