City of san tins oB>Ispo COUNCIL AGENDA REPORT ITEM N MB : FROM: Dodie Williams, BIA Administrator SUBJECT: Final passage of ordinance prohibiting dogs on Thursday nights. SUMMARY RE X14ME iDATION: Grant final passage to attached Ordinance No. 1121 DISCUSSION: The Council passed the ordinance to print on September 20, 1988, on a 4-1 vote. The ordinance allows the Police Department to enforce the prohibition of dogs during the Thursday Night Activities or during other events where their presence would interfere with the event. Major concerns are public health and safety, which have been jeopardized by recent events, and liability of the BIA and the City. SIGNIFICANT IMPACTS: No significant impacts are anticipated. CONSEQUENCES OF NOT TARING ..TBE RECOMMENDED ACTION: There would be no authority to enforce the ban instituted by the BIA on August 25, 1988. Attachment: Ordinance 1121 ORDINANCE NO. 1121 (1988 SERIES) AN ORDINANCE ADDING SECTION 6.20.050C TO THE SAN LUIS OBISPO MUNICIPAL CODE PROHIBITING DOGS ON PUBLIC STREETS DURING SPECIAL EVENTS BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Section 6.20.050C is hereby added to the San Luis Obispo Municipal Code to read as follows: , I.C. Notwithstanding any other• provision of this code, no person shall allow any dog, whether on a leash or not, to be on any public street, alley, lane, sidewalk, or other place open to and used by the public and for which an encroachment, sidewalk or street closure, or similar permit has been issued and the person(s) holding said permit have given reasonable notice that the presence of any dogs would interfere with the purposes for which the permit was issued. This prohibition shall not apply to guide or seeing-eye dogs."
